1966-02-01 Regular CC Minutes/ REGULAR MEETING OF THE COUNCIL 05 THE CITY OF ALAMEDA | HELD TUESDAY EVENING FEBRUARY 1, 1966 / / The meeting convened at 7:30 o'clock p.m. with Vice President Rose presiding. The Pledge of Allegiance WAS led by 'qGuyor" Gary Smith, the Boy Scout Official, and was followed by an inspiring Invocation delivered by The Reverend Mr. Martell Twitchell, Pastor of Santa Clara Avenue Methodist | Church. ' / ( At this point, Vice President Rose stated the Council had the pleasure of baving a number of | Boy Scouts present who had been elected to the several City Offices. He then called upon Nr, Richard Watson, Assistant City Manager, who had been in charge of this “Scout Day in Government" program. 8r. Watson briefly explained the boys' participation during the day in visiting the offices and • departments of the City. He said the Scout "Councilmen" had met earlier this evening and had elected | Gazy Smith and Terry Justice as Mayor and Vice Mayor, respectively. | Upon reques t, the Clerk then read the Proclamation of The Honorable William S. Godfrey, Mayor of the City of Alameda, setting forth the week of February 7 to 13. 1966, as "Boy Scout Week'? and Tuesday, | ! February 8, 1956, as 'Boy Scout Anniversary Day". Vice President Rose then presented to the "Scout' City Officials their Honorary Award Certificates. There was a large audience of Scouts and their parents and leaders in the Scout organization, all of whom were welcomed. Mr. James Walton, President of the Boy Scout Council, was unable to be present at this meeting. Mr. John McKie, Scout Executive, was introduced and, in turn, introduced Mr. George Skolla, Vice President of the Scout Council. Mr. Skells extended 8r. Walton/a regrets and then expressed his own satisfaction in being able to work in the Scouting movement and urged all other men who could to sign up to help as there was always need for leaders. ' .• Vice President Rose expressed Mayor Godfrey's regrets that he could not be present and extended his . greetings. He also invited the Boy Scouts to attend the City Council meetings at any time. | ROLL CALL: The roll was called and Councilmen Bartley, La Croix, Jr., McCall and Vice President Rose, (4), were noted present. Absent: President Godfrey, (1). MINUTES: 2. The minutes of the regular meeting held January 18, and the adjourned regular meeting held Janu- ary 19, 1966, were approved as transcribed. WRITTEN COMMUNICATIONS� 3.1"7 From Carber, Inc., signed by Mr. Colton C. Carmine, requesting the refund of $91. paid for Building Permit No. 1734 for construction on property at 17I5 Eagle Avenue. The owner had now decided not to build on this lot. Councilman McColl moved the request be granted and the sum of $91. be refunded to Carber, Inc. The motion was seconded by Councilman La Croix and carried on the following roll call vote. Ayes: Four. Noes: None. Absent: President Godfrey, (l). v' From Mr, I. G. Frost, 2217-R Encinal Avenue, in protest against a certain "Flyer" being left on his porch, representing the views of the Berkeley Viet-Nam Day Committee. There being no objections, Vice President Rose asked the Clerk to acknowledge the communication and quote for Mr. Frost the sections of the Alameda Municipal Code pertaining to this matter so that he would understand the City's position. It was so ordered. v~ 5^ From Alameda Unified School District, signed by Mr. Charles A. Briscoe, Assistant Secretary, requesting cancellation of taxes on certain property acquired for school purposes. The matter was referred to "Resolutions". w� 6, From Mr. W. J. Emmons, 3233 Fernside Boulevard, calling attention to damage done to Maitland Drive by contractors working on the project of water lines for East Bay Municipal Utility District and urging that necessary repairs be made when the job has been completed. The Clerk was to assure 8r. Emmons that the required repairs would be made at the proper time. 7.v' From California Spring Garden Show, signed by Mr. John H. Staley, Jr., President, requesting time on a Council meeting agenda for presentation of slides and information by Mr. Michael 7illea concerning the 1966 Show, "Symphony of Flowers". It was felt the desired publicity about the '/Sbow', might better be accomplished by a presentation at the Alameda High School Little Theater. Another suggestion was that one of the "Service" Clubs - Kinunio, Rotary, Lions or one of the women's groups - might plan such a program and invite all to attend. It was thought that the people of the community were the ones who needed the information about this show. The Clerk was to so infnr , Staley. 8/0 From Alameda West Lagoon Home Owners' Association, signed by Mr. Charles W. Lindemann, Jr., President, in protest against the situation on the Grand Street Bridge involving fishing therefrom, the hazard to children who might fall into the lagoon and the throwing of garbage and debris into the water. Said letter was accompanied by copies of letters from several property owners pointing up the problem. The request was made that this matter be reviewed in order to arrive at an agreeable solution. The matter was referred to the City Manager for investigation and recommendation. 9:' From Davis & Craig, Attorneys for the Bay Farm island Reclamation District No. 2105, signed by Mr. James 8. Davis, requesting approval of a warrant in the amount of $177,000. to replenish' its revolving fund account. The matter was referred to "Resolutions". ORAL COMMUNICATIONS: lO. Mr. Frank Gottytein, 731 Haight Avenue, pointed out to the Boy Scouts that, in the future, they would have the privilege and opportunity to address the City Council on any subjects they felt should be brought to its attention. ll. Mrs. R. R. Lang, 624 Rock Isle, referred to the complaint submitted by the Alameda West Lagoon Home Owners' Association, and emphasized the dangerous situation caused by boys jumping off the bridge and narrowly missing children in small boats coming under said bridge. She expressed her concern that a serious accident could happen in this way. Vice President Rose assured Mrs. Lang that the circumstances would be given thorough consideration by the City 8onuger, REPORTS O- OFFICERS, 8OARDS, ETCETERA: 12: From the City Manager, recommending contract be awarded to B. Stuart Macintyre & Soo, low bid- der, for the project of Alternate "B" in io tbe Repair of Walls at the Alameda Swim Center, at the total cost of $3,251. Councilman La Croix moved the recommendation. be approved; that contract be awarded to the designated firm for the specified project at the price quoted. The motion was seconded by Councilman Bartley and carried on the following roll call vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 13. From the Recreation and Parks Commission, signed by Mr. Raymond P. Kranelly, Chairman, au6mit- tin the Operating Policy of the Commission, as adopted by said Body on Jaouary 13, 1966. Councilman La Croix explained that this "Policy" was the outgrowth of a meeting between the City Council and said Commission and he commended it for its excellent report. Councilman Bartley expressed his opinion that said Operating Policy merely set forth the functional duties of the Commission and he had not been able to find where the Commission had indicated its plans for future programs, which he had thought were to be presented. INTRODUCTION OF ORDIN "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by mending Section 3-5818 UNFINISHED BUSINESS: Vice President Rose commented that the only point in the Policy statement which was not entirely clear to him was that concerning the sett.ing of fees for different facilities. He said that, otherwise, he felt the report was fine. The document was accepted for filin . ICES: 14. Councilman Bartley introduced the following ordinance, after which it was laid over under provi- sion of law and the Charter: Thereof, Relating to Seizure and Sale for Taxes." 15. The matter was presented with regard to the Report from the Assistant City Manager concerning the proposal of Messrs. D. L. Hubbard and J. R. Halton to establish and operate boat rentals on the South Shore Beach under a form of Concession Agreement with the City. Said Report was dated January 26, 1960, | Councilman La Croix cited the difficulties listed in the Report relating to the operation of the pro- posed enterprise and moved the request for a permit to operate such a concession on the South Shore Beach be denied. The motion was seconded by Councilman Bartley and on roll call carried by the follow- ; RESOLUTIONS: 16. The following resolution was introduced by Councilman McCall, who moved its adoption: "Resolution No. 6900 Cancelling City Taxes on Property Acquired by the Alameda Unified School District for Public Purpoees.' (Expansion of Haight School) The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 17. The following resolution was introduced by Councilman Bartley, who moved its adoption: "Resolution No. 6901 Authorizing Execution of Agreement with State of California Providing for Joint Participation in-Installation of Pedestrian Control Heads at the Intersections of Lincoln Avenue with State Highway Route 260 (Webster Street) and Park Street with State Highway Route 61 (Encinal Avenue)." The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 18. The following resolution was introduced by Councilman Bartley, who moved its adoption.: "Resolution No. 6902 Adopting Specifications, Special Provisions and Plans for Replacement of Existing Culvert at Fernside Boulevard and Liberty Avenue, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 19. The following resolution was introduced by Councilman Bartley, who moved its adoption: "Resolution No. 6903 Adopting Specifications, Special Provisions and Plans for Culvert Reconstruction on Encinal Avenue from Pearl Street to Fountain Street, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 20. The following resolution was introduced by Vice President Rose, who moved its adoption: 'Resolution No. 6904 Adopting Specifications, Special Provisions and Plans for Culvert Reconstruction at Fifth Street and Taylor Avenue and at Everett Street and Webb Avenue, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Bartley and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 21. The following resolution was introduced by Councilman La Croix, who moved its adoption: "Resolution No. 6905 Adopting Specifications, Special Provisions and Plans for Installation of Exposed Aggregate Concrete at the Encinal Swim Center, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Bartley and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). 22. The following resolution was introduced by Councilman McCall, who moved its adoption: "Resolution. No. 6906 Approving Warrant No. 105 of Board of Trustees of Reclamation District No. 2105. ($177,000.) The motion to adopt said resolution was seconded by Councilman Bartley and on roll call carried by the following vote. Ayes: Three. Noes: Councilman La Croix, (1). Absent: President Godfrey, (1). 23. The following resolution was introduced by Councilman Bartley, who moved its adoption: "Resolution No. 6907 Adopting Specifications for Furnishing to the City of Alameda Three (3) New, 1966 Model Trucks, for the Street Department, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman McCall and on roll call carried by the following vote. Ayes: Four. Noes: - None. Absent: President Godfrey, (1). The Vice President then declared all of the foregoing resolutions adopted. ORDINANCES FOR PASSAGE: 24. 'Ordinance No. 1520, New Series An Ordinance Authorizing Grant of Pipe Line Easement to East Bay Municipal Utility Diatrict," (Kzusi Park) Councilman Bartley moved the ordinance be passed as submitted. The motion was La Croix and on roll call carried by the following vote. President Godfrey, (1). 25. Ayes: "Ordinance No. 1521, New Series seconded by Councilman Four. Noes: None. Absent: An Ordinance Amending Certain Portions of the Alameda Municipal Code Relating to Traffic Regulations." Councilman La Croix moved the ordinance be passed as submitted. The motion was seconded by Councilman Bartley and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: President Godfrey, (1). FILING: 26. Agreement - Between City of Alameda and State installation of Pedestrian Control Heads 31. Specifications and Provisions No. MS 2-66-1 - the Street Department. BILLS: No. PW Street No. PW 2-66-4 - and Webb 2-66-5 - Culvert Reconstruction on Encinal Culvert Reconstruction at Fifth Avenue. Installation of Exposed Aggregate of California - Providing Joint Participation in at Specified Highway Intersections. Furnishing Three (3) New, 1966 Model TrUcks for 32. An itemized List of Claims against the City of Alameda and the Departments thereof, in the total amount of $51,497.02, was presented to the Council at this meeting, The List was accompanied by certification from the City Manager that the Claims shown were correct. Councilman McCall moved the bills as itemized in the List of Claims filed with the City Clerk on February 1, 1966, and presented to the Council at this meeting, be allowed and paid. Absent: President Godfrey, (1). 33,` At this point, Vice President Rose referred to the sad news received just prior to the Council meeting this evening of the passing of an eminent, former pioneer-resident of Alameda, Mr. Joseph R. Knoolmod, Sr. He asked that all rise and stand for a moment of silence in observance of the death of this distinguished man, who had served not only the 'City and the State but also the Nation in public office. 34. There being no further business to come before the meeting, the Council adjourned in respect. to the memory of Mr. Joseph R.
