AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING SECTION 2-33
(PAYMENTS OF DEBTS OWING TO THE CITY) TO ARTICLE III
(DEPARTMENTS OFFICES AND BUREAUS) OF CHAPTER II
(ADMINISTRATION), THEREOF AUTHORIZING THE ACCEPTANCE OF
NEGOTIABLE INSTRUMENTS AND CREDIT CARDS FOR PAYMENT OF DEBTS
OWING TO THE CITY , AND AUTHORIZING THE REJECTION OF BURDENSOME
UNROLLED COINS AS PAYMENT OF DEBTS TO THE CITY
BE IT ORDAINED by the Counci 1 of the city of Alamedathat:
section . The Alameda Municipal Code is hereby amended
by adding section 2-33 (Payments of Debts Owing to the City) to
Article III (Departments 1 Offices and Bureaus), of Chapter II
(Administration) thereof to read:
2-33 PAYMENTS OF DEBTS OWING TO THE CITY.
2-33.Authoriza tion to Accept Negotiable Instruments.
Any off icer of the city may, in his or her discretion
accept negotiable paper in payment of any assessment , license,
permi t , or fee or other obligation owing to the city.
2-33.Negotiable Paper.
As used in this section , negotiable paper means
checks and drafts and express and post-off ice money orders.

2-33.Effect of Acceptance of Negotiable Paper.
The acceptance of negotiable paper constitutes payment of
any amount owing to the City as of the date of acceptance when , but
not before , the negotiable paper is duly paid.
2-33.Payment by Unrolled Coin.
Any officer of the city may refuse to accept unrolled
coins in payment of any assessment , license , permit , fee or other
obligations owing to the City if , in the reasonable judgment of
such off icer, the amount or number of unrolled coins presented in
payment is burdensome or unreasonable.
2-33.Payment by Credit Card.
a. Purpose. The purpose of this section is
authorize payment by credit card of any assessment , licensepermit, fee or other obligation owing to the City, and to implement
the provisions of Government Code Section 6254.
b. Authorization to Accept Credit Cards.

c. Effect of Acceptance of Credi Cards.1. The honoring of a credit card pursuant to
subsection 22-33.5 constitutes payment of the amount owing to theci ty as of the date the credit card is honored provided the credit
card draft is paid following its due presentment to a card issuer
or draft purchaser.2. If any credit card draft is not paid following
due presentment to a card issuer or draft purchaser or is charged
back to the city for any reason , any record of payment made by the
city honoring the credit card shall be void. Any receipt issued in
acknowledgment of payment shall also be void. The obligation of the
cardholder shall continue as an outstanding obligation as though no
payment had been attempted.
d. Authorization to Impose Fees by Resolution.
City council may impose by resolution a fee for the use of a creditcard, not to exceed the costs incurred by the city in providing for
payment by credit car. These costs may include , but shall not be
limited to the payment of fees or discounts (including payment fees
to the card issuer or draft purchaser). The payment of any fees or
discounts to the card issuer or draft purchaser shall be deducted
or accounted for prior to any statutory or other distribution offunds received from the card issuer or draft purchaser to the
extent not recovered from the card holder.

22-33.Payment by Debit Card.
Any off icer of the city may utilize debit cards in
payment of any assessment , license , permit , fee or other obligation
owning to the city. For purposes of this section , "debit card"
means any credit card , automatic teller machine (ATM) card , or any
other card or device which permits the immediate transfer of funds
from an account of the card holder to an account in the name of thecity.
section Severance Provision.
That if any section , subsection , sentence , clause , or
phrase of this ordinance is , for any reason , held to be invalid or
unconsti tutional, such decision shall not affect the validity or
consti tutionali ty of the remaining portions of this ordinance.
The City Council of the ci ty of Alameda hereby declares that
would have passed this ordinance , and each section , subsection
clause or phrase hereof , irrespective of the fact that any one ormore sections , subsections , sentences , clauses and phrases are
declared to be invalid or unconstitutional.

effect from and after the expiration of thirty (3 0) days from the
date of its final passage.
