HELD TUESDAY EVENING, JUNE 30, 1959
The meeting convened at 7:30 o'clock p.m. with President McCall presiding. The
Pledge of Allegiance was led by Councilman Freeman.
ROLL CALL:
The roll was called and Councilmen Collischonn, Freeman, Petersen, Schacht and
President McCall, (5), were noted present. Absent: None.
WRITTEN COMMUNICATIONS:
1. From Board of Supervisors of Alameda County, signed by Mr. Harold Schulze, Deputy,
Clerk, urging and recommending the City join in the request to the Governor that he
veto Senate Bill 48, providing for a second State Direct Primary Election in August,
1960, which has been adopted by the Legislature.
Councilman Schacht said he felt this Bill provides for duplication of primary elec-
tions in a presidential election year at great cost and suggested the matter be
referred to "Resolutions ", at which time he would like to introduce a resolution in
support of the request of the Board of Supervisors. There being no objections, it was
so ordered.
2. From County Planning Commission, signed by Mr. Robert L. Williams, Planning
Director and Secretary, requesting the Council, in conjunction with the Planning
Board, to undertake a study of the Wilbur Smith Report - "A Proposed Alameda County
Highway Master Plan" - in order that official policies and views on highways and free-
ways affecting Alameda can be incorporated into the revised County Master Plan.
It was definitely felt there should be a joint meeting of the Council and the Board,
after the latter had reviewed the report. It was determined that a letter be directed
to Mr. Williams informing him of the Council's intention in this respect, pointing up
that the City has grave concern about the proposed freeway along the South Shore and
would like to have sufficient time to study the report before the plan is finally
adopted. It was also brought out the request was made that the City indicate "alterna-
tives" where certain features of the proposal may be unacceptable.
Councilman Schacht strongly felt the Council should meet with the Planning Board
immediately on this matter for a preliminary discussion and then plan to hold another
meeting for further review after each Body had independently given more detailed study
to the report.
Councilman Collischonn moved the Council refer the matter to the Planning Board with
the request that it submit its report on the subject and, subsequently, a joint meet-
ing will be arranged with the Council for further review - and that a letter be sent
to Mr. Williams advising him of the action taken. The motion was seconded by Council-
man Freeman and carried on the following roll call vote. Ayes: Four. Noes: Council-
man Schacht, (1). Absent: None.
ORAL COMMUNICATIONS:
3. Mr. G. N. Pope, 1820 Bay Street, inquired if there was going to be a Public Hear-
ing on the Budget for the ensuing fiscal year. Upon being informed that such was not
required, he requested that a Public Hearing be held.
Mr. Annibale pointed out that all meetings of the Council relative to budget discussions
have been open and public and any citizen could have attended and expressed his views.
REPORTS OF OFFICERS, BOARDS, ETCETERA:
4. From City Manager, reporting all work satisfactorily completed on the project of
Painting and Decorating Portions of City Hall - recommending it be accepted and the
Notice of Completion be ordered filed.
Councilman Schacht moved the recommendation be adopted; that the work on said project
be accepted and the Notice of Completion be filed. The motion was seconded by Council -
man Freeman and unanimously carried.
5: From City Manager, reporting all work satisfactorily completed on the project
covering Limited Janitorial Service for the City Hall during fiscal year 1958 -1959 -
recommending it be accepted and the Notice of Completion be ordered filed.
Councilman Freeman moved the recommendation be approved; that the work on said project
be accepted and the Notice of Completion be filed. The motion was seconded by Council-
man Schacht and unanimously carried.
6J From the City Auditor, submitting his estimate of 556,933,391. as the net assess-
ment values for the City of Alameda for the fiscal year 1959 -1960.
The communication was noted and ordered filed.
INTRODUCTION OF ORDINANCES:
7. Councilman Schacht introduced the following ordinance, after which it was laid
over under provision of law and the Charter:
"Ordinance No.
New Series
An Ordinance Amending the Alameda Municipal Code by
Adding Thereto a New Section, Numbered 17,-344.1,
Relating to 24- Minute Parking Limit." (West side of
Everett Street, between Santa Clara and Central Avenues)
UNFINISHED BUSINESS:
8. The matter was presented concerning the adoption of the Tentative Budget for
1959 -60. Councilman Schacht moved the adoption of said Budget, which was seconded
by Councilman Freeman.
Mr. Weller suggested that, for the record, it would be wise to read the individual
departmental appropriations so there will be no misunderstanding. He also explained
certain funds of the Budget and then proceeded to read the expenditures by classifi-
cation as set forth in the recommended Budget, including the adjustment due to the
recently adopted salary increase.
Mr. Weller referred to the sum of $100,000. in the Contingent Fund and stated it could
be transferred to the Capital Outlays Fund for 1958 -59 by Council authorization at .
this meeting, which would simply reduce the year -end balances or it could be added to
the 1959 -60 Budget and it would make absolutely no difference in terms of the tax
requirement.
Councilman Schacht, with the consent of his second, amended his motion to include that
the City Auditor be authorized and directed to effect said transfer from existing
balances as of June 30, 1959. The motion, as amended, was then carried on the follow-
ing roll call vote. Ayes: Five. Noes: None. Absent: None.
9. The matter was submitted concerning the proposed amendments to Zoning Ordinance
No. 1277, New Series, relative to Home Occupations.
Councilman Collischonn referred to a recent meeting of the City Manager, City Attorney
and Planning Director on this subject and stated he concurred with the review of the
proposed amendments and the recommendations of these officials as contained in Mr.
Weller's memorandum of June 26, 1959, and he would move the City Attorney be directed
to prepare a revised ordinance for introduction at the next meeting of,. the Council in
conformity with said memorandum of June 26, The motion was seconded by Councilman
Freeman.
The City Manager's memorandum set forth the principal issues and the staff recommenda-
tions thereon, as follows:
1. Whether or not the language in Section 11- 1222(c), authorizing the
employment of non- resident assistants by certain professional people
should be retained.
Recommendation: Eliminate permission for such assistants.
2. Whether or not the conditional authority to utilize side and rear yard
areas, as provided in Section 11- 1222(a), should be retained.
Recommendation: Retain provision, under Use Permit procedure.
3. Whether the authority given the Planning Director to register Home
Occupations, as provided in Section 11- 132(a), should be left to the
Planning Board.
Recommendation: Authority to Planning Director, with right of appeal,
first to the Planning Board and, if necessary, then to the City Council..
4. Whether or not a new restriction should be established to prohibit
Home Occupations in "R -1" and "R -2" Districts.
Recommendation: No new restriction to be added.
In response to a number of questions by Councilmen Petersen and Schacht, both Messrs.
Weller and Annibale elaborated upon the contemplated provisions in clarification and
there was a great deal of discussion on the ramifications.
Mr. R. W. Royer, 3255 Thompson Avenue, stated he felt the trend should be toward the
reduction of Home Occupations in residential areas.
The question was then put and the motion carried on the following roll call vote.
Ayes: Councilmen Collischonn, Freeman and President McCall, (3). Noes: Councilmen
Petersen and Schacht, (2). Absent: None.
RESOLUTIONS:
10. The following resolution was introduced by Councilman Schacht, who moved its
adoption:
"Resolution No. 5966
Adopting Budget, Approving and Authorizing Execution
of Memorandum of Agreement with the State of California
for Expenditures of Gas Tax Allocation for Major City
Streets for the Fiscal Year 1959 -60."
The motion to adopt said resolution was seconded by Councilman Collischonn and on roll
call carried by the following vote. Ayes: Five. Noes: None. Absent: None.

11. The following resolution was introduced by Councilman Collischonn, who moved its
adoption:
"Resolution No. 5967
Authorizing Extension of Agreement by and Between the
City of Alameda and the Alameda Family Service Agency,
a Non - Profit Corporation, for a One -Year Period, Said
Agreement Relating to Furnishing of the Services of
an Executive Secretary to the Social Service Board."
The motion to adopt said resolution was seconded by Councilman Schacht and on roll call
carried by the following vote. Ayes: Five. Noes: None. Absent: None.
12. The following resolution was introduced by Councilman Schacht, who moved its
adoption:
"Resolution No. 5968
Adopting Specifications, Special Provisions and Plans
for the Improvement of Grand Street Between Clement
Avenue and the Estuary, Calling for Bids and Directing
City Clerk to Advertise Same."
The motion to adopt said resolution was seconded by Councilman- Freeman and on roll call
carried by the following vote. Ayes: Five. Noes: None. Absent: None.
13. The following resolution was introduced by Councilman Collischonn, who moved its
adoption:
"Resolution No. 5969
Transferring $2.6,836.88 from Special Gas Tax Street
Improvement Fund, and $2, 134.36 from Washington Park
Development Fund to the General Fund."
The motion to adopt said resolution was seconded by Councilman Schacht and on roll call
carried by the following vote. Ayes: Five. Noes: None. Absent: None.
14. The following resolution was introduced by Councilman Schacht, who moved its
adoption:
"Resolution No. 5970
Resolution of the Council of the City of Alameda
Urging a Veto of Senate Bill 48."
The motion to adopt said resolution was seconded by Councilman Petersen and on roll
call carried by the following vote. Ayes: Five. Noes: None. Absent: None.
The President declared all of the foregoing resolutions duly adopted and passed.
1. At this point, Councilman Collischonn mentioned the sand which is still blowing
in the vicinity of Otis Drive and Grand Street, especially that which has accumulated
in the gutters of the streets.
President McCall stated that in view of the recent conference and agreements reached,
the City Manager should call Mr. Travers of South Shore Land Co. and request him to
expedite the cleaning up of these streets. Mr. Weller explained that he thought this
work is progressing and should probably be finished within two days.
16. Councilman Collischonn also asked when the signs would be installed, indicating
"No Trespassing" on the Fill Area which has been treated to prevent the sand from
blowing. It was stated the City is now awaiting delivery and the signs will be posted
promptly upon receipt.
In response to President McCall's question, Mr. Weller replied that he understands the
"Company" has a watchman on a round- the -clock basis to keep people off the treated
areas. He said it is certainly the Company's responsibility to install signs if, in
its judgment, they are necessary to protect the property for which it is responsible.
He stated it is the Company's responsibility to have the Fill Area adequately patrolled
and the sand adequately retained. Mr. Weller stated Mr. Travers is well aware of the
problem and he felt sure he will do everything he can to alleviate the condition.

ORDINANCES FOR PASSAGE:
17. "Ordinance No. 1307,
New Series
An Ordinance Amending the Alameda Municipal Code
by- Amending Section 13 -1924, Section 13 -196, and
Repealing Ordinance No. 261, N. S., All Relating
to Business License Tax."
Councilman Schacht moved the ordinance be adopted as submitted. The motion was
seconded by Councilman Collischonn and on roll call carried by the following vote.
Ayes: Five. Noes: None. Absent: None.
FILING:
18. Memorandum of Agreement - Between City and State for Expenditure of Gas Tax
Allocation for Major City Streets.
19. Extension of Agreement - Between City and Family Service Agency - to
June 30, 1960.
20. Specifications No. PW 6 -59 -11 - Project of Improving Grand Street between
Clement Avenue and the Estuary.
BILLS:
21. An itemized List of Claims against the City of Alameda, and the Departments
thereof, in the amount of $12,674.67, was submitted to the Council at this meeting.
The list was accompanied by certification from the City Manager that the Claims shown
were correct.
Councilman Schacht moved the bills as itemized in the List of Claims filed with the
City Clerk on June 30, 1959, and presented to the Council at this time, be allowed
and paid. The motion was seconded by Councilman Collischonn and on roll call carried
by the following vote. Ayes: Five. Noes: None. Absent: None.
ADJOURNMENT:
22. There being no further business to come before the meeting, the Council adjourned -
to assemble in regular session on Tuesday evening, July 7, 1959, at 7 :30 o'clock.
