ADOPTING A CONTRACT OF SALE FROM THE CITY OF ALAMEDA TO
THE COMMUNITY IMPROVEMENT COMMISSION OF THE CITY OF
ALAMEDA FOR THE REAL PROPERTY GENERALLY KNOWN AS THE
FLEET INDUSTRIAL SUPPL Y CENTER
WHEREAS Section 67 of the Deparment of Defense Appropriations Act of 1996
Public Law 104-106 , authorizes the Secretar of the Navy to transfer the Fleet Industrial Supply
Center ("FISC") propert at former Naval Air Station Alameda to the City of Alameda at no or
nominal" consideration; and
WHEREAS , the FISC is within the boundaries of the Business and Water Front
Improvement District and the Alameda Point Improvement District; and
WHEREAS , on June 4 , 1996 , the Community Improvement Commission of the City of
Alameda ("CIC") initiated the process to select a developer for the FISC; and
a: WHEREAS , on November 4 , 1996 , pursuant to a Request for Qualifications process , the
CIC selected three qualified developers to paricipate in the Requests for Proposals (RAP); and
WHEREAS , on Januar 21 , 1997 , the Requests for Proposals were issued; and
WHEREAS , the CIC anticipate final selection ofthe developer including entering into an
Exclusive Negotiation Agreement ("ENA") on Februar 3 , 1998; and
WHEREAS , conveyance of the FISC from the City to the CIC is necessar to implement
the FISC development , as guided and managed by the crc exercising its redevelopment powers;
and
WHEREAS , approval of the City land sale contract to the CIC prior to final development
selection allows the ENA to be executed between the CIC and the selected developer; and
WHEREAS , Se ction 3-10 of the City Charer requires conveyance of real property to be
authorized by Ordinance upon the affirmative vote of four members of the City Council.
NOW , THEREFORE , BE IT ORDAINED by the Council of the City of Alameda , and
upon the affrmative vote of four members of the Council that:
Section I . The City Council of the City of Alameda hereby approves and
authorizes the contract of sale from the City of Alameda to the Community Improvement
Commission of the City of Alameda for the real property generally known as the Fleet Industrial
Supply Center.
Section 2.The City Manager of the City of Alameda be , and is hereby authorized
to execute , for and on behalf of the City of Alameda, the contract of sale from the City of
Alameda to the Community Improvement Commission of the City of Alameda for the real
property generally known as the Fleet Industrial Supply Center, substantially in the form and
containing the terms and conditions and covenants as set out in the Contract of Sale between the
City of Alameda and the Community Improvement Commission of the City of Alameda for
Purchase and Sale of the Fleet Industrial Supply Center , attached to the Staff Report , and the
City Clerk is hereby authorized and directed to attest to the same.
Section 3 . This ordinance shall be in full force and effect from and after the
expiration ofthirty (30) days from the date of its final passage.
