HELD TUESDAY EVENING MARCH 2, 1965
The meeting convened at 7:30 o'clock p.m. with President Godfrey presiding. The Pledge of Alle-
giance was led by Councilman Rose and was followed by an inspiring Invocation delivered by The
Reverend Mr. Harold Petroelje, Pastor of First Christian Reformed Churoh,
ROLL CALL:
The roll was called and Councilmen Freeman, La Croix, Jr., McCall, Rose and President Godfrey,
(5), were noted present. Absent: None.
MINUTES:
1. The minutes of the regular meeting held February 16, 1965, were approved as transcribed.
WRITTEN COMMUNICATIONS:
2. From Sisters of the Precious Blood, 604 Taylor Avenue, signed by Sister M. Melitta, in appreciation
of the new street lights on Taylor Avenue.
The communication was noted and the President directed the Clerk to send a copy thereof to the Bureau
of Electricity.

4,`/ From Jones-Thenn & Associates, requesting abandonment of a transformer easement located at the
front common corner of Lots 7 and 8, Block 1, Tract No. 1898. It was stated this easement was not
needed since another one in the same Tract had been granted and recorded.
Following the City Engineer's clarification of the circumstances involved, Councilman La Croix moved
the Mayor execute a document ordering the abandonment of the specified easement, as requested. The
motion was seconded by Councilman McCall and carried on the following roll call vote. Ayes: Five.
Noes: None. Absent: None.

5. From Pacifica Lodge, Inc., signed by Mr. Larry Surano, President, submitting its Application to
Fill Property along the north side of Mecartney Road - known as Tract No. 2642 - by end dumping of
28,000 cubic yards of material. The application was accompanied by a bond in the amount of $5,000.,
which had been approved by the City Attorney and the Mayor, as required.
Councilman Freeman raised the question about the retention necessary for this project and Mr. Hanna
explained the situation.
Councilman McCall then moved the application be granted subject to compliance with all of the require-
ments of the City Engineer. The motion was seconded by Councilman La Croix and on roll call carried
by the following vote. Ayes: Five. Noes: Nooe, Absent: None.
ORAL COMMUNICATIONS:
U. Mr. Frank Gottstein, 731 Haight Avenue, referred to an article which had appeared in the Alameda
Times-Star recently which had made disparaging statements about one of the Council candidates. He felt
the Council should take a position in concurrence or criticism of such an editorial statement.
It was pointed out this was not a Council matter and the individual Councilmen expressed their regret
about the incident and stated they had so spoken to the candidate in question.
7. Mr. Q. N. Pope, 1820 Bay Street, referred to AB 432 concerning news coverage in Government Agencies
and inquired if the City Manager had yet recommended any position for the City to take on this measure.
Upon request, Mr. Weller explained that the City would take no position on any Bill in the State Legis-
lature's session at this early date because all Bills usually were substantially modified between the
time of introduction and when they were submitted on the floor.
8.r Mr. Al Ruebel, 1716 Eighth Street, inquired about the financial backing of any candidate for City
Office. It was pointed out this was an individual matter and that each candidate had to file with the
City Clerk after the election a Campaign Statement covering his expenditures. Mr. Ruebel said he
thought the people should know before the election just who was "backing" whom and why.
9. / Mr. Lawrence Patton, 1020 San Antonio Avenue, one of the candidates for`Councilmoo, stated he was
financing his own campaign and proceeded to announce an itemized list of expenditures he had thus far
made.
REPORTS OF OFFICERS, BOARDS, ETCETERA:
lO.' From City Planning Board, aigned,by the Secretary, recommending approval of Property Division
Map No. 1I7, subject to conditions contained in the City Engineer's Report dated June 16, 1964. Prop-
erty located on Grand Street - owned by Mr. Eugene P. Lasartemay.
The matter was referred to "Resolutions".
11. From City Manager, recommending contract be awarded to Re-al Equipment Corporation, low bidder,
for furnishing one Portable Air Compressor for the Street Department, at the total cost of $3,300.
Councilman La Croix qmved the recommendation be adopted; that contract be awarded to the specified
firm for furnishing the designated item at the price guote6. The motion was seconded by Councilman
Freeman and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None.

12. From City Planning Board, signed by the Secretary, recommending the adoption of certain amend-
ments to the Alameda Municipal Code - Zoning Ordinance Section - relating to fees for Variance, Use
Permit and Rezoning Applications.
This matter was set for a Public Hearing before the City Council at its regular meeting o be held
March 16, 1965.
Councilman Freeman said she thought the proposed fees were somewhat high for the regular charge for
such applications. The President asked Mr. Johnson to investigate this matter and submit further
information thereon prior to the time of the Hearing.

13. From City Manager, recommending contract be awarded to A. C. Bashnick, low bidder, for the pro-,
jeot of Installing a Sanitary Sewer Along the North Shore of the Lagoon from Grand Street to Bay
Street, at the total cost of $33,936,25.
Councilman Rose moved the recommendation be approved; that contract be awarded to the designated bid-
der for the specified project at the price quoted. The motion was seconded by Councilman La Croix
and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None.

From City Manager, recommending contract be awarded to A. C. Bashnick, only bidder, for the
project of Installing Storm Sewers on Kitty Hawk Road south of Franciscan Way, and Peach Street at
Washington Street, at the total cost of $7,732.80.
Councilman La Croix moved the recommendation be accepted; that contract for said project be awarded
to the designated bidder at the price quoted. The motion was seconded by Councilman Freeman and no
roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None.

15.v From City Planning Board, signed by the Secretary, recommending approval of Property Division
Map No. 115, subject to the conditions contained in the City Engineer's Report dated July 9, 1964,
and with specific exception to Sec. 11-3119 of Subdivision Ordinance No. 1208, New Series. The prop-
erty was located at 3260 and 3262 Madison Street - Robert Bourgeois, owner.
The matter was referred to "Resolutions".
INTRODUCTION OF ORDINANCES:
16. Councilman La Croix introduced the following ordinance, after which it was laid over under pro-
vision of law and the Charter:

l7y 7 From City Planning Board, signed by the Secretary, submitting its recommendations on specific
findings under certain provisions of the Zoning Ordinance and Subdivision Ordinance for approval of
the Tentative Map for Tract No. 2642, located at the northwest corner of County Road and Mecartney Road.
Councilman Rose moved the recommendation of the Planning Board be adopted and the Tentative Map for
Tract No. 2642 be approved as stipulated in the Board's letter of February 25, 1965. .The motion was
seconded by Councilman McCall.

New Series
An Ordinance Authorizing Amendment to the Contract Between the City Council
of the City of Alameda and the Board of Administration of the California State
Employees' Retirement System, Providing for the Exclusion in Said System of
All Hourly Rated, Non-Civil Service Employees of the City Hired on or After
May 1, 1965."

Speaking on the question, Councilman Freeman again raised many inquiries about the map as submitted
and claimed it did not comply with requirements. Mr. Cunningham clarified certain points and Mr.
Johnson explained the regulations of the Zoning Ordinance and the Subdivision Ordinance with regard
to a "PD" type of development.
Councilman Freeman also requested, with the approval of the motion and the second, that a certain por-
tion of the Tract be designated as a recreational area to be maintained by the Homeowners' Association.
A very lengthy discussion ensued. Councilman Freeman believed the exact area should be spelled out
and the facilities itemized.
Following further discussion, Mr. Johnson pointed out that the residential density of this type of
development would actually be less than in a conventional subdivision for the `8-2" zone. He strongly
believed this was the best, most attractive and desirable type of development for this area. Mr.
Johnson also defined the term "condominium° and its ramifications for the information of all concerned.
Mr. Weller also pointed out it would be improper for the Council to "freeze" any particular portion
of a subdivision for any specific purpose because the flexibility of presentation of a Planned Develop-
ment would be sharply restricted both with respect to the Developer and to the action of the Planning
Board. Further it would be wrong because, basically, it would defeat the entire concept of a Planned
Development.
'After more discussion, it was agreed that the Council could advisedly indicate the size of the portion
of the Tract it would like to have reserved for recreational purposes - but not the exact location
thereof. It was suggested the Tentative Map of Tract No. 2642 be approved subject to the retention
and designation of approximately three-quarters of an acre for the recreational use and benefit of
the entire Tract ownership.
Councilman Rose and McCall then withdrew their motion and second. Councilman La Croix moved the recom-
mendation of the Planning Board be adopted and the Tentative Map for Tract No. 2642 be approved as
stipulated in the Board's letter of February 25, 1965, and subject, further, to the retention of approxi-
mately three-quarters of an acre for recreational use. The motion was seconded by Cuuncilmun McCall
and carried on the following vote. Ayes: Councilmen La Croix, McCall, Rose and President Godfrey,
(4). Noes: None. Not Voting: Councilman Freeman, (1). Absent: None.

18. The following resolution was introduced by Councilman Rose, who moved its adoption/

Latest Model, Trailer Type, Tree Spraying Machine for Street Department,
Calling for Bids and Directing City Clerk to Advertise Same."
The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by the
following vote. Ayes: Five. Noes: None. Absent: None.
19. The following resolution was introduced by Councilman Rose, who moved its adoption:
"Resolution No. 6748
Adopting Specifications for Furnishing to the City of Alameda One (1) New,
Latest Model, 1/2 Ton Pickup Truck for Street Department, Calling for Bids
and Directing City Clerk to Advertise Same.'
The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by
the following vote. Ayes: Five. Noes: None. Absent: None.
20. The following resolution was introduced by Councilman Rose, who moved its adoption:

Adopting Specifications, Special Provisions and Plans for Installation of
Exposed Aggregate Concrete at Godfrey Park and Lincoln Park, Calling for
Bids and Directing City Clerk to Advertise Same."

21. The following resolution was introduced by Councilman La Croix, who moved its adoption:

22. The following resolution was introduced by Councilman La Croix, who moved its adoption:

Adopting and Submitting a Third Amended Budget for Expenditure of Funds
Allocated from the State Highway Fund to Cities."
The motion to adopt said resolution was seconded by Councilman Rose and on roll call carried by the

23. The following resolution was introduced by Councilman McCall, who moved its adoption:
"Resolution No. 6752
Authorizing Execution of Agreement with State Providing for Installation of
Traffic Control Signal System at Intersection of Eighth Street with Central
Avenue (State Highway Route 01), and Modification of Existing Systems at
Intersections of Sherman, Grand and Chestnut Streets with Encinal Avenue
(State Highway Route 61), and at Intersection of Webster Street (State�
Highway Route 61) with Lincoln Avenue, and Providing for Costs of Installation
and Maintenance Thereof."
The motion to adopt said resolution was seconded by Councilman La Croix and on roll call carried by

24. The following resolution was introduced by Councilman McCall, who moved its adoption:
"Resolution No. 6753
Adopting Specifications, Special Provisions and Plans for Installation of
Culverts at Taylor Avenue and Caroline Street, Calling for Bids and Directing
City Clerk to Advertise Same."
The motion to adopt said resolution was seconded by Councilman Rose and on roll call carried by the

25. The following resolution was introduced by Councilman McCall, who moved its adoption:
"Resolution No. 6754
Approving Property Division Map No. 115 for Division of Lots 4, 5 and 6,
Block 60, and a Portion of Market Street (Abandoned), and Permitting Recording
Thereof (Robert Bourgeois)."
The motion to adopt said resolution was seconded by Councilman Rose and on roll call carried by the

The President then declared all of said resolutions adopted.
ORDINANCES FOR PASSAGE:
26. "Ordinance No.
New Series
An Ordinance Amending the Alameda Municipal Code by Amending Section 12-326
'Ihereof, Relating to Attendance by Minors at Public Dances."
The President recalled that it was he who had introduced this ordinance at the last meetiog. He
explained that, since then, the Police Department had requested that other provisions pertinent to
this subject also be considered which would be helpful to it in the enforcement of such an ordinance.
He said that, if there were no objections, he would suggest the ordinance be laid over in order that
the City Attorney could incorporate and amend the regulations as requested by the Police Department.
Mr. Cunningham explained the situation and what was intended. The matter was then laid over to the
next meeting.

Taylor Avenue and Caroline Street.
31. Agreement - Between City and State - Installation of Traffic Control Signal System and Modifica-
tion of Existing Systems at Various Locations.
BILLS:
32. An itemized List of Claims against the City of Alameda and the Departments thereof, in the total
amount of $65,273.95, was presented to the Council at this meeting.
The List was accompanied by certification from the City Manager that the Claims shown were Correct.
Councilman McCall moved that the bills as itemized in the List of Claims filed with the City Clerk on
March 2, 1905, and presented to the Council at this meeting, be allowed and paid. The motion was
seconded by Councilman La Croix and on roll call carried by the following vote. Ayes: Five. Noes.:
None. Absent: None.

33. There being no further business to come before the meeting, the Council adjourned - to assemble in
regular session on Tuesday evening, March 16, 1965, at 7:30 o'clock.
