AMENDING THE ALAMEDA MUICIPAL CODE BY
AMENDING SUBSECTION 3-59.17 (a), (FILING CLAIM) OF
SUBSECTION 3-59.17 (REFUNS) OF SECTION 3-
(UTILITY USERS TAX), OF CHAPTER III (FINANCE
TAXTION) TO SHORTEN THE FILING OF CLAIM PERIOD
FROM THREE YEARS TO ONE YEAR
BE IT ORDAIND by the City Council of the City of Alameda that:
Section 1 . The Alameda Municipal Code is hereby amended by amending
Subsection 3-59.17(a) Filing Claim , of Subsec;l lon 3-59.17 (Refunds), of Section
59 (Utility Users Tax), Chapter III (Finance and Taxation) to read as follows:
57.Refunds.
a. Filng Claim. Whenever the amount of any tax , interest or penalty has
been overpaid or paid more than once or has been erroneously or ilegally
collected or received by the City under this section it may be refunded as provided
in paragraph b. and c. of this subsection provided a claim in writing therefore
stating under penalty of perjury the specific grounds upon which the claim is
founded if fied with the Tax Administrator within one (1) year of the date of
payment. The claim shall be on forms furnished by the Tax Administrator.
Section 2 . This Ordinance shall be in full force and effect ITom and after
the expiration of thirty (30) days from the date of its final passage.
