Ordinance 2827CITY OF ALAMEDA ORDINANCE NO. 2827 New Series APPROVING AN AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE AN SALE AGREEMENT WITH HAROR BAY ISLE ASSOCIATES TO PURCHASE A 2.2 ACRE PARCEL FOR THE CROSS AIRPORT ROADWAY PROJECT WHEREAS, on February 17 , 1993 the City Council , by Resolution No. 12964 , made findings as a Responsible Agency, pursuant to Public Resources Code 21167 (b) that the Oakland Airport Development Program Environmental Impact Report was adequate for puroses of approving the Cross Airport Roadway Project; and WHEREAS, pursuant to Section 15162 of the CEQA Guidelines , additional environmental review is not necessar for this project; and WHEREAS, in June , 1999 , the Port of Oakland , Alameda County Transportation Authority (ACTA) City of Oakland and City of Alanleda , executed agreements for the construction and fuding of the Cross Airport Roadway Project; and WHREAS , the Cross Airport Roadway Project will be funded through Measure B and local matching funds; and WHEREAS , the proposed improvements for the Cross Airport Project located at Harbor Bay ParkwaylMaitland Drive requires theCityof Alameda to purchase 2.2 acres of right-of-way from Harbor Bay Isle Associates; and WHEREAS , ACTA wil provide the funds for the City to purchase the property by placing the fuds in an escrow account prior to the City executing the Purchase and Sale Agreement; and WHREAS , an Appraisal Report based on current real estate market value was prepared by Symers Appraisal in November , 1999 , which values the property at $1,425 000. NOW , THEREFORE , BE IT ORDAID by the Council of the City of Alameda that Section 1.The City Manager of the City of Alameda be, and is hereby authorized to execute a Purchase and Sale Agreement in a form substantially similar to that Purchase and Sale Agreement attached to the staff report from Matthew Naclerio , Public Works Director, presented at the City Council meeting of March 7 , 2000 , for and on behalf of the City of Alameda , with Harbor Bay Isle Associates to purchase a 2.2 acre parcel for the Cross Airport Roadway Project located within the Harbor Bay Business Park. Section 2.This Ordinance shall be in full force and effect from and after the expiration of thirt (30) days from the date of its final passage.
