AMENDING VARIOUS SECTIONS OF THE ALAMEDA MUNICIPAL CODE
CONTAINED IN ARTICLE I (ZONING DISTRICTS AND REGULATIONS) OF
CHAPTER XXX (DEVELOPMENT REGULATIONS) TO PROHIBIT SINGLE
RETAIL STORES LARGER THAN 90 000 SQUARE FEET IN SIZE THAT
INCLUDE MORE THAN TEN-PERCENT SALES FLOOR AREA DEVOTED TO
NON-TAXBLE MERCHANDISE
BE IT ORDAINED by the City Council of the City of Alameda that:
Section The Alameda Municipal Code is hereby amended by adding the
following definition to Section 30-2 (Definitions):
Super Store: A single retail store or tenant that exceeds
, 000 square feet in size and includes 10% or more sales
floor area devoted to non-taxable merchandise.
Section 2.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-10 (C-Neighborhood Business District , Uses
Requiring Use Permits), as shown below by underlined text , as follows:
Section 30-4.10 Large Format Retail including conversion of
existing multiple retail tenant spaces to a single tenant space
larger than 30 000 square feet (if part of a planned development
no use permit is required). Super Stores. as defined in Section 30-
2. are prohibited
Section 3.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-16 (C-entral Business District , Uses Requiring Use
Permits), as shown below by underlined text , as follows:
Section 30-16 Large Format Retail including conversion of
existing multiple retail tenant spaces to a single tenant space
larger than 30 000 square feet (if part of a planned development
no use permit is required). Super Stores. as defined in Section 30-
. are prohibited.
Section 4.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-9A.c.gg (C-C Community Commercial , Uses Requiring
Use Permits), as shown below by underlined text , as follows:
30-9A.1 (gg) Large Format Retail including conversion of
existing multiple retail tenant spaces to a single tenant space
larger than 30 000 square feet (if part of a planned
development , no use permit is required). Super Stores, as
defined in Section 30-, are prohibited.
Section 5.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-10.15 (C-M Commercial-Manufacturing, Uses Requiring
Use Permits), as shown below by underlined text, as follows:
30-10.15 Large Format Retail including conversion of existing
multiple retail tenant spaces to a single tenant space larger than
000 square feet (if part of a planned development , no use
permit is required). Super Stores, as defined in Section 30-. are
prohibited.
Section 6.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-10.15 (C-M Commercial-Manufacturing, Uses Requiring
Use Permits), as shown below by underlined text , as follows:
30-10.c .15 Large Format Retail including conversion of
existing multiple retail tenant spaces to a single tenant space
larger than 30 000 square feet (if part of a planned development
no use permit is required). Super Stores. as defined in Section 30-
2. are prohibited.
Section 7.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-4.11.14 (M-Intermediate Industrial District , Uses
Requiring Use Permits), as shown below by underlined text , as follows:
30-4.11.14 Large Format Retail including conversion of existing
multiple retail tenant spaces to a single tenant space larger than
30,000 square feet (if part of a planned development , no use
permit is required). Super Stores. as defined in Section 30-2 are
prohibited.
Section 8.The Alameda Municipal Code is hereby amended by adding new
text to Section 30-12.19 (M-2 General Industrial District , Uses Requiring
Use Permits), as shown below by underlined text , as follows:
Section 30-12.19Large Format Retail including conversion of
existing multiple retail tenant spaces to a single tenant space
larger than 30 000 square feet (if part of a planned development
no use permit is required). Super Stores. as defined in Section 30-
2. are prohibited.
Section 9.This Ordinance shall be in full force and effect from and after the
expiration of thirty (30) days from the date of its final passage.
Section 10.Severability Clause. It is the declared intent of the City Council ofAlameda that if any section , subsection , sentence , clause , phrase , or provision of thisordinance is held invalid or unconstitutional by a court of competent jurisdiction , suchinvalidity or unconstitutionality shall not be so construed as to render invalid orunconstitutional the remaining provisions of this ordinance.
Section 11.The above amendments shall be known as and referenced to asReclassification and Rezoning Amendment No.
