AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
CHAPTER 2 (ADMINISTRATION) ARTICLE II (BOARDS AND
COMMISSIONS) BY REPEALING SECTION 2 -20 TO DISSOLVE THE
FILM COMMISSION; AMENDING SECTIONS 2- 13.2(A); 2- 15.2(A); 2-
21.2(A) TO REVISE THE MEMBERSHIP OF THE GOLF, ECONOMIC
DEVELOPMENT, AND YOUTH ADVISORY COMMISSIONS; AND
AMENDING SECTIONS 2 -17, 2 -17.1, 2- 17.2(A), 2- 17.2(D), 2- 17.3(A), 2-
17.3(B), 2 -17.4, 2 -17.5, 2- 17.5(A), 2 -17.5 (B), 2- 17.5(C) TO CHANGE
THE NAME OF THE HOUSING AND BUILDING CODE HEARING AND
APPEALS BOARD
BE IT ORDAINED by the City Council of the City of Alameda that:
Section 1. The Alameda Municipal Code is amended by
repealing section 2 -20 in Article II of Chapter 2 in its entirety.
Section 2. The Alameda Municipal Code is amended by
changing section (a) of articles 2 -13.2; 2 -15.2; and 2 -21.2 which shall read as
follows:
2 -13.2 - Membership; Appointment; Term of Office; Removal; Vacancies
That section 2- 13.2(a) in Article II of Chapter 2 of the Code of the City of
Alameda is hereby amended to read as follows:
a. The Commission shall consist of five (5) members, all of whom shall, at
the time of their appointment and during their incumbency, be residents of the
City.
2 -15.2 - Membership; Appointment; Term of Office; Removal; Vacancies
That section 2- 15.2(a) of Article II in Chapter 2 of the Code of the City of
Alameda is hereby amended to read as follows:
a. The Commission shall consist of seven (7) members, all of whom shall,
at the time of their appointment and during their incumbency, be residents of
the City.
2 -21.2 - Membership; Appointment; Term of Office; Removal; Vacancies
That section 2- 21.2(a) in Article II of Chapter 2 of the Code of the City of
Alameda is hereby amended to read as follows:
a. The Commission shall consist of seven (7) regular members, all of
whom shall be residents or attend a school within the City.
Section 3 The Alameda Municipal Code is amended by
changing sections 2 -17, 2 -17.1, 2- 17.2(A), 2- 17.2(D), 2- 17.3(A), 2- 17.3(B),
2 -17.4, 2 -17.5, 2- 17.5(A), 2 -17.5 (B), 2- 17.5(C) which shall read as follows:
2 -17 — Housing and Building Code Hearing and Appeals Board.
That section 2 -17 in Article II of Chapter 2 of the Code of the City of Alameda
is hereby amended to read as follows:
Housing and Building Code Hearing and Appeals Commission
2 -17.1 — Board Created
That section 2 -17.1 in Article II Chapter 2 of the Code of the City of Alameda
is hereby amended to read as follows:
Commission Created
There is hereby created a commission, which shall be known as the Housing
and Building Code Hearing and Appeals Commission.
2 -17.2— Membership; Appointment; Term of Office; Removal; Vacancies
That section 2 -17.2 (a) and section 2 -17.2 (d) in Article II Chapter 2 in the
Code of the City of Alameda is hereby amended to read as follows:
a. The Commission shall consist of five (5) members, all of whom shall at
the time of their appointment and continuously throughout their incumbency
be residents of the City.
d. A member of the Commission may be removed by the vote of a
majority of the Council. A vacancy in the office of a member shall be filled for
the unexpired term by nomination and appointment by the Mayor and the City
Council, respectively, for the duration of the unexpired term of office.
2 -17.3— Meeting; Voting
That section 2- 17.3(a), 2- 17.3(b) in Article II Chapter 2 in the Code of the City
of Alameda is hereby amended to read as follows:
a. The Commission shall meet as necessary to perform the duties
outlined in subsection 2 -17.4. Meetings shall be held on a fiscal year
schedule, running July 1 through June 30. The Commission shall have the
power to establish rules for its proceedings.
b. The votes of a majority of the entire membership of the Commission
shall be necessary to take any action thereof.
2 -17.4 - Duties of the Board
That section 2 -17.4 in Article II Chapter 2 in the Code of the City of Alameda
is hereby amended to read as follows:

It shall be the duty of the Housing and Building Code Hearing and Appeals
Commission to:
2 -17.5 — Composition of Board; Special Terms, Qualifications, and
Conditions
That section 2 -17.5, 2- 17.5(a), 2- 17.5(b), 2- 17.5(c) in Article II Chapter 2 in
the Code of the City of Alameda is hereby amended to read as follows:
Composition of the Commission; Special Terms, Qualifications, and
Conditions
a. Members of the Commission shall be persons who are qualified by
experience and training to pass on matters pertaining to building construction
and who are not employees of the City of Alameda. The City Council shall
endeavor to appoint persons who are knowledgeable in the construction or
design of buildings and who are familiar with the content and application of
the Uniform Codes.
b. The Chief Building Inspector, or his /her designee, shall be an ex officio
member of the Commission, but shall have no vote on any matter before the
Commission.
c. The Commission shall have no authority relative to interpretation of the
administrative provision of the Building Code nor shall the Commission be
empowered to waive requirements of the Building Code.
Section 4. This Ordinance shall be in full force and effect from and
after the expiration of thirty (30) days from the date of its final passage.
