CITYOFALAMEDAORDINANCENO.2824 NewSeries AMENDINGTHEALAMEDAMUNICIPALCODEBY AMENDINGCHAPTERXIII(BUILDINGANDHOUSING)BY ADDINGANEWSECTION13-56(EXCAVATIONINTOTHE MARSHCRUST/SUBTIDALZONEATTHEFORMERNAVAL AIRSTATIONALAMEDAANDFLEETINDUSTRIALSUPPLY CENTER,ALAMEDAANNEXANDFACILITY)TOARTICLE XVII(PITS,WELLSANDEXCAVATIONS) WHEREAS,themarshlandsandnearshoreareasoncelocatedadjacenttotheisland ofAlamedawerefilledwithdredgematerialbetweenapproximately1900and1940;and WHEREAS,themarshcrust,andthesubtidalzoneextendingfromit,isahorizonthat isidentifiableinthesubsurface(theinterfaceatthebottomofthefillmaterial)whichcontains remnantsofgrassesandotherintertidalandsubtidalfeatures;and WHEREAS,themarshcrust/subtidalzonealsocontains,atleastlocally,elevated levelsofpetroleum-relatedsubstances,suchassemi-volatileorganiccompounds,whichsubstances mayposeanunacceptablerisktohumanhealthandtheenvironmentifexcavatedinmarsh crust/subtidalzonematerials,broughttothegroundsurfaceandhandledinanuncontrolledmanner; and WHEREAS,properhandling,storageanddisposalofmaterialsexcavatedfromthe marshcrust/subtidalzone,pursuanttostateandfederalhazardousmaterialslaws,willhelpeliminate unacceptableexposure'sandriskstohumanhealthandtheenvironment;and WHEREAS,theDraftBase-wideFocusedFeasibilityStudyfortheFormerSubtidal AreaandMarshCrustandGroundWater(U.S.Navy,February20,1999)recommends implementationbytheCityofaninstitutionalcontrol,suchasanexcavationordinance,asaremedial actionrelatedtothecleanupbytheUnitedStatesNavyofNavalAirStationAlamedaandtheFleet IndustrialSupplyCenter,AlamedaAnnexandFacility,whichclosedmilitaryinstallationsare anticipatedtobetransferredtotheCity;and WHEREAS,itcanbeseenwithacertaintythatadoptionofapermittingprogramby theCitythatrequiresproperhandling,storageanddisposal,pursuanttoexistingstateandfederal hazardousmaterialslaws,ofmaterialsexcavatedfromthemarshcrust/subtidalzonewillnotinvolve orrequireanyphysicalactivitiesotherthanoptionaltestingofexcavatedmaterialsand,therefore, isexemptfromtheCaliforniaEnvironmentalQualityActpursuanttoCaliforniaCodeof Regulations,title14,section15061(b)(3)becausethereisnopossibilitythattheenactmentofthe ordinancemayhaveasignificanteffectontheenvironment. NOW,THEREFORE,BEITORDAINEDbytheCounciloftheCityofAlameda that: Section1.TheAlamedaMunicipalCodeisherebyamendedbyaddinganewSection 13-56(ExcavationIntotheMarshCrust/SubtidalZoneattheFormerNavalAirStationAlamedaand FleetIndustrialSupplyCenter)toArticleXVII(Pits,WellsandExcavations)ofChapterXIII (BuildingandHousing)thereoftoread: 13-56 EXCAVATIONINTOTHEMARSHCRUST/SUBTIDALZONEATTHE FORMERNAVALAIRSTATIONALAMEDAANDFLEETINDUSTRIAL SUPPLYCENTER,ALAMEDAANNEXANDFACILITY. 13-56.1 DEFINITIONS. ForpurposesofthisSection13-56thefollowingdefinitionsshallapply: Bay shallmeanSanFranciscoBay,includingtheOaklandEstuaryandtheOakland InnerHarbor. DTSC shallmeantheCaliforniaEnvironmentalProtectionAgency,Departmentof ToxicSubstancesControL Earthmaterial shallmeananyrock,naturalsoilorfilloranycombinationthereof. Excavation shallmeanthemechanicalremovalofearthmateriaL Hazardousmaterials,asdefinedinCaliforniaHealthandSafetyCodesections 25260(d)and25501(k),shallmeananymaterialthat,becauseofitsquantity,concentration,or physicalorchemicalcharacteristics,posesasignificantorpotentialhazardtohumanhealthand safety,ortotheenvironment.Hazardousmaterialsinclude,butarenotlimitedto,hazardous substances,hazardouswasteandanymaterialwhichahandlerortheadministeringagencyhas reasonablebasisforbelievingwouldbeinjurioustothehealthandsafetyofpersonsorharmfulto theenvironmentifreleasedintotheworkplaceortheenvironment. Marshcrust shallmeantheundergroundlayerthatistheremnantofthetidalmarsh thatexistedalongtheshorelineofAlamedaIslandbeforefillingtocreateadditionaldryland.In manyplaces,thislayercontainssubstancesfromformerindustrialdischargesthatwereretainedin thehistoricmarshbeforefilling. Subtidalzone shallmeantheundergroundlayerthatisthepre-fillingBayfloor extensionofthehistoricmarsh.Together,themarshcrustandthesubtidalzoneconstituteasingle, continuous,undergroundlayerthatextendsBaywardoftheoriginalmeanhigherhightidelineof AlamedaIsland,beforefilling,throughouttheareathatwasfilled. Thresholddepth shallmeanthedepthbelowwhichapermitisrequiredbythis Section13-56.Thethresholddepthisconservativelyidentifiedwiththeelevationabovewhich thereislittlelikelihoodthatsubstancesfromthehistoricmarshorBayfloorwouldhavemixed duringfilling,includingamarginofsafetyabovetheelevationofthehistoricmarshsurfaceor subtidalzone.Innoeventwillthethresholddepthbeabovemeanhigherhighwater. 13-56.2 PermitRequired. a.Itshallbeunlawfulforanyperson,includingutilitycompaniesandtheir employeesandcontractors,toexcavatebelowathresholddepthabovethe marshcrust/subtidalzonewithintheareaoftheformerNavalAirStation AlamedaandFleetandIndustrialSupplyCenter,AlamedaAnnexand Facility,asdepictedinExhibitA,hereto,withoutfirstobtainingapermitin writingfromtheChiefBuildingOfficial. b.AllexcavationbelowthethresholddepthintheareasubjecttothisSection 13-56shallbeperformedsolelyinaccordancewiththepermitasapproved andissuedbytheCity. 13-56.3DepthofExcavationSubjecttoPermitRequirement. TheChiefBuildingOfficialshallestablishathresholddepth,consistentwithDTSC's remedialdecisiondocumentspertainingtothemarshcrust/subtidalzone,belowwhichapermitshall berequiredforexcavationpursuanttothisSection13-56.Thethresholddepthmayvarybylocation. TheChiefBuildingOfficialshallpublishamapdepictingtheparcelsandthresholddepthsforwhich apermitisrequiredunderthisSection13-56.TheChiefBuildingOfficialmayupdatethemap, consistentwithDTSC'sremedialdecisiondocumentspertainingtothemarshcrust/subtidalzone, asnecessarytoincorporateanynewinformationconcerningthedepthofthemarshcrust/subtidal zonereceivedbytheCitysincethepreparationoftheinitialmaporlastupdate. 13-56.4 ExceptiontoPermitRequirement. a.NopermitshallberequiredunderthisSection13-56forpiledrivingorother penetrationofthemarshcrust/subtidalzonethatinvolvesneither(i)bringing materialsfrombelowthethresholddepthtoabovethethresholddepth;nor (ii)exposureofconstructionworkerstosoilexcavatedfrombelowthe thresholddepth. b.NopermitshallberequiredunderthisSection13-56forexcavation associatedwithemergencyrepairofpublicinfrastructurefacilities;provided, however,thatsoilexcavatedfrombelowthethresholddepthintheareaofthe marshcrust/subtidalzone,asdepictedonExhibitA,mustbemanagedas thoughitwerehazardousinaccordancewithSubsection13-56.8b. 13-56.5 PermitApplication. Applicationforapermitshallbemadeinwritingonformsavailableinorfromthe BuildingServiceOfficeandshallbefiledintheBuildingServicesOffice.Subsection13-1.2of ArticleIofChapterXIIIregardingAppeals(Section204.11997UniformAdministrativeCode), AppealFee(Section204.21997UniformAdministrativeCode),Expiration(Section303.41997 UniformAdministrativeCode),PermitFees(Section304.21997UniformAdministrativeCode), andPlanReviewFees(Section304.31997UniformAdministrativeCode),shallapplytoallpermits issuedpursuanttothisSection13.56.Theinformationrequiredtobeprovidedontheapplication shallbedeterminedbytheChiefBuildingOfficialandshallincludeataminimum: a.Adescriptionandmapofthepropertythatistobeexcavatedsufficientto locatetheareaofproposedexcavationonExhibitA. bDetailedplans,preparedbyaregisteredcivilengineerlicensedintheState ofCalifornia,oftheexcavationworktobedone,includingadrawingwith dimensionstoscaleofallproposedexcavationactivity. c.Astatementofthemaximumdepthofexcavation. d.AllelevationsinplansandapplicationmaterialssubmittedtotheCityshall bereferencedtoCityDatumandshallshowdepthbelowgroundsurface. e.Acostestimateforpurposesofdeterminingtheamountofthebondrequired tobeobtainedpursuanttoSubsection13-56.11. 13-56.6 CertificationsandAcknowledgments. a.Thefollowingcertificationsshallberequiredaspartofthepermit application: 1.TheapplicantshallsignacertificationpreparedbytheChiefBuilding Officialacknowledgingreceiptofnoticethatthepropertytobe excavatedmaybeintheareaofthemarshcrust/subtidalzone,and thathazardousmaterialsmaybeencounteredduringexcavation. 2.TheapplicantshallsignacertificationpreparedbytheChiefBuilding Officialacknowledgingthatfederalandstatehazardousmaterials lawsandregulationswillapplytostorage,transportationanddisposal ofanymaterialsexcavatedfromthemarshcrust/subtidalzonethat arehazardousmaterials. 3.TheapplicantshallsignacertificationpreparedbytheChiefBuilding Officialacknowledgingliabilityfordisturbingandremovingall materialsfromthemarshcrust/subtidalzoneinaccordancewiththis Section13-56andthepermit. OrdinanceNo.2824,Revised6/15/00 b.Allbuildingandexcavationpermitsissuedforconstructionorexcavation withintheareasubjecttothisSubSection13-56shallcontainthefollowing writtenwarning: "PursuanttoSection13-56ofArticleXVIIofChapterXIIIoftheAlameda MunicipalCode,excavationworkintheareaofthemarshcrust/subtidalzone withintheareaoftheformerNavalAirStationAlamedaandFleetand IndustrialSupplyCenter,AlamedaAnnexandFacility,asdepictedinExhibit AtoSection13-56ofArticleXVIIofChapterXIIIoftheAlameda MunicipalCode,maybesubjecttospecialmaterialshandlingrequirements. Thepermitteeacknowledgesthatheorshehasbeeninformedofthespecial materialshandlingrequirementsofSection13-56ofArticleXVIIofChapter XIIIoftheAlamedaMunicipalCodeandthathazardousmaterialsmaybe encounteredduringexcavation." 13-56.7 NotificationPriortoStartofExcavation. a.Afterreceiptofapermitandnolessthantwo(2)businessdays(forty-eight (48)hoursminimum)beforecommencementofanyexcavationactivityinthe areasubjecttothisSection13-56,thepermitteeshallnotifytheChief BuildingOfficialoftheplannedstartofexcavation.Saidnotificationshall includeascheduleforanyexcavationworkthatwilllastformorethanone day. b.ThepermitteeshallgiveadequatenoticetoUndergroundServiceAlertprior tocommencinganyexcavationactivitysubjecttothisSection13-56. 13-56.8 MaterialsHandling. Thepermitteeshallelecttofollowoneormoreofthecoursesofactionsetforth belowbeforebeginninganyexcavationactivitiesintheareasubjecttothisSection13-56.Unless otherwisedemonstratedbythepermitteebymeansofreconnaissanceinvestigationpursuantto Subsection13-56.8a,orunlessthepermitteepreparessitemanagementplanspursuanttoSubsection 13-56.8c,soilbelowthethresholddepthintheareaofthemarshcrust/subtidalzone,asdepictedon ExhibitA,mustbemanagedasthoughitwerehazardouspursuanttoSubsection13-56.8b.The permitteemayelecttofollowSubsection13-56.8a,butmustcomplywithSubsection13-56.8bor 13-56.8ciftestingdemonstratesthatthematerialsbelowthethresholddeptharehazardousmaterials. Copiesofallreconnaissancetestingresultsand/orexistinginformationusedtosatisfythe reconnaissanceinvestigationrequirementsofSubsection13-56.8ashallbereportedtoandfiledwith theCity.Allobservationsorencounterswiththemarshcrust/subtidalzoneduringexcavationshall bereportedtotheCity. a.ReconnaissanceInvestigationtoRuleOutthePresenceofHazardous MaterialsBelowtheThresholdDepth. Thepermitteemayelecttousereconnaissanceborings,pursuanttoaplanprepared byaqualifiedregisteredengineerorregisteredgeologist,licensedintheStateofCalifornia,torule out,tothesatisfactionoftheChiefBuildingOfficial,thepresenceofhazardousmaterialsbelowthe thresholddepthintheareatobeexcavated.Aspartorallofthereconnaissanceplan,thepermittee maymakeuseofexistinginformation,whereappropriate,iftheexistinginformationisdirectly relevanttothelocationanddepthtobeexcavatedandcontainsobservationsorresultsofanalyses thatassistinconcludingwhetherhazardousmaterialsarepresent.Thereconnaissancereportshall includeadescriptionofallobservationsfrombelowthethresholddepthevidencingthepresenceor absenceofthemarshcrust/subtidalzone. 1.Ifhazardousmaterialsarefoundbelowthethresholddepthwithinthe areatobeexcavatedatanytime(duringreconnaissanceorduring excavation),thepermitteeshallcomplywitheitherSubsection13- 56.8borSubsection13-56.8c,athisorherelection. 2.Ifhazardousmaterialsarenotfoundbelowthethresholddepth withintheareatobeexcavated,noadditionalmaterialscontrols, exceptasotherwisemayberequiredunderapplicablefederal,stateor locallaw,arerequiredunderthisSection13-56. b.HandlingMaterialsExcavatedFromBelowtheThresholdDepthas HazardousMaterials. Ifthepermitteehasnotruledoutthepresenceofhazardousmaterialspursuantto Subsection13-56.8a,orelectsnottoprepareasitemanagementplanandmaterialstestingprogram pursuanttoSubsection13-56.8c,thepermitteeshallpresumethatmaterialsexcavatedfrombelow thethresholddepthmustbedisposedatanappropriatelypermitteddisposalfacility.Inaddition,no excavatedmaterialsfrombelowthethresholddepthmaybestockpiledpriortodisposalorreturned totheexcavation. c.PreparationofConstructionSiteManagementPlanforHandling MaterialsExcavatedFromBelowtheThresholdDepth. 1.Inlieuofhandlingmaterialsexcavatedfrombelowthethreshold depthpursuanttotherestrictionsinSubsection13-56.8b,the permitteemayelecttohireaqualifiedregisteredengineeror registeredgeologist,licensedintheStateofCalifornia,todevelopa site-specificconstructionsitemanagementplan,includingamaterials testingprogram,tothesatisfactionoftheChiefBuildingOfficial. Theconstructionsitemanagementplanshallinclude,ataminimum, provisionsgoverningcontrolofprecipitationrunonandrunofffrom stockpiledsoils,soilsegregation,securingofstockpiledsoils, durationofstockpiling,andcontingencyplansforhandlingmaterials excavatedfrombelowthethresholddepththatprovetobehazardous materials. 2.Thepermitteeshallhireaqualifiedregisteredengineerorregistered geologist,licensedintheStateofCalifornia,tooverseecompliance withtheapprovedconstructionsitemanagementplan,andshall transmittotheChiefBuildingOfficialuponcompletionoftheproject writtencertificationofcompliancewiththeconstructionsite managementplan.Thecertificationreportshallincludeadescription ofallobservationsfrombelowthethresholddepthevidencingthe presenceorabsenceofthemarshcrust/subtidalzone. 13-56.9 HealthandSafetyPlan. Theapplicantshallcausetobepreparedbyacertifiedindustrialhygienist,andkeep ontheconstructionsiteatalltimes,ahealthandsafetyplantoprotectworkersattheexcavationsite andthegeneralpublictothesatisfactionoftheChiefBuildingOfficial.TheChiefBuildingOfficial mayprepareandprovidetoapplicantsamodelhealthandsafetyplanwhich,ifusedbytheapplicant, shallbemodifiedbytheapplicant'scertifiedindustrialhygienisttosuitthespecificrequirements oftheapplicant'sproject. 13-56.10 ExcavationSiteBestManagementPractices. AllexcavationandmaterialshandlingactivitiespermittedunderthisSection13-56 shallbeconductedinaccordancewithapplicableAlamedaCountywideCleanWaterProgramBest ManagementPracticesandCityofAlamedaStormWaterManagementandDischargeControl ProgramOrdinancerequirements. 13-56.11 Bonds. UponafindingbytheChiefBuildingOfficialthatapermitshouldissuefor excavationpursuanttothisSection13-56,asuretyorperformancebondconditioneduponthe faithfulperformanceandcompletionofthepermittedexcavationactivityshallbefiledwiththeCity. SuchbondshallbeexecutedinfavoroftheCityandshallbemaintainedinsuchformandamounts prescribedbytheRiskManagersufficienttoensurethatthework,ifnotcompletedinaccordance withtheapprovedplansandspecifications,willbecorrectedtoeliminatehazardousconditions. 13-56.12 NonassumptionofLiability. Inundertakingtorequireapplicantsforcertainexcavationpermitstocomplywiththe requirementsofthisSection13-56,theCityofAlamedaisassuminganundertakingonlytopromote thegeneralwelfare.TheCityisnotassuming,norisitimposingonitselforonitsofficersand employees,anobligationforbreachofwhichitisliableinmoneydamagestoanypersonwhoclaims thatsuchbreachproximatelycausedinjury. 13-56.13 ConstructiononCityProperty. a.TheChiefBuildingOfficialshallpreparestandardworkproceduresthat complywithalltherequirementsofthisSection13-56forallCity constructionorimprovementactivitiesinvolvingexcavationbelowthe thresholddepthintheareasubjecttothisSectionl3-56.Alldepartments, boards,commissions,bureausandagenciesoftheCityofAlamedathat conductconstructionorimprovementsonlandundertheirjurisdiction involvingexcavationbelowthethresholddepthintheareasubjecttothis Section13-56shallfollowsuchstandardworkprocedures. b.TheCityshallincludeinallcontractsinvolvingexcavationbelowthe thresholddepthintheareasubjecttothisSection13-56aprovisionrequiring CitycontractorstocomplywithalltherequirementsofthisSection13-56. Allcontractsenteredintobydepartments,boards,commissions,bureausand agenciesoftheCityofAlamedathatauthorizeconstructionorimprovements onlandundertheirjurisdictioninvolvingexcavation.belowthethreshold depthintheareasubjecttothisSection13-56alsoshallcontainsuchstandard contractprovision. 13-56.14 Severability. Ifanysection,subsection,subdivision,paragraph,sentence,clauseorphraseofthis Section13-56oranypartthereofisforanyreasonheldtobeunconstitutionalorinvalidor ineffectivebyanycourtofcompetentjurisdiction,suchdecisionshallnotaffectthevalidityor effectivenessoftheremainingportionsofthisSection13-56oranypartthereof.TheCityCouncil herebydeclaresthatitwouldhavepassedeachsection,subsection,subdivision,paragraph,sentence, clauseorphraseofthisSection13-56irrespectiveofthefactthatoneormoresections,subsections, subdivisions,paragraphs,sentences,clausesorphrasesbedeclaredunconstitutionalorinvalidor effective. 13-56.15 PermitFee. Nopermitsforexcavationinthemarshcrust/subtidalzoneshallbeissuedunlessa feehasbeenpaid.ThefeeshallbesetbyCityCouncilresolution. 13-56.16 Penalties. a.Anyperson,includingutilitycompaniesandtheiremployeesand contractors,violatinganyoftheprovisionsofthisSection13-56shallbe deemedguiltyofamisdemeanor,andeachpersonshallbedeemedguiltyof aseparateoffenseforeachandeverydayorportionthereofduringwhichany violationofanyoftheprovisionsofthisSection13-56iscommitted, continuedorpermitted,andsuchviolationmaybeprosecutedandpunished asaninfractionormisdemeanorpursuanttotheprovisionsofSection1-5.1 oftheAlamedaMunicipalCode. b.Anyperson,includingutilitycompaniesandtheiremployeesandcontractors, thatcommencesanyexcavationwithoutfirstobtainingthenecessarypermits thereforshall,ifsubsequentlyallowedtoobtainapermit,payanamount,in additiontotheordinarypermitfeerequired,quadruplethepermitfee otherwiserequired. 13-56.17 RetentionandAvailabilityofPermitFiles TheCityshallmaintainfilespertainingtoallpermitsissuedunderthisSection13-56, andshallmakesuchfilesavailabletoDTSCforinspectionuponrequestduringnormalbusiness hours. 13-56.18 AmendmentofSection13-56 ThisSection13-56shallnotberepealedoramendedwithoutthirty(30)daysprior writtennoticetotheDTSCDeputyDirectorforSiteMitigation.
