AMENDING THE ALAEDA MUICIPAL CODE BY ADDING
SUBSECTION 2-61.(JOINT PURCHASES WITH PUBLIC
AGENCIES) TO SECTION 2-61 (BIDDING PROCEDURES ON
PUBLIC PROJECTS AND GOODS AND SUPPLIES), ARTICLE V
(ADMINISTRATIVE PROCEDURES AND POLICIES) OF CHAPTERII (ADMINISTRATION), THEREOF, AUTHORIZING JOINT
PURCHASES OF MATERIALS AND SUPPLIES WITH OTHER
PUBLIC AGENCIES
WHEREAS, Alameda City Charter Section 3 -15 requires that
purchases of materials and supplies exceeding one thousand dollars
be put out to bid; and
WHEREAS, City Charter Section 3 -15 provides that the City
Council , by four affirmative votes can authorize an open market
purchase if it determines that the materials and supplies may be
purchased at a lower price on the open market and
WHEREAS, the City Council hereby determines that the open
market purchase of materials and supplies via a j oint purchase with
another government agency or agencies may result in savings to the
City.
that:BE IT ORDAINED by the Council of the City of Alameda
Section 1 The Alameda Municipal Code is hereby amended
by adding subsection 2-61.7 (Joint Purchases with Public Agencies)to Section 2 - 61 (Bidding Procedures on Public proj ects and Goodsand Supplies), Article V (Administrative Procedures and policies)
of Chapter II (Administration) to read:
2 - 61.7 Joint Purchases with Public Agencies.
. Subj ect to the provisions of subsection 2 - 62.andnotwi thstanding any other provisions of this chapter, materialssuppliesequipment, vehicles apparatus or other personal
property or goods may be purchased together or in cooperation with
any other city, county state, federal or other public agency,
including a joint powers authority, provided the purchase is the
result of competitive bidding or proposal and is made in compliancewith the competitive bid or proposal requirement of any
participating agency or organization in a manner that is consistent
with law.
Section 2.Severability.
If any section, subsection, sentence, clause , phrase or
portion of this ordinance is for any reason held invalid orunconstitutional by any court or competent jurisdiction, suchportion shall be deemed a separate, distinct and independent
provision of such ordinance and shall not affect the validity ofthe remaining portions thereof.
Section This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.

of the City of Alameda in regular meeting assembled on the 20th
