REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, AUGUST 6, - - - - - - 1957 The meeting convened at 7:30 o'clock p.m., with President McCall presiding. The Pledge of Allegiance ras lead by Councilman Petersen. ROLL CALL: The roll was called and Councilmen Haag, Petersen, Schacht and President McCall (4), were noted present. Five bids were received and read for the project of Constructing Paving in the Vicinity of the New Nunicinal Golf Course Club House, in accordance with Specifica- tions, Special Provisions and Plans therefor, No. PVT 6-57-18, as follows: From Gallagher & Burk, Inc. WRITTEN COMNUNICATIONS: From Mrs. Helen Hastier, 2837 Calhoun Street, protesting against the Lagoon Sys- tem because she believes it is a hazard to children and a bottleneck in case of disaster. The communication was noted and referred to the file on the subject. From Alameda Municipal Civil Service Employees Association, signed by Pir. Arthur L. Berg, Vice President, thanking the Council for its efforts in bringing City Employ- ees' salaries into line with neighboring municipalities. President McCall thanked the Association for its expression of appreciation. 6. From The Commercial telegraphers' Union, signed by Mr. L. Ross, President, urg- ing the Council to protest against the closing, of the Alameda office of Western Union Telegraph Company, in the interest of public convenience. The letter was noted and ordered. filed. 7. From Skiatron TV Inc., 9i15 Santa on ice Boulevard, Los Angeles, signed by Er. Alan Lane, Vico President and Director, making application for permit or license to construct, operate and maintain a closed circuit television system within the City of Alamede. The letter was accompanied by a memo from the Acting City Manager, recommending the matter be referred to the City Attorney for study and report. Mr. Annibele stated a meeting on this particular matter has been set for August 9, 1957, in San r'rancisco, and he, has been invited to attend. He said he could give a definite renort on the subject after that meeting. P‘" From Berger 6; Plate Company, Incorporated, signed by Mr. J. W. Herring, request- ing the refund of c'48.95, paid on Tax Bill No. LL63, covering certain merchandise already paid for under Tax Bill No. 4611. The request was accompanied by a letter from Mr. R. V. Grafe, Deputy Assessor, explaining that two companies had paid on the same merchandise which had been declared erroneously by Encinal Terminals. (-)2 Mr. Annibale explained that the Alameda Municipal Code requires that an application for a refund must be verified - which was not done in this instance - and he sug- gested the matter be referred to him and he would so inform the applicant. It was so ordered. 9. From County of Alameda Board of Supervisors, signed by Mr. Harold Schulze, Deputy Clerk, informing the Council the sum of di9,000. has been included in the 1957-58 County budget for steam cleaning, painting and surface preparation of Posey Tube - also, 2/1_,000. has been allocated for the installation of intensive lighting zones for 300 feet inside each portal. Councilman Haag stated he did not remember whether or not the County Budget has been approved or officially announced but it would seem to him that the minute it is announced, the City Manager should make a monthly checkup to ascertain that the money allocated in the County Budget for this purpose is expended. It is one thing to have it in the Budget and another thing to have it spent. President McCall asked that this be done. 1 10. From Aeolian Yacht Club, Inc., signed by Mr. Alton S. Lee, Vice President, making Application for Permit to Fill Property, by truck dump and/or dredge, with 7,000 cubic yards of material. The area to be filled is located immediately south- westerly from Market and Calhoun, Streets. The Clerk stated she had on file the bond covering this project, which had been apnroved by the Mayor. Councilman Haag asked the City Engineer for some information on this matter. Mr. Hanna have a detailed explanation of the situation and the improvement which will be effected. Councilman Haa, moved the application be granted and a Permit be issued for the fill as requested. lhe motion was seconded by Councilman Petersen and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Coun- cilman Freeman, (1). Nis 11. Petition from thirty-three residents of the 5n0 block of Taylor Avenue, making the following requests: That said avenue, between Fifth and Sixth Streets, be made one-way traffic, westerly; that parking be permitted on one side only and the Stop Signs be removed from Sixth Street and Taylor Avenue and placed at the intersection of Fifth Street and Taylor Avenue. These requests were made due to the narrowness of the street in this block. President McCall stated that, if there were no objections, he felt this matter should be referred to the Acting City Manager whowill contact the Chief of Police for a review and report on this subject. It was so ordered. 12. From Key System Transit Lines, concerning its consideration of substituting motor coach service for train service between the East Bay and San Francisco - and asking the City's cooperation by eliminating the tax provision from the franchise granted to Key System. President McCall stated most of the cities affected are endeavoring to find out what the others are doing in this respect and he felt this Council should wait until such time as the cities have had an opportunity to get together and discuss this sub- ject so that all will know the cities are agreed with regard to this communication. He asked if there were any objections. Councilman Haag asked what is the franchise fee being paid to the City by Key System. Mr. Neil Clark replied that for the year 1956-57 the sum of ',31 ,a23. was received and the amount of $9,0O0. has been conservatively budgeted for the current fiscal year. Councilman Schacht thereupon moved the communication be referred to the Committee of the Whole. The motion, was seconded by Councilman Haag and unanimously carried. 1. From Hotel Alameda, signed by Mr. James Stahlbaum, Manager, requesting the Coun- cil reconsider its action to eliminate the position of Captain in the Alameda Police Department because in so doing it would be risking the safety and protection of the citizens. 14. From Blunden Tot & Teen Shop, signed by Mr. Jack A. Blunden, urging the Council to retain the position of Police Captain. 15, From Mr, Ross Wright, Real Estate and insurance Broker, pointing out other means of cutting the budget should be taken before eliminating the important position of Police Captain. 16. From Mr, George H. Searle, 2150 San Jose Avenue, stating a saving made at the expense of public safety would be a great mistake and hoping the tentative decision recently made to eliminate the position of Captain in the Police Department will be reversed. 17. From Mr. Robert E. DeCelle, 276 Beach Road, suggesting no budget cuts be made in the Recreation and. Police Departments' services, but that other means be found to reduce the tax. 18. From West Alameda Business Association, signed by Mr. Don Bernal, President, urging the Council to reconsider its action to eliminate the position of Captain in, the Alameda Police Department. President McCall stated the Council has received these communications from the several persons and organizations and, if there are no objections, the letters will be -Med. He said he knew the subject was going to be brought up under "Oral Communications", as Mr. Whitney has asked for permission to speak at that time. 19. The Clerk presented two written communications, each dated July a„, 1957, and identical in content - one from Reclamation District 2087, signed by Mr. Charles T. Travers, President of the Board of Trustees, and the other from Utah Construction Company, signed by Mr. E. W. Littlefield, Executive Vice President. Commitments were set forth in detail from each organization as to its payment of all costs and expenses incurred by the City in the acquisition of the necessary easements for the lagoon drainage system and facilities to be constructed along the south shore of the City. President McCall asked the City Attorney to comment on these letters. Mr. Annibale stated there is a resolution on the Agenda for this meeting authorizing condemnation proceedings with regard to the specific narcels needed. These letters are, of course, necessary as the agreements by the Reclamation District, guaranteed by Utah Construc- tion Company, to bear all costs in relation to gaining such easements. He Pointed out they're sufficient agreements by the respective parties, i.e., the Reclamation District and Utah Construction Company, to conform to the CouncilTs desires in this matter. The communications were then ordered filed. ORAL COHLTTICATIONS: 201/. At this point, President McCall noted, and welcomed, a group of Cub Scouts and asked the Cubmaster to introduce his boys. 21'1. Mr, Paul E. Jackson, of the California State Automobile Association addressed the Council in presentation of the Honorable Mention Award in the annual American Automobile Association Pedestrian, Protection Contest. He commended the "Official Family" for its coordination of efforts by tt-e Police Department and the Court - and said the winning of the Award testifies to some very fine work. He introduced Judge Van Sicklen of the Municipal Court and Lt. Gerald Nordling of the Alameda Police Department. He asked Mr. D. D. I,Tay, Divisional lanager of the California State Automobile Association, to present the plaque to the Mayor. With appropriate thanks, Mayor McCall accepted the plaque on behalf of the City and he, in turn, presented it to Lt. Nordling for display in the Police Department. 2 Mr. Stanley D. Whitney appeared before the Council, stating he represented the Triangle Club, which organization is quite concerned with the Cooncil's proposed elimination of the position of Captain in the Alameda Police Department. He compli- mented the Council on its diligent efforts to reduce the budget but emphasized that when it starts economizing on public health and safety, it is treading on dangerous ground. He said it is impossible for a Chief to spread himself out so thin that he can be both a Chief and a Captain and perform the administrative work and bake care of the problems all the way down the lino. He quoted from the reports and recommen- dations of the drand Jury of Alameda County, the Public Administration Service and the Citizens' Advisory Committee to the effect that a captain is needed in the Police Department organization for a City of this size. He pointed out the record shows Alameda has ess police officers per population ratio than any other City and he urged the Council to reconsider its action to eliminate this position. President McCall stated that, at the meeting when this particular portion of the budget was considered, there were only three members of the Council present, and it had been the recommendation of the City Manager that this position, could be deleted for a period of one year. Subsequently, all of these letters have been received and the Acting City Manager has undoubtedly discussed the matter with the Chief and other members of the Council have also discussed the situation with him and we find that the Chief actually believes this position should be retained due to the fact it will give him the opportunity to administer his department more efficiently. He said he was sure the Council, at the time this decision was made, had no thought of not safe- guarding the lives of the people of the City. He felt the other members of the Council might now wish to express their opinions on the subject. For himself, he said he agreed the position is justified but it will probably be October 1 before the position can be fillled due to the giving of an examination. Councilman Haag stated that, while he was not present at the meeting in question, he felt sure the three members who were there went along with the recommendation of the City Manager. After discuesing the matter with Chief Dralne, he felt it was nob only proper, but necessary, that the position be filled. Councilman Schacht stated he, too, had not been present at that meeting, but the sub- meet had been discussed somewhat previously and it was the recommendation of the City Manager. He said he, personally, has not had an, opportunity to discuss the matter with too many others but he would not, in any way, want to jeopardize the health, safety and welfare of the community. Apparently, from the expression of opinion of other members of the Council it is now felt the filling of the position is quite urgent, and he concurred it is a necessary step. Councilman Petersen said he felt sure Mr. Whitney realizes the critical situation of the budget in Alameda at this time and every member of the Council does likewise. Pertaining to this position, the discussion came up at a time when the Council was considering various cuts concerning jobs which were not currently occupied, and the City Manager had recommended the job be deleted. The Council, being enthusiastic to save as much money as possible, had gone along with the recommendation. He agreed with Mr. Whitney the most imnortant features to consider in the budget are the safety and welfare of the people. He said he felt the Council can and should make an adjust- ment on this particular situation and it will be doing the community a service in this respect. President McCall assured Mr. Whitney the Council is in full accord on this issue and, while the Tentative Budget is on the Agenda tonight for submission to the Council, any corrections in that budget can be made up to the time it is nresented to the Council in its final form on the third Tuesday in September. The City Attorney corroborated this statement. President McCall asked the pleasure of the Council with regard to further action on this position. Councilman Haag moved the position of Captain of Police be reinstated in the budget in order that the Chief may take immediate steps to get his examination under way and to fill the position at the earliest possible time. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Freeman, (1). V 23. Mr. Frank Gottstein, 731 Haight Avenue, addressed the Council in protest against the trucks that double park at Ninth Street and Santa Clara Avenue, and those who park in the zone which is supposed to be reserved for busses, causing the latter to stop in the middle of the street. He also spoke at great length concerning the Posey Tube improvements - painting and lighting. He said he had appeared at a meeting of the County Board of Supervisors and had requested that any monies allocated for lighting be exnended on the Alameda side as it is needed much more there. He asked that the City Council make such request of the Board of Supervisors. Councilman Petersen stated he had talked with innumerable people who feel the same way Mr. Gottstein does about the lighting in the Tube and he felt the Council should ask for the "full treatment" on this issue. He moved the Council ask the Board of Supervisors for a complete remodeling or painting of the Tube on the Alameda side and request that such be fulfilled. The motion was seconded by Councilman Haag and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Freeman, (1). President McCall asked the Acting City Manager to write such a communication to the Board of Supervisors. Councilman Haag said he felt this letter is quite important and should be made strong enough and he wondered if it could be delayed long enough so that a letter could be drawn up in rough draft form and sent out to the Councilmen immediately for any additions or suggestions each one may have. It was so ordered. REPORTS OF COMMITTEES: V 24. From the City Manager, recommending the City enter into a contract with Mr. Philip N. Storrs for engineering work on Lincoln Avenue and Tilden Way, at the low- bid fee of 2 3/4 per cent of the contract price. In response to Councilman Schacht's question, Mr. Clark answered that the fee pay- able to Mr. Storrs would be `";27,000. It was pointed out the project involved is very large. Councilman Schacht moved the City Manager's recommendation be adopted; that con- tract be entered into with Mr. Storrs for said engineering services at the fee quoted. The motion was seconded by Councilman Haag and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Freeman, (1). Councilman Haag called attention to the fact that, originally, one proposal had been submitted and it had been suggested it be approved. However, the Council had asked that additional bids be secured. The original bid was four per cent - and, roughly figuring, by having called for more bids, the Council saved the City about 410,000. 4 25. From the City Manager, requesting permission be granted to sell the Burbank School building at the best possible price. Councilman Petersen moved the City Manager's request be granted. The motion was seconded by Councilman Schacht and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Freeman, (1). 26. From Mr. Wallace D. Miracle, member of the Library Board, requesting a three- months leave of absence from his duties, beginning August 7, 1957, as he will be on a trip out of the country. Councilman Schacht moved Mr. Miracle's request be granted. The motion was seconded by Councilman Haag and unanimously c arried. 27. From the City Planning Board, concerning Mr. James M. Campbell's contract cover- ing certain planning services. It was stated the Zoning Ordinance text and Zoning Maps were to be submitted by Mr. Campbell not later than August 27, 1957. As the first public hearing on the new Zoning Ordinance is scheduled for August 8, 1957, and certain material which should be used in the Master Plan text will be gained from the hearing on. said Ordinance, it is felt that a sixty-day extension of Mr. Campbell's contract would be desirable, in order to make the Master Plan text as complete as possible. Councilman Haag stated that, since this is the wish of the Board, as well as the Acting Planning Director, he would so move. The motion was seconded by Councilman Petersen who pointed out this work has beencblayed considerably and it should be stipulated that the Council will not grant any additional extension and it expects the job to be completed under the present extension of time. Councilman Haag thereupon amended his motion to include this stipulation, and on roll call it was carried by the following vote. Ayes: Four. Noes: None. Absent: Coun- cilman Preeman, (1). 281 From Acting City Manager, recommending Messrs. Ray Gaul, Paul Nelson, James Merritt, Arthur Treadwell, Jr., and Don Ulricksen, Police Officers, be authorized to attend the 16th Annual California Technical Institute, to be held at University of California, August 5 through. August 16, 1957, on their own time - and be appro- priated to defray their expenses. Councilman Petersen moved the Acting City Manager's recommendation be approved; that the five Police Officers specified be authorized to attend the Institute and be appropriated for their expenses. The motion was seconded by Councilman Schacht and on, roll call carried by the following vote. Ayes: 1°our. Noes: None. Absent: Council- man Freeman, (1). 29. From the Acting City Manager, submitting the Tentative Budget of the City of Ala- meda for the fiscal year 1957-1958. President McCall questioned whether the Council would act on the Tentative Budget as presented or as amended with regard to the reinstatement of the salary for the posi- tion of Police Captain, The Acting City Yanager explained this is the City vanager's E'entative Budget and it is certainly within the province of the Council to change it and we can make that change immediately - therefore, making it possible for an exam- ination to be held so the position can be filled. Mr. Annibale stated that merely an acceptance of the filing of the Tentative Budget as amended in relation to the position of Police Captain would be the motion in order. Councilman Schacht moved that the Council accept the filing of the Tentative Budget wit the thourht of inclucin the action which has been taken tonight with regard to the reinstatement or the ,00sition of Police Captain. Councilman HaeF seconded the motion but wanted to point out that it would not mean adding a full year's salary to the budget. It was agreed that it woele Probably be October 1 before the position could be filled, and therefore three months salary cold be delete( from the budget in this connection. Speaking on the question, Councilman Petersen referred to the contemplated sale of the Encinal Housinr property, bids for which will be opened on August 20 11 felt, at that time, the Council will know if it can reduce the budget further and it is his hope that such can be done. When the money from the sale of the industrial park is realized, the Council anticipates making a considerable reduction in the current budget and he hopes it will be very substantial and, under the circumstances, and in view of the fact there is a twenty-three anc seven-eirhths per cent increase et this t.me, he will vote "'To" on the filing because he believes the Council can ro lower. President McCall Pointed out this is merely the filing of the Tentative Budget and chanres can be made un to the third Tuesday in September. He thereupon called for a roll call. From the City Manager, reporting aLL work satisfactorily completer: on the project of Installing Sanitary Sewers to serve the Alameda Municipal 71olf Courses - recommend- ing it be accented and the Notice of Comnletion be ordered filed. Councilman Haar moved the City 1,Lanprer's recommendation be adoPted; that the work of the specified project be accented anc the ',otice of Completion be filed. The motion was seconded by Councilman Petersen and unanimously carried. 31. From the City Manarer, renortinr all work satisfactorily completed on the nroject of Remodeling Washroom at the Corporation Yard - recommending it be acceieted and th, Notice of Completion be ordered filed. Councilman Petersen moved the City ", ,a,ger's recommendation be,approved; that the work of the designated project be accented and the Notice of Completion be filed. The motion was seconded by Councilmen Schacht and unanimously carried. 4 31. From Acting City Manager, reporting all work satisfactorily completed on the project of Constructing Washington Park Levees and Portion of Fill - recommending it be accepted and the Notice of Completion be ordered filed. Councilman Schacht moved the Acting City F(Anager's recommendation be followed; that the work of this project be accepted and the Notice of Completion be filed. The motion was seconded by Councilman Haag and unanimously carried. 33. From Acting City Manager, reporting all work satisfactorily completed on the project of Constructing a Road and Parking Lot to serve the New Municipal Golf Course - recommending it be accented and the Notice of Comnlction be ordered filed. Councilman Haag moved the Acting City Manager's recommendation be adopted; that the work on this project be accepted and the Notice of Completion be filed. The motion was seconded by Councilman Petersen and unanimously carried. INTRODUCTION OF ORDINANCES: 3,L. Councilman Haag introduced the following ordinance, after wt.ich it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding Subdivision (79) to Section 17-h32 ?hereof, Relating to Stop Intersections. (Clubhouse Memorial toad and Maitland Drive). UNFINISHED BUSINESS: 3 . Councilman Haag said that, sometime ago, the Recrertion Commission had submitted certain rules and regulations for use of the old Golf Course Club House. At that time, Councilman Schacht had asked that the matter be laid over so he could familiarize him- self with the details before voting on the matter. Councilman Haag wondered if the matter could be acted upon at this time. Councilman Schacht stated that, what 'iti the budget sessions, there had still been no time in which to discuss several Questions he had on the matter. Councilman Haag agreed it was all right with him to continue it further. RESOLUTIONS: 36. The following resolution was introduced by Councilman Petersen, who moved its adoption: "Resolution No. 5676 Resolution of the Council of the City of Alameda Supporting Recommendations of the Alameda County Highway Advisory Committee as Set Out in. the Minutes of the Meeting of Said Committee Dated Friday, July 5, 1957." The motion to adopt said resolution was seconded by Councilman Ha-1g and on roll call carried, by the following vote. Ayes: Four. Noes: None. Absent: Councilman Freeman, (1). 37. The following resolution, was introduced by Councilman Schacht, who moved its adoption:- "Resolution No. 5677 Designating Certain Streets 'fithin the City of Alameda as Maor City Streets (Tilden 'lay, Patton 'lay and Marshall 'lay)." The motion to adopt said resolution was seconded by Councilman Haag and on roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman Freeman, (1). 38. The following resolution was introduced by Councilman Haag, who moved its adoption: "Resolution No. 5678 Amending Portion of Salary Resolution No. '-)656 by Deleting the Positions of Denuty Assessor and Assistant Purchasing Agent and Building Superintendent and Adding the Position of Deputy Assessor and Assistant Purchasing Agent." The motion to adopt said resolution was seconded by Councilman Petersen and on roll call carried by the following vote. Ayes: Four. Joes: None. Absent: Councilman 7reeman,(1). 30. Tem following resolution was introduced by Councilman Petersen, who moved its adoption: "Resolution No. L----;679 Resolution of the City of Alameda Declaring Public Interest and -4eco sitY Require the Acouisition of Certain Real Property for Storm dater Drainage Purposes, Author- izing Commencement of Condemnation Proceedings and Employment of Special Legal Counsel -Lherefor." The motion to adopt said resolution was seconded by Co,Incilmar Schacht and or roll call carried by the following vote. Ayes: Four. Noes: None. Absent: Councilman T,lreeman, (1). LO rhe following resolution was introduced by CoflncilmRn Schacht, who moved its adoption: "Resolution No. 5680 Resolution, of Intention to Order the Vacation of a Portion of ::-Irket Street, in the City of Alameda." The motion to adopt said resolution was seconded by Council-,an Haag and on, roll call carried by the following vote. Ares: Four. Noes: None. Absent: Councilman Freeman, '(1). President McCall declared all of t'le -oree'oing resolutions duly adopted and passed. At this point, Councilman Schacht said he thought some resolution should be fortienn n from this body to the Federal Communications Lon on Protesting the closing or the Western. Union Office in, the City. He said the letter from The Commer- cial Telegraphers' Union set forth very clearly the necessity for our maintaining said office. He thereupon moved the Council adopt a resolution opoosing the granting of permission to close the Alameda Office of Western Union. Councilman Petersen seconded the motion. Speaking on the question, Councilman Haag stated this particular office has been certainly non-compensatory - in other words, it has been a loss operation. A report showed there was an average of five messages per day. Councilman Schacht felt this was a public utility which owed. a duty to the public regardless of whether or not it made as llch profit as it would like. Councilman Petersen pointed out most of the telephoned messages are pushed through the Oakland office and there is no charge made through the Alameda office and he felt this was part of the reason for the situation. President McCall stated a representative of "lestern Union had been present tonight but he had left, and he wanted an opportunity to discuss this with the Council from the floor. Lie President felt that, in all fairness, he should be given such op ,or- tunitv before action is taken on a resolution. Further discussion ensued on the subject - it being brought out that an application has been maQ© for a telegreonh and messenger serYice to be located at 128 Linturn Street. Councilman Schacht contended the Council owed it to the business firms and citizens to make every effort to maintain a 'restern Union Ucrice in the City, and he felt it is the Council's duty to protest t-,(-) aUrmpl,ed closinco.
