HELD TUESDAY EVENING APRIL 19, 1966
The meeting convened at 7:30 o'clock p.m. with President Godfrey presiding. The Pledge of Alle-
giance was led by Councilman McCall and was followed by an inspiring Invocation delivered by The
Reverend Mr. Robert L. Harrell, Interim Pastor of First Christian Church.
ROLL CALL:
The roll was called and Councilmen Bartley, La Croix, Jr., McCall, Rose and President Godfrey,
(5), were noted present. Absent: None.
MINUTES:
1. The minutes of the regular meeting held April 5, 1906, were approved as transcribed.
WRITTEN COMMUNICATIONS:
2. From Davis & Craig, Attorneys for Bay Farm Island Reclamation District No. 2105, signed by Mr.
James B. Davis, requesting approval of Warrant No. 107 in the amount of $135,000 to replenish the
Revolving Fund of the "Diatrlct".
The matter was referred to "Resolutions".
3. From Miss Margaret K. Schlichting, 1627 Sherman Street, in protest against the reduced time,
establio6dd in the new ordinance, in which to retrieve animals from the City Pound.
Miss Schlichting was present and personally expressed her concern for the dogs. It was developed
that if the dogs were licensed they were not destroyed. The owners were then contacted. The animals
in question were the strays and every attempt was made to sell even them.
4. The President read a letter from Alameda Post No. 9, American Legion, signed by Messrs. H. J.
Kihn and George A. Rose, Co-Chairmen, expressing thanks to the City for its cooperation in the
preparations for the Community Easter Sunrise Services.
The President extended the appreciation of the City to these two gentlemen and Alameda Post No. 9
for their efforts in presenting this annual, impressive ceremony.
ORAL COMMUNICATIONS:
5/ Mr. Vernon W. Dennen, 1926 Everett Street, vociferously expressed his objection to the recently
adopted ordinance which established a period of three days, excluding Saturday, Sunday and Holidays,
within which to retrieve animals. He offered several suggestions for the better operation of the
City Pound and for more service to the citizens who have animals.
b:J Mr. Lawrence A. Patton, 1020 San Antonio Avenue, referred again to his interest in the construc-
tion of an interchange at Atlantic Avenue and Webster Street. He recalled that he had requested the
City to write a letter to the State Division of Highways on this subject and inquired if the City
intended to do so.
It was pointed out the City Engineer had been making a study of the traffic situation in this entire
area and he had expected to have a report ready 'before this time. Mr. Hanna assured the Council
said report would be submitted before the next Council meeting.
The City Manager also explained that circumstances had recently been changed by the decision of the
Toll Bridge Authority to construct the southern crossing of San Francisco Bay. This would relieve
the traffic conditions in said area and thus eliminate the justification for such an interchange.
REPORTS OF OFFICERS, BOARDS, ETCETERA:
7. From City Attorney, concerning the observance of Law Day USA on May 1, 1966,
The matter was referred to "Resolutions".

8. From City Manager, reporting all work satisfactorily completed on the project of Installing
Exposed Aggregate Concrete at Encinal Swim Center - recommending it be accepted and the Notice of
Completion be ordered filed.
Councilman Rose moved the recommendation be approved; that the work on the specified project be
accepted and the Notice of Completion be filed. The motion was seconded by Councilman La Croix and
on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None.
9. i From City Planning Board, signed by the Secretary, recommending denial of the petition filed by
Mr. Harold M. Lane to rezone certain properties from "R-l", One-Family Residence District, to "R-4",
Neighborhood Apartment District. The properties were located in the block bounded by Pearl Street,
San Jose Avenue, Broadway and the north side of Encinal Avenue between Broadway and Pearl Street.
There being no objections, the Public Hearing on this matter was to be held before the Council at
its regular meeting of May 3, 1966.
lO," From City Manager, recommending an extension of time be granted to 5 o'clock p.m., May 13,
1906, for completion of the project to Replace a Culvert at Fernside Boulevard and Liberty Avenue,
with the understanding that the Contractor would be required to pay for the additional City services.
Councilman La Croix moved the recommendation be adopted; that the extension of time, as indicated,
be granted to the Contractor engaged on this project. The motion was seconded by Councilman Bartley
and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None.
ll. From City Manager, with reference to the recent request from Mr. Gage Risdon for the abandonment
of a portion of Sixth Street, south of Central Avenue. It was recommended that any such action be
deferred until the applicant had clarified the question of ownership and had established to the City's
satisfaction what the resultant situation would 6e°
Councilman La Croix moved the recommendation be followed and further action in this respect be
deferred as indicated. The motion was seconded by Councilman Bartley and carried on the following
roll call vote. Ayes: Five, Noes: 0one, Absent: None.
INTRODUCTION OF ORDINANCES:
12. Councilman Rose introduced the following ordinance, after which it was laid over under provision
of law and the Charter:
"Ordinance No.
New Series
An Ordinance Amending the Alameda Municipal Code by Amending Subdivision
(30) of Section 17-333 Thereof, Relating to All Time No Parking." (North
side of Buena Vista Avenue, between. Hibbard and Sherman Streets)
UNFINISHED BUSINESS:
l3. = The President broached the subject of the trespassing problem on and around Grand Street Bridge,
as presented to the Council by the Alameda West Lagoon Home Owners' Association in its letter of
January 24, 1906.
There was considerable discussion about the several aspects of this situation. Reports had been sub-
mitted by memoranda from the City Manager and the City Engineer.
Councilman Rose then moved that the Council authorize the construction as shown in Mr. Hanna's report
and sketch, dated April 1, 1966 - as referred to in the City Manager's memorandum of April 15` 1966 -
if and at such time as it may appear necessary, either in the judgment of the City or of the affected
property onners. The motion was seconded by Councilman Bartley.
Speaking on the question, Councilman McCall expressed his opinion that this problem was the Home
Owners' responsibility and, insofar as the children fishing from and jumping off said bridge was
concerned, it was a parental responsibility.
President Godfrey commented that there was the hazard particularly to the younger children - not only
at this bridge but also at the end of Union Street - which he felt merited some special consideration
and effort to obviute.
Some discussion ensued about the financial responsibility to pay the cost of such construction were
it to proceed at some time in the future. It was agreed this issue could be determined by the Coun-
cil at the time the work was to be dnne. Further study was to be given this matter.
The question was then put and the motion carried on the following roll call vote. Ayes: Four, Noes:
Councilman McCall, (1). Absent: None.
14.'/ Councilman Bartley referred to the reports concerning the review of the Subdivision Ordinance
and offered his services to discuss with the City Engineer and the Planning Director certain features
which he had suggested be incorporated to upgrade said Subdivision Ordinance.
15. ~Councilman McCall referred to a notice of a meeting of the Community Action Committee to help
secure a Head Start Educational Program, through application to the office of Economic Opportunity.
He inquired if it were not true that to qualify for such Federal Aid in these programs, the City had
to have a Workable Program.
Mr. Cunningham assured him this was true, plus the fact that many other requirements had to be met
and, to his knowledge, the City had not applied for any of the Federal Aid financed prngrume.
It was developed that this activity was through a Committee headed by The Reverend Mr, L. T. Nutting,
Pastor of the Court Street Methodist Church, and that there were certain Federal funds available to
private groups such as churches, etcetera, for this type of program.

18, Councilman McCall also inquired about the following matters and requested that he be furnished
with a written report from the City Manager thereon: (1) The status of the Nichandros development;
(2) The possibility that Encinal Terminals might move or sell out - and that Matson Container Corp.
would go to the Port of Oakland within the next two years; (3) The status of the five acres remain-
ing in the former Estuary Housing Project - had the owners applied for building permits and submitted
plans for bringing the structures into conformity with the building code requirements? (4) The
status of Harbor Land Development and, in the event of the sale of its land, what was the status of
the City-owned land; and what obligation did City of Alameda have with regard to the portion of land
which the Company had filled and which belonged to the City - and also, he understood that the lease
with the City was not tronoferruble. Further, had the City heard anything from the State Division of

Beaches and Parks with regard to the agreements between this Agency, the East Bay Regional Parks
District and the City of Alameda. Finally, the Traffic Advisory Committee's recommendation concern-
ing the alignment at the corner of High Street and Encinal Avenue. He felt this had created a hard-
ship on the owner, the lessees and the patrons of the large market located in proximity thereto, by
depriving them of twelve parking spaces.
It was pointed out the latter recommendation was in the traffic report submitted by Wilbur Smith &
Associates and had been approved some time ago. It was agreed this report should be reviewed from
time to time.
Mr. Weller then proceeded to verbally respond to the foregoing questions and said he would be glad
to oveotigute and report further to the Council whatever he could ascertain, if so desired.
17. Councilman Bartley referred to his recent request for a report on the traffic interchange prob-
lems at the intersection of Atlantic Avenue and Webster Street. Subsequently, he had asked for a
survey to be made of this entire area to determine the highest and best use of the properties. Be
said he realized this could not be established until the traffic situation had been resolved and he
planned to pursue the matter after such a report had been made.
18, Councilman McCall said he believed the Councilmen should consider and discuss many matters of
community-wide interest so that all would be aware of contemplated plans for any such developments.
lgx Councilman Bartley commented that he had recently talked with the lessees of Encinal Market,
located at High Street and Encinal Avenue. They had been disturbed by the loss of twelve parking
spaces but understood that the traffic problem at their intersection necessitated the realignment.
Be said the lessees would like to meet with the City Officials to discuss the possibility of convert-
ing a portion of the existing parkway into a parking area for the market and they indicated they
would be willing to pay all costs of said installation and the maintenance thereof. Councilman
Bartley suggested the City Manager and his Staff arrange such a meeting and then submit recommenda-
tions to the City Council.
President Godfrey stated the City Manager and the Department Heads were at the disposal of the people
of the City of Alameda at all times and anyone could call and ask for an appointment time and there
was no doubt in his mind that said meeting would be set up.
RESOLUTIONS:
20. The following resolution was introduced by Councilman Bartley, who moved its adoption:
"Resolution No. 6935
Authorizing Execution of Architectural and Planning Services Agreement
with Sarazen, Muirhead & Caldwell in Connection with Municipal Golf Courses."
The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by
the following vote. Ayes: Five. Noes: None. Absent: None.
21. The following resolution was introduced by Councilman Rose, who moved its adoption:
"Resolution No. 0936
Observing May 1, 1966, as 'Law Day USA'."
The motion to adopt said resolution was seconded by Councilman McCall and on roll call cartied by the
following vote. Ayes: Five. Noes: None, Absent: 0one,
22. The following reom}Ution was introduced by Councilman La Croix, who moved its adoption:
"Resolution No. 6937
Authorizing Acquisition by Purchase of Certain Real Property for Street
Purposes (Intersection of Market Street with Otis Drive -- .01816 Acre)."
The motion to adopt said resolution was seconded by Councilman Bartley and on roll call carried by
the following vote. Ayes: Five. Noes: None. Absent: None.
23. The following resolution was introduced by Councilman La Croix, who moved its adoption:
"Resolution No. 6938
Adopting Specifications, Special Provisions and Plans for the Resurfacing
and Minor Repairs of Various Streets in the City of Alameda, Calling for
Bids and Directing City Clerk to Advertise Same."
The motion to adopt said resolution was seconded by Councilman Bartley and on roll call carried by
the following vote. Ayes: Five. Noes: None. Absent: None.
24. The following resolution was introduced by Councilman Bartley, who moved its adoption:

25. The following resolution was introduced by Councilman La Croix, who moved its adoption:
"Resolution No. 6940
Resolution of the Council of the City of Alameda In Memoriam to Alec P.
McEwing, Retired Captain of the Alameda Fire Department
"WITH HEARTFELT GRIEF, the Council of the City of Alameda records the death of one of
its former, faithful employees, Captain Alec P. McEwing of the Alameda Fire Department.
"WHEREAS, Capt. McEwing had been appointed by the City of Alameda on October 1, 1929,
to serve as a Fireman and, by his earnest and constant efforts in the performance of his
duties, he had advanced through the ranks to Lieutenant on Fbbruury 16, 1040, and to Captain
on August 18, 1944, in which latter capacity he was serving at the time of his retirement on
October 1, 1954; and
"WHEREAS, Capt. McEwing had been most competent and reliable in the leadership of his fire
fighters in their work on behalf of the City and had been greatly respected by his fellow employ-
ees for his conscientious assumption of responsibilities.
"NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alameda does hereby
express its appreciation for the excellent service rendered by Capt. McEwing during the twenty-
five years of his employ with the City of Alameda and its sense of personal loss at the death
of this fine man,
"BE IT FURTHER RESOLVED, that this resolution be spread in full upon the minutes of this
meeting and a copy thereof be sent to the family of Cayt. McEwing in order to extend to its
members a sincere expression of sympathy in their bereavement.
"DE IT FURTHER RESOLVED, that when this meeting of the Council of the City of Alameda
adjourns, it shall do so in respect to the memory of ALEC P. MoDWING."
The motion to adopt said resolution was seconded by Councilman Bartley and on roll call carried by

The President declared all of the foregoing resolutions adopted.
ORDINANCES FOR PASSAGE:

An Ordinance Authorizing Conveyance, by Quitclaim Deed and Upon Condition, of
Certain Surplus City-Owned Real Property to Gene A. Stauber (,162 Acre, Beach
Road Near Fitchburg Avenue)."
Councilman La Croix moved the ordinance be passed as submitted. The motion was seconded by Council-
man McCall and carried on the following roll call vote. Ayes: Five, Noes: None. Absent: None.

30. Auditor's Financial Statement - City of Alameda, as of March 31, 1908 - Verified by Raoklemao,
Larzelere & McKenna.
BILLS:
31, An itemized List of Claims against the City of Alameda and the Departments thereof, in the total
amount of $27,495.50, was presented to the Council at this meeting.
The List was accompanied by certification from the City Manager that the Claims shown were correct.
Councilman McCall moved the bills as itemized in the List of Claims filed with the City Clerk on
April 19, 1966, and presented to the Council at this meeting, be allowed and paid. The motion was
seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Five. Noes:

33. At this time President Godfrey called up the audience for a moment of silence in observance of
the passing of Alec P. McEwing, Retired Captain of Alameda Fire Department.

34. There being no further business to come before the meeting, the Council adjourned in respect to
the memory of Alec P. McEwing - to assemble in adjourned regular session on Tuesday evening, April 26,
1966, at 8:80 o'clock.
