Ordinance 2756CITY OF ALAMEDA ORDINANCE NO. 2756 New Series AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING A NEW SECTION 4-25 (PARKG PROHIBITED IN FRONT YARDS AND SIDE YARDS OF RESIDENTIALL Y ZONED PROPERTY) TO CHAPTER IV (OFFENSES AND PUBLIC SAFETY) BE IT ORDAINED by the City Council of the City of Alameda that: Section 1. There is hereby added to the Alameda Municipal Code , Chapter IV (Offenses and Public Safety) a new section 4-25 which shall read as follows: 25.Parking Is Prohibited in Front Yards and Side Yards of Residentially Zoned Property. 25.Purpose. The City Council finds and declares that the parking of vehicles in front and side yards of residentially zoned propert between the public right of way and any building or structure constitutes visual blight and depreciates neighborhood property values. The City Council finds it in the interest of the public health, safety and welfare to prohibit the parking of vehicles in front and side yards in residentially zoned districts. 25.Prohibitions; Exceptions. a. It shall be unlawfl for the owner , lessee , tenant , occupier or person in possession of any lot or parcel situated in a residentially zoned area to park a vehicle in the front yard , side yard or any additional area between the right of way and any residence or accessory building or structue located therein or permit, consent , suffer , or allow any other person to so park a vehicle. Notwithstanding the foregoing: Vehicles may be parked in driveways. 2. Parking of vehicles is permtted in any setback or on any surace which has been previously approved for parking purposes pursuant to applicable Building and/or Zoning Code provisions. 25.Authority to Issue Citation. The Code Enforcement Officer or other person authorized and designated by the Chief of Police to enforce this code is authorized to issue a citation for a violation of this section. 25.Violation is an Infraction. Any person convicted of violating any of the provisions of this section shall be deemed guilty of an infraction and shall be punishable as set forth in subsection 1-5.1 (e) of this Code. Section 2 Ifany section, subsection, sentence , clause , or phrase of this ordinance , for any reason, held to be invalid or unconstitutional , such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council of the City of Alameda hereby declares that it would have passed this ordinance , and each section, subsection clause or phrase hereof, irrespective of the fact that anyone or more sections , subsections , sentences clauses and phrases are declared to be invalid or unconstitutional. Section 3 This ordinance shall be in full force and effect from and after the expiration ofthirty (30) days from the date of its final passage.
