CITYOFALAMEDAORDINANCENo.3094 NewSeries ADDINGSECTION30-5.17REASONABLEACCOMMODATIONTO THEALAMEDAMUNICIPALCODETOPROVIDEREGULATIONS REGARDINGREASONABLEACCOMMODATION WHEREAS,thefederalFairHousingActandtheCaliforniaFairEmployment andHousingActhaveenactedlawstoaddressbarrierstohousingopportunitiesfor individualswithdisabilities;and WHEREAS,CaliforniaHousingElementlawrequiredlocaljurisdictionsto specificallyaddresstheissueofreasonableaccommodationinthe2007-2014 HousingElement;and WHEREAS,theCityofAlamedaadoptedthemostcurrentversionofthe HousingElementonJuly3,2012;and WHEREAS,theHousingElementincludesImplementationMeasure1.j., ReasonableAccommodation,toprovideaprocesstoaccommodatehousingneeds ofpersonswithdisabilitiesandstreamlinethepermitreviewprocess;and WHEREAS,theAlamedaMunicipalCode(AMC)Section30-5addresses GeneralProvisionsandExceptions;and WHEREAS,theproposedSection30-5.17isanappropriatelocationfor addressingReasonableAccommodation;and WHEREAS,theprojectisCategoricallyExemptfromenvironmentalreview pursuanttoCaliforniaEnvironmentalQualityAct(CEQA)Guidelines,Section15305, MinorAlterationsinLandUseLimitations,astheadditionofSection30-5.17would resultinminoralterationsofalanduselimitation. BEITORDAINEDbytheCityCounciloftheCityofAlameda: Section1.SECTION30-5.17oftheAlamedaMunicipalCodeisherebyamended toaddlanguageasfollows: 30-5.17ReasonableAccommodation 30-5.17.1-Purpose 30.5-17.2-Applicability 30-5.17.3-ApplicationRequirements 30-5.17.4-ReviewAuthority 30-5.17.5-ReviewProcedure 30-5.17.6-FindinqsandDecision 30-5.17.7-AppealofDetermination 30-5.17.1-Purpose Thepurposeofthissectionistoprovideaproceduretorequestreasonable accommodationforpersonswithdisabilitiesseekingequalaccesstohousingunder theFederalFairHousingActandtheCaliforniaFairEmploymentandHousingAct (together,theActs)intheapplicationofzoninglawsandotherlanduseregulations, policies,andprocedures. 30-5.17.2-Applicability a.Arequestforreasonableaccommodationmaybemadebyanypersonwith adisability,theirrepresentativeoranyentity,whentheapplicationofa zoninglaworotherlanduseregulation,policyorpracticeactsasabarrierto fairhousingopportunities.Apersonwithadisabilityisapersonwhohasa physicalormentalimpairmentthatlimitsorsubstantiallylimitsoneormore majorlifeactivities,anyonewhoisregardedashavingsuchimpairmentor anyonewhohasarecordofsuchimpairment.Thissectionisintendedto applytothosepersonswhoaredefinedasdisabledundertheActs. b.Arequestforreasonableaccommodationmayincludeamodificationor exceptiontotherules,standardsandpracticesforthesiting,development anduseofhousingorhousing-relatedfacilitiesthatwouldeliminate regulatorybarriersandprovideapersonwithadisabilityequalopportunityto housingoftheirchoice. c.Areasonableaccommodationisgrantedtothehouseholdthatneedsthe accommodationanddoesnotapplytosuccessorsininteresttothesite. d.Areasonableaccommodationmaybegrantedincompliancewiththis sectionwithouttheneedfortheapprovalofavariance. e.Requestsforreasonableaccommodationshallbemadeinthemanner prescribedinSection30-5.17.3ApplicationRequirements. 30-5.17.3-ApplicationRequirements a.Application.Arequestforreasonableaccommodationshallbe submittedonanapplicationformprovidedtheCommunity DevelopmentDepartment,orintheformofaletter,totheCommunity DevelopmentDirectorandshallcontainthefollowinginformation: 1.Theapplicant'sname,address,andtelephonenumber; 2.Addressofthepropertyforwhichtherequestisbeingmade; 3.Thecurrentactualuseoftheproperty; 4.Thebasisfortheclaimthattheindividualisconsidereddisabled undertheActs. 5.TheZoningOrdinanceprovision,regulation,orpolicyforwhich reasonableaccommodationisbeingrequested;and 6Whythereasonableaccommodationisnecessaryto accommodatethefunctionaldailyneedofthedisabled individual. b.ReviewwithOtherLandUseApplications.Iftheprojectforwhichthe requestforreasonableaccommodationisbeingmadealsorequires someotherdiscretionaryapproval(includingbutnotlimitedto:Use Permit,DesignReview,GeneralPlanamendment,zonechange,etc.), thentheapplicantshallfiletheinformationrequiredbySubsectiona. (Application)abovetogetherwiththeapplicationfordiscretionary approval. 30-5.17.4-ReviewAuthority a.CommunityDevelopmentDirector.Arequestforreasonable accommodationshallbereviewedbytheCommunity DevelopmentDirector(Director),orhis/herdesigneeifno approvalissoughtotherthantherequestforreasonable accommodation. b.OtherReviewAuthority.Requestsforreasonable accommodationsubmittedforconcurrentreviewwithanother discretionarylanduseapplicationshallbereviewedbythe authorityreviewingthediscretionarylanduseapplication. 30-5.17.5-ReviewProcedure a.DirectorReview.TheDirector,orDirectordesignee,shallmake awrittendeterminationwithin45daysandeithergrant,grant withmodifications,ordenyarequestforreasonable accommodationinaccordancewithSection30-5.17.6Findings andDecision. b.OtherReviewingAuthority.Thewrittendeterminationon whethertograntordenytherequestforreasonable accommodationshallbemadebytheauthorityresponsiblefor reviewingthediscretionarylanduseapplicationincompliance withtheapplicablereviewprocedureforthediscretionaryreview. Thewrittendeterminationtograntordenytherequestfor reasonableaccommodationshallbemadeinaccordancewith Section30-5.17.6FindingsandDecision. 30-5.17.6-FindingsandDecision a.Findings.Thewrittendecisiontograntordenyarequestfor reasonableaccommodationwillbeconsistentwiththeActsand shallbebasedonconsiderationofthefollowingfactors: 1.Whetherthehousing,whichisthesubjectoftherequest, willbeusedbyanindividualwithadisabilityasdefined undertheActs. 2.Whethertherequestforreasonableaccommodationis necessarytomakespecifichousingavailabletoan individualwithadisabilityundertheActs. 3.Whethertherequestedreasonableaccommodationwould imposeanunduefinancialoradministrativeburdenonthe City. 4.Whethertherequestedreasonableaccommodationwould requireafundamentalalterationinthenatureofaCity programorlaw,includingbutnotlimitedtodesignreview, historicpreservation,landuseandzoning. 5.Potentialimpactonsurroundinguses. 6.Physicalattributesofthepropertyandstructures;and 7.Alternativereasonableaccommodationswhichmay provideanequivalentlevelofbenefit. b.ConditionofApproval.Ingrantingarequestforreasonable accommodation,thereviewingauthoritymayimposeany conditions of approvaldeemedreasonableandnecessaryto ensurethatthereasonableaccommodationwouldcomplywith thefindingsrequiredbySubsectionaabove.Theconditions shallalsostatewhethertheaccommodationgrantedshallbe removedintheeventthatthepersonforwhomthe accommodationwasrequestednolongerresidesonthesite. 30-5.17.7-AppealofDetermination Adeterminationbythereviewingauthoritytograntordenyarequestforreasonable accommodationmaybeappealedtothePlanningBoardincompliancewithSection 30-25,AppealsorCallsforReview. Section2.ThisOrdinanceshallbeinfullforceandeffectfromandafterthe expirationofthirty(30)daysfromthedateofitsfinalpassage. Section3.SeverabilityClause:ItisthedeclaredintentoftheCityCouncilthatifany section,subsection,sentence,clause,phrase,orprovisionofthisOrdinanceisheld invalidorunconstitutionalbyacourtofcompetentjurisdiction,suchinvalidityor unconstitutionalityshallnotbesoconstruedastorenderinvalidorunconstitutional theremainingprovisionsofthisOrdinance.
