1992-07-31 Special CC MeetingSPECIAL MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA JULY 31, 1992 The meeting convened at 5:40 p.m. with Vice Mayor Lucas presiding. ROLL CALL - Present: Councilmembers Arnerich, Camicia, Roth, and Acting President Lucas - 4. (Councilmember Camicia arrived at 5:47 p.m.] Absent: President Withrow - 1. 92-556 Report from Personnel Director Pertaining to the Impasse Procedures to be Used for Settlement of the Dispute with the Firefighters Regarding the City's Proposed Ballot Measure on Binding Arbitration for Firefighters and Voter Approval of Such Binding Arbitration Awards. Acting President Lucas stated the purpose of the meeting is to decide on an Impasse procedure to resolve this matter; the Impasse procedures are Mediation (or Conciliation), Determination by Council following a hearing on the merits of the dispute, or as ordered by the Council; staff recommends Council make final determination after a special hearing; to meet Election Code deadlines for placing this issue on the November ballot, staff recommends against mediation or other dispute-resolving procedure; time is of the essence; if Council agrees with Staff's position, Council should set Monday, August 3, 1992 at 5:30 p.m. as a special hearing. The Personnel Director summarized her report, stating that the Firefighters' representatives and City's representatives met a number of times discussing the language for the Ballot Measure, positions are significantly different and at the last negotiating meeting held Monday, July 27, 1992, the City declared an Impasse; staff recommends scheduling a hearing Monday at 5:30 p.m. to enable Council, at its Regular Meeting on August 4th, to consider a resolution to place the Measure on the ballot. Chris Reilly, Alameda Firefighters Association, stated although Council and City's negotiating team have known about Firefighters' initiative since April, Firefighters did not hear about counter-measure until late July, and some major issues are still outstanding; the Firefighters' negotiating team has requested, but has not received from the City's negotiating team, definitions of some key items; Firefighters want fair and impartial procedure to resolve differences; a mediation procedure is provided in the staff report and a nuetral third party could provide new ideas and facilitate getting answers to questions Firefighters raised; Firefighters' position is to have a neutral process, mediation, at this point to resolve some questions. Councilmember Camicia moved the hearing be held Monday (5:30 p.m., August 3, 1992). Councilmember Roth seconded the motion which carried by unanimous voice vote - 4. July 31, 1992 41.
