APPROVING AND AUTHORIZING CONVEYANCE BY
GRANT DEED OF MEYERS HOUSE MUSEUM AND
GARDEN LOCATED AT 2021 ALAMEDA AVENUE TO THE
ALAMEDA MUSEUM, A NON-PROFIT CORPORATION
(REQUIRES FOUR AFFIRMATIVE VOTES)
WHEREAS, the Meyers House Museum and Garden (“Meyers House”),
located at 2021 Alameda Avenue was bequeathed to the City of Alameda in
1996 by Jeanette B. Meyers; and
WHEREAS, it was the original wish of the Meyers family to grant the
Meyers House to the Alameda Museum, but at that time, the Museum did not
have the financial or volunteer capacity to manage the property and declined the
offer, so the property transferred to the City instead. The Alameda Museum now
has the ability to manage and maintain the house and requested to do so; and
WHEREAS, the Alameda Museum currently operates the Meyers House
museum by hosting monthly tours, maintaining the historical artifacts and house
interior; and
WHEREAS, the Alameda Museum presented a financial plan to manage
the Meyers House and provide much needed capital improvements that have
continued as deferred maintenance by the City due to lack of funding; and
WHEREAS, this grant deed transfer includes three lots that are all part of
the Meyers House property. These lots include the house, garden and parking
lot. This would transfer all three Meyers House lots to the Alameda Museum at
no cost; and
WHEREAS, this grant deed transferring the property to the Museum
reserves a power of termination in favor of the City to take the property back if
the property ceases to be used as a local house museum: and
WHEREAS, the Meyers House is zoned R-4 Neighborhood residential and
is not zoned O- Open Space/Park and therefore the requirement to put the sale
of any park to a vote of the public is not applicable to the Meyers House
conveyance; and
WHEREAS, the City believes that the Alameda Museum will be good
stewards of the Meyers House and it is an appropriate and common practice for
a house museum to be owned and operated by a non-profit entity; and
WHEREAS, pursuant to City Charter Article III Sec. 10, no real property of
the City shall be transferred except upon the affirmative vote of four members of
the City Council.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Alameda that by four affirmative votes:
Section 1. The City of Alameda conveys by grant deed to Museum the property
located at 2021 Alameda Avenue, and more particularly described in Exhibit A
attached.
Section 2. The City Manager of the City of Alameda is hereby authorized to
execute, for and on behalf of the City of Alameda, a grant deed and all other
such documents as shall be required to transfer to the Museum any interest the
City of Alameda may have in the property described in Exhibit A. The City Clerk
is hereby directed to attest to same.
Section 3. This ordinance shall be in full force and effect from and after the
expiration of thirty (30) days from the date of its final passage.

regular meeting assembled on the 5th day of March, 2013, by the following
vote to wit:
AYES: Councilmembers Chen, Daysog, Ezzy Ashcraft, Tam
and Mayor Gilmore – 5.
NOES: None.
