APPROVING A LEASE AND AUTHORIZING THE CITY MANAGER TO
EXECUTE DOCUMENTS NECESSARY TO IMPLEMENT THE TERMS OF THE
LEASE WITH THE ALAMEDA SOCCER CLUB FOR THE USE AND
MANAGEMENT OF THE ALAMEDA POINT SOCCER FIELDS , LOCATED ON
THE GREEN BETWEEN BUILDINGS 2 , 3 , AND 4 , FOR A TOTAL OF 3 YEARS
.'t WHEREAS,TheAlamedaSoccerClub(ASC)leaseagreementhassimilarterms
~totheexistinglease,includingthebaserentpaymentbeingoffsetbyASC'sfull
""')maintenanceresponsibilityofallfoursoccerfields;and
WHEREAS,TheASCwillbesharingthefieldswiththePiedmontSoccerClub,
EastBayUnitedSoccerClub(includingtheparentleague,JackLondonYouthSoccer
SportsLeague)andtheAlamedaUnifiedFootballClub;and
WHEREAS,TheASCalsocurrentlyleasesandmaintainstheHornetSoccer
FieldsatAlamedaPoint,locatedat250W.HornetAvenue;and
WHEREAS,Thethree-yearleaseagreementwiththeASCfortheuseoffour
soccerfieldsatAlamedaPointrequirestheASCtomaintainthefieldsattheirsale
expensewhichincludes,butisnotlimitedto,mowingandfertilizationofthenaturalturf
fields,refusecollectionanddisposal,fieldcleanupandmaintenanceoftheexisting
quickcouplerirrigationsystem.TheASCwillberesponsibletopayforthewaterused
tomaintainthesoccerfields;and
WHEREAS,Theallowedfieldusesincludesoccerpractice,competitions,camps
andfundraisingactivitiesfrom8:00a.m.until10:00p.m.,sevendaysaweek,withthe
useofportablelights;and
WHEREAS,TheCityofAlamedaRecreationandParkDepartmentwillretainthe
righttoreasonablyusethefieldsforpublicrecreationalprograms;and
NOWTHEREFORE,BEITORDAINEDbytheCityCounciloftheCityof
Alamedathatbyfouraffirmativevotesthat:
Section1.TheCityManageroftheCityofAlamedaorhisdesigneeishereby
authorizedtonegotiate,execute,forandonbehalfoftheCityofAlameda,aleasewith
theAlamedaSoccerClubforatermofthreeyears,fortheuseandmanagementofthe
AlamedaPointsoccerfields,locatedonthegreenbetweenbuildings2,3,and4,fora
totalof3years,subjecttosuchtechnicalorclarifyingrevisionsasarereasonably
determinednecessarybytheCityManagerandapprovedbytheCityAttorney,andthe
CityClerkisherebyauthorizedanddirectedtoattesttothesame.
Section2.Ifanysection,subsection,sentence,clauseorphraseofthis
ordinanceif,foranyreason,heldtobeinvalidorunconstitutional,suchdecisionshall
notaffectthevalidityorconstitutionalityoftheremainingportionsofthisordinance.the
CityCounciloftheCityofAlamedaherebydeclaresthatitwouldhavepassedthis
ordinance,andeachsection,subsections,clause,orphrasehereof,irrespectiveofthe
factthatanyoneormoresections,subsections,sentences,clausesandphrasesare
declaredtobeinvalidandunconstitutional.
Section3.Thisordinanceshallbeinfullforceandeffectfromandafterthe
expirationofthirty(30)daysfromthedateofitsfinalpassage.
