Ordinance 2678CITY OF ALAMEDA ORDINANCE NO. New Series 2678 GRANTING AN APPROPRIATE INTEREST IN LAND FROM THE CITY OF ALAMEDA TO THE UNITED STATES OF AMERICA FOR SANITARY SEWER PURPOSES ACROSS THE OAKLAND INNER HARBOR BE IT ORDA.INED BY THE COUNCIL OF THE CITY OF ALAMEDAthat: WHEREAS , the Alameda Naval Air Station is currently served by two sevIer mains , one servicing the housing east of MainStreet, and the second providing service to the remainder of the base; and WHEREAS , the existing sewer line under the Estuary is located within the area that will be dredged for the deep water port container facilities for the Port of Oakland; and WHEREAS , a replacement line will need to be constructed approximately 50 feet eastward and parallel to the existing line but 9 feet deeper to be below the dredging; and WHEREAS , the Army Corps and Navy have requested that the City of Alameda provide an additional strip of property to the United States of America for installation of the replacement line. WHEREAS an easement across the Estuary, construction of this line , was granted to the United America from the City in 1957; and f or theStates of WHEREAS , the Estuary placement ine would be located on tidelands property. NOW , THEREFORE , BE IT ORDAINED by the Counci 1 of the City of Alameda that: section The city of Alameda grants to the United States of Amer ica the appropr iate interest in land for sanitary sewer purposes across the Oakland Inner Harbor location as set forth in Exhibit A , attached hereto and incorporated herein by ref erence . Section The City Manager is hereby authorized and directed to execute , for and behalf of the City of Alameda , the appropr iate interest in land for sanitary sewer purposes across the Oakland Inner Harbor. The City Clerk is hereby directed to attest to the same. section This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its f ina 1 passage. A s trip of submerged land 30 Alameda, County of Alameda, Statelying 15 feet at right angles desc ibed centerline: feet wide, situate in the City of of California , said strip of landon each side of the following BEGINNING at a point in the United States Pierhead/Bulkhead Line extending between Harbor Line Points No. 51 and 53, in the City of Alameda, Alameda County, California, as said line was established b the Secretary of the Army on 28 June 1948 and shown on drawing on file in the Office of the District Engineer , San Francisco, California enti tIed " San Francisco Bay, California, P,ABOR LINES, Oakland-Alameda , dated 13 February 1948 , being Sheet Number 5 of 8 Shee ts of Drawing No. 1-14 -19, and said line being also the portion of the northerly boundary of that certain tract of land acquired by the United States of America (designated as "Tract 2"), by Civil Action No. 22463 -A, had in the District Courtof the United States in and for the Northern District California, Southern Division, entitled "UNITED STATES OF AMERICA, Plaintiff, vs. 69.448 acres of land , more or less in the City of Alameda, County of Alameda, State of California, CITY OF ALEDA, et al., Derendents , said line being the boundary course de signatedas "South 56'44" East, 6084.97 feet" in the Judgement on Declaration of Taking in said Civil Action No. 22463-A rendered January 29, 1943, said POINT OF BEGINNING being distant North 72049' 46" West, along the aforesaid Pierhead/Bulkhead Line, 916. feet from the Harbor Line Point No. 53, the California Coordinate System, Zone III coordinates of the POINT OF BEGINNING are Y=475 830.76 and X 176,650.80 and all bearings used herein are referenced to the meridian ' of said California Coordinate System, Zone III, from said POINT OF BEGINNING thence North 7 16' East, 413.10 feet to a Point of Terminus in the boundary line between theCity of Oakland and the City of Alameda, said boundary being confirmed in March, 1925, by the Superior Court of Alameda County, under a special proceeding brought by the City of Alameda vs. the City of Oakland, as provided for by Legislative Act (Statutes of 1921, page 1067), and upheld, on appeal, April 1926, the coordinates of said Point of Terminus being Y=4 76,240.54 and X=l, 476,703.05. The southwesterly terminus of said strip of land being a portion of the aforesaid northerly boundary of lands of the united States of America (Naval Air Station), and the northeasterly terminus of said strip of land being a portion of the aforesaid boundary line between the City of Oakland and the City of Alameda. containing in said strip of land 0.28 acres, more or less.
