ORDINANCE EXTENDING THE AGREEMENT BETWEEN THE
CITY OF ALAMEDA AND WASTE MANAGEMENT OF ALAMEDA
COUNTY INC. FOR SOLID WASTE DISPOSAL SERVICES FOR
A FIVE YEAR PERIOD, UNTIL SEPTEMBER 30, 2017
WHEREAS, on April 16, 2002, the City Council entered into an
"Agreement Between the City of Alameda and Waste Management of Alameda
County Inc. (WMAC) for Solid Waste Disposal Services" (Agreement); and
WHEREAS, Section 2.04 (Options to Extend Term) of the Agreement
provides that the City can extend the Agreement for up to one five-year period
after September 30, 2012 Le., until September 30, 2017; and
WHEREAS, the City's consultant, HF&H Consultants, LLC, has reviewed
disposal contracts in the area and determined that the existing Agreement with
WMAC is competitive.
The City Council of the City of Alameda does ordain as follows:
Section 1. The City Council hereby approves a five-year extension to the
existing agreement, under all current terms.
Section 2. It is the declared intent of the City Council that if any section,
subsection, sentence, clause, phrase, or provision of this Ordinance is held
invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not be so construed as to render invalid or
unconstitutional the remaining provisions of this Ordinance.
Section 3: This Ordinance shall be in full force and effect from and after
the expiration of thirty (30) days from the date of its final passage.
