AMENDING THE ALEDA MUICIPAL CODE BY AMENDING
CERTAIN SECTIONS OF CHAPTERS XIII (BUILDING AND
HOUSING) AND CHAPTER XXX (DEVELOPMENT REGULTIONS)
TO BRING THEM INTO CONFORMCE WITH THE ADOPTION OF
UNIFORM BUILDING AND ASSOCIATED CODES AS CONTAINED
IN ORDINANCE NO. 2714 N. S.
The City Council of the City of Alameda does hereby ordain as
follows:
Section 1 The Alameda Municipal Code is hereby amended bysubstituting "Alameda Building Code" for "Uniform Building Code" insubsection (a) of section 13 -21. 4 (Procedure for Preservation of
Historical and Cultural Monuments) of Article VII of Chapter XIII
(Building and Housing)
Section The Alameda Municipal Code is hereby amended bydeleting sections 13 -31.1 through 13 -31.4 of Article X (Minimum
Noise StaLdards) I substituting the following sections 13 -31., 13-
31.2 and 13 - 31.3, and renumbering the remaining sections of 13 - 31:
13-31.1 Purpose.
The purpose of this section is to establish uniform
minimum noise insulation performance standards to protect
persons wi thin new hotels, motels, apartment houses, and
dwellings from the effects of excessive noise, including butnot limited to hearing loss or impairment and persistent
interference with speech and sleep.
13-31.2 Application and Scope.
The provisions of this section shall apply to all new
hotels, motels and residential structures located within ahigh exposure area.
13-31.3 Defini tions.
As used in this section:
High exposure area shall mean an area where the total
community noise equivalent level (the CNEL of all sources), as
determined by the general plan, attains or exceeds sixty-five (65)
dB.
Section 3 The Alameda Municipal Co e is hereby amended by
deleting the definition of II Building Official" in section 13 - 3 8.
(Definitions) of Article XII (Floating Homes) of Chapter XIII
(Building and Housing)
Section 4 The Alameda Municipal Code is hereby amended by
deleting section 13-38.(Applicability of Other Regulations) of
Article XII (Floating Homes) of Chapter XIII (Building and Housing)
in its entirety and substituting a new 13-38.6 to read as follows:
13-38.Applicabili ty of Other Regulations.
Code Requirements. Except as otherwise provided herein
every floating home shall comply with the requirements of
sections 13-through 13-of Article I (Uniform Codes
Relating to Building Construction and Maintenance) of Chapter
XIII and section 15-(Alameda Fire Code) of the JI.lamedaMunicipal Code.
Section 5 The Alameda Municipal Code is hereby amended by
deleting the second paragraph in subsection (j) of section 13-38.
(Moorage Standards) of Article XII (Floating Homes) of Chapter XIII(Building and Housing) in its entirety and substituting thefollowing;
All collection and disposal systems shall
constructed in accordance with the applicable chapter of
the Alameda Plumbing Code , and all pumping systems shall
meet the design and construction requirements of the
applicable section of the Alameda Plumbing Code.
Section 6 The Alameda Municipal Code is hereby amended by
deleting the first paragraph of subsection (k) of section 13 -38.
(Moorage Standards) of Article XII (Floating Homes) of Chapter XIII(Building and Housing) in its entirety and substituting thefollowing;
k. Fuel Gas Piping. All gas piping installed within a
floating home moorage including such piping intended to serve
floating homes and other floating structures and such piping
as may be required to serve dockside facilities shall be
installed in accordance with the Alameda Plumbing Code and
with the following special requirements:
Section 7 The Alameda Municipal Code is hereby amended by
deleting subsection e. 2 of section 13 - 3 8.18 (Electrical Wiring and
Service) of Article XII (Floating Homes) of Chapter XIII (Building
and Housing) in its entirety and substituting therefor:

Section 8 The Alameda Municipal Code is hereby amended bydeleting section 13 -38.19 (Plumbing) of Article XII (Floating
Homes) of Chapter XIII (Building and Housing) in its entirety andsubstituting the following;
13-38.Pluming.
The plumbing of all floating homes as defined in this
section shall comply with the requirements of the Alameda
Plumbing Code, except as follows:a. Building Drain. The building drain shall be deemed
to be that part of the lowest piping of a drainage system
which receives the discharge from all soil, waste and other
drainage pipes inside the walls of the floating home or other
structure and conveys it to a sewage device conforming to
subsection 13-38.15 (j), hereof.b. Plastic Piping. A.C. drainage, waste and vent
piping and P. V. C. drainage, waste and vent piping conformingto the product and installation standards of the Alameda
Plumbing Code will be permitted as an alternate method of
construction when first approved by the Building Official.
Plastic pipe in floating homes or other structures shall be
limited to that part within the walls of the floating home orother structure.
Section The Alameda Municipal Code is hereby amended by
amending section 13 -38.21 (Fuel Gas Piping) of Article XII(Floating Homes) of Chapter XIII (Building and Housing) to delete
"Chapter 12 of the currently effective Uniform Plumbing Code" andsubstituting therefor, "the Alameda Plumbing Code.
Section 10 The Alameda Municipal Code is hereby amended by
deleting section 13 -4 5.(When Deemed Dwelling) of Article XIV
(Particular Structures) of Chapter XI I I (Building and Housing) in
its entirety and sUbstituting a new 13 -45.2 to read as follows;
13-45.When De med Dwelling.
Every houseboat or ark which has been drawn up on the dry
land, or which has been set up and fastened upon posts oruprights fixed in .the ground , and which is used as a place of
abode by one (1) or more persons shall be deemed a dwelling
within the meaning of the State Housing Act of the State ofCalifornia, and shall be subj ect to all the provisions of the
Alameda Building Code, the Alameda Electrical Code, theAlameda Plumbing Code, the Alameda Housing Code, and the
Alameda Fire Code.
Section 11 The Alameda Municipal Code is hereby amended by
deleting the following sentence from Section 30-2 (Definitions) of
Article I of Chapter XXX (Development Regulations) :
Building Official shall mean the City Engineer
or his authorized representative.
Section 12 The Alameda Municipal Code is hereby amended bysubstituting "Alameda Building Code " for "Uniform Building Code " in
the last sentence of paragraph (f) of section 30-5.(Permitted
Encroachments in Yards) of Article I of Chapter XXX (DevelopmentRegulations)
Section 13 The Alameda Municipal Code is hereby amended bysubstituting "Building Official" for "City Engineer" in section 30-
20.4 (Restoration of Damaged Buildings) of Chapter XXX (Development
Regulations) .
Section 14 . Any provisions of the Alameda Municipal Code, or
appendices thereto, or any other ordinances of the City
inconsistent therewith , to the extent of such inconsistencies and
no further, are hereby repealed.
Section 15 If any section, subsection , sentence, clause, or
phrase of this ordinance is, for any reason, held to be invalid or
unconstitutional, such decision shall not affect the validity or
constitutionality of the remaining portions of this ordinance. The
City Council of the City of Alameda hereby declares that it would
have passed this ordinance, and each section, subsection, clause or
phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences , clauses and phrases are declared
to be invalid or unconstitutional.
Section 16 This ordinance shall be in ull force and effect
from and after the expiration of thirty ) days from the date of
its final passage.
