Resolution 14923CITYOFALAMEDARESOLUTIONNO.14923 PRELIMINARILYAPPROVINGANNUALREPORTDECLARING INTENTIONTOORDERLEVYANDCOLLECTIONOF ASSESSMENTSANDPROVIDINGFORNOTICEOFPUBLIC HEARINGONJULY15,2014,ISLANDCITYLANDSCAPINGAND LIGHTINGDISTRICT84-2,ZONE8. WHEREAS,theCityofAlameda(the"City")hasdulycreatedtheIslandCity LandscapingandLightingDistrict84-2(the"District"),includingZones2and3underthe LandscapingandLightingActof1972(Sections22500andfollowingoftheStreetsand HighwaysCodeofCalifornia)(the"Act")toinstallandmaintaincertainlandscapingand lightingimprovements(the"Improvements");and WHEREAS,theCityproposestoconsolidateZones2and3inanewZone8;and WHEREAS,theCityhasdirectedtheCityEngineer,asengineerofworkforthe District,tofileanannualreportinaccordancewiththeLandscapingandLightingActof 1972,andthatreportisonfilewiththeCityandshowstheproposedimprovementsandthe estimatedcostsandassessments,allfortheFY14-15. NOW,THEREFORE,BEITRESOLVED,DETERMINEDANDORDEREDbythe CityCounciloftheCityofAlameda,pursuanttoChapter2,Section22587oftheActthat: 1.TheCityCouncilherebyfindsthatthereportoftheengineerofwork onfilewiththeCitycontainsallmattersrequiredbySection22565through22574ofthe Actandisherebyapprovedandconfirmed.Referenceismadetothereport,whichison filewiththeCityClerkoftheCityofAlameda,forafullanddetaileddescriptionofthe improvements,theboundariesoftheZone,theassessmentrangeformulathatisproposed tobeleviedontheassessablelotsandparcelsofpropertywithintheZone. 2.TheCityCouncilherebydeclaresitsintentiontoconsolidateZones2 and3intoasingleZonetobeknownasZone8(WebsterStreet)andtoincreasethe assessmentamountintheZoneandtoallowforfutureannualincreasesbasedonan indexedinflationadjustmentformula.TheCityCouncilhasdeterminedatthistimetocall anassessmentballotproceedingthereintoauthorizetheassessmentincrease(whichis moreparticularlyoutlinedintheEngineer'sReport)topaythecostsandexpensesofthe improvementsdescribedinthisResolution.TheCityCouncilfindsthatthepublic'sbest interestrequiressuchlevyandcollection. 3.PursuanttoProposition218,Section4,Sub-Section4(c),now CaliforniaConstitutionalArticlesXIIICandXIIID,(hereafterreferredtoasthe"Proposition 218")approvedbytheCaliforniavotersinNovember1996,anassessmentballot proceedingisherebycalledonbehalfoftheZoneonthepropositionofincreasingthe assessmentandprovidingforfutureincreasesthroughanindexedinflationadjustment formulainthemethodofspreadtoallowforreasonableincreaseswithintheDistrict. 4.TheboundariesoftheproposedZone8oftheIslandCityLandscaping andLightingMaintenanceDistrict84-02locatedintheCityofAlamedaisgenerallylocated alongWebsterStreetsouthofAtlanticAvenueandnorthofCentralAvenue. 5.TheproposedZone8iswithintheboundariesoftheCityofAlameda, withintheCountyofAlameda,StateofCalifornia,asshownupontheboundarydiagram includedintheEngineer'sReport,whichisonfileintheofficeoftheCityClerk.The distinctivedesignationoftheDistrictwillbe"IslandCityLandscapingandLightingDistrict 84-2,Zone8oftheCityofAlameda". 6.TheimprovementsprovidedwithintheproposedZone8arefurther definedintheEngineer'sReportandinclude,butarenotlimitedto,theoperating, maintaining,andservicingofallpubliclandscapingimprovements,consistingoftrees, medians,refusecontainers,sidewalks,plantmaterials,pathways,irrigationsystems, lightingsystems,andassociatedappurtenantfacilities.Servicesinclude,butarenot limitedto,personnel,materials,contractingservices,electricalenergy,waterrequiredfor allnecessarymaintenance,replacement,repairandadministration,requiredtokeepthe abovementionedimprovementsinahealthy,vigorousandsatisfactorycondition.The MaintenanceandCleaningProgramincludesregularsidewalksweeping,alleycleaning, refuseremoval,regularlyscheduledsteamcleanings,pressurewashing,graffitiremoval, treepruningandwatering,treewellweedingwithcrushedgranitereplenishment,aswellas otherrelatedactivities. 7.ForFY14-15,theproposedassessmentsareoutlinedintheEngineer's Reportwhichdetailstheannualassessmentsandformula. 8.NoticeisherebygiventhataPublicHearingonthesematterswillbe heldbytheCityCouncilontheJuly15,2014at7:00P.MatthemeetingplaceoftheCity Council,intheAlamedaCityHall,2263SantaClaraAvenue,Alameda,California,94501. 9.TheCityClerk,orherdesignee,isherebyauthorizedanddirectedto givenoticeofthePublicHearingtoaffectedpropertyownersbymailingtheNoticeof PublicHearingandAssessmentBallotProcedureandfilingoftheEngineer'sReport, togetherwiththeassessmentballotsandballotmaterialstotherecordownersofallreal propertyproposedtobeassessedwithintheproposedZone8inaccordancewithSection 53753oftheCaliforniaGovernmentCodeandSection4ofArticleXIIIDoftheCalifornia Constitution.BallotsmustbereceivedpriortotheconclusionofthePublicHearing,at whichtimetheywillbetabulated.AtthePublicHearing,allinterestedpersonsshallbe affordedtheopportunitytohearandbeheard. 10.InterestedpersonsshouldcontactLiamGarland,Administrative ServicesManager,CityofAlamedaPublicWorksDepartment,950W.MallSquare,Room 110,Alameda,California94501,telephonenumber(510)747-7930,regardingthishearing, theassessments,andthereport. ***** I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregularmeeting assembledonthe20th dayofMay,2014,bythefollowingvotetowit: AYES:CouncilmembersEzzyAshcraft,Tamand MayorGilmore-3.
