1956-10-26 Regular CC MinutesADJOURNED REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA The meeting convened at 7:30 o'clock p.m. with President Kranelly presiding. ROLL CALL: The roll was called and Councilmen Haag, Hove, McCall, Moresi and President Kranelly, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held. October 16, 1956, were approved as transcribed. WRITTEN COMMUNICATIONS: 2 From the Alameda Chamber of Commerce, attaching copies of the Chambe First Quarterly Report, as requested by the Council in the 1956-1957 Contract. This letter and enclosure were acknowledged with thanks, and referred to the file on the subject. ORAL CONYUNICATIONS: 3' Mr. Frank Gottstein remarked upon the recent incident when a jet plane crashed in a populated section of the Oakland hills, and said this occurrence gives good argument against the continuation of this dangerous flying. He felt these planes should be flying over the ocean. Mr. Gottstein also criticized traffic conditions on Webster Street to the Posey Tube, which are caused by the heavy flow from the Naval Air Station. President Kranelly stated he and the Council were aware of the jet plane tragedy and had given thought to the possibility of a similar occurrence in the City of Alameda. He felt it might be well to bring it to the attention of the authorities and that planes should be prohibited from flying over the City. Councilman Moresi heartily agreed, citing that planes had gone down recently over the Air Station, The City Manager was requested to write to the Oakland and Alameda Naval Air Stations, referring to the incident, and asking them to do what can be done to prevent such an accident over the City. Councilman McCall called attention to the fact that the plane involved in the crash was based at Moffatt Field, Councilman Haag pointed out there is a great number of business and professional men who belong to the Navy League. All members of the League are expected to be a liaison between the Navy and the public. He suggested calling this matter to the attention of the Navy League. Councilman Hove suggested a strong protest should be made by letter. Mr. Robert G. Andrus, in the audience, wondered if these craft have any pattern of flight. It was suggested that a pattern might be set over the ocean. The City Manager, upon request, stated this matter had come before the Council pre- viously on one or two occasions. Some months ago, a conference was held with Cap- tain French at which it was stated the pattern the Navy has is to fly over the Estuary. The question was raised, then, whether these planes are off their flight pattern when the accidents happen. Councilman Moresi believed that many times the flight pattern is not followed. Mr. Froerer said any time a squadron comes into the Air Station the men are briefed and given the pattern. Councilman Hove asked the City Attorney if the City would be in a position to take legal action. Mr. Annibale replied this would be true as to a private airline, but he would -vant to investigate as to such an action concerning the Federal Government. It was then directed that the City Manager write the llth and 12th Naval Districts, and also the Navy League, to bring this matter to the attention of the proper authorities. REPORTS OF CONMITTEES: L. From the City Manager, recommending extension of three weeks' time be granted O. C. Jones & Sons, contractor, for completion of the project of Constructing Three Off-Street Parking Lots, in accordance with Specifications No. PW 7-56-15. Councilman Hove inquired if this delay would affect the deadline date of November 15 for completing the Parking Lots. The City Manager replied the lots will be completed according, to schedule, "God and the weather willing". There has been some delay incurred by virtue of the fact that in some instances tenants could not be gotten out of houses. To a question by Councilman Haag, Mr. Froerer said the completion of the contract means pavin, marking, placing meter posts, everything but fixing the meters. Councilman Hove then moved the recommendation of the City Manager be followed; that the requested time extension of three weeks be granted O. C. Jones & Sons for the completion of the specified project. The motion was seconded by Councilman Moresi and unanimously carried. r-V From the Recreation Commission, signed by J. Roger Hooper, Chairman, recommend- ing that public swimming after school cease on November 1, and on weekends after November 26, 1956, to be initiated again in the spring of next year. Councilman Moresi moved the recommendation be accepted and that public swimming be discontinued on the dates specified. The motion was seconded by Councilman McCall and unanimously carried. 6. From the Mayor, nominating Mr. Terry Y. LaCroix, Jr., 920 Grand Street, for appointment to the office of a member of the Recreation Commission for the term com- mencing September 1, 1956, and expiring August 31, 1959. This letter was referred to "Resolutions". From Mr. Burt C. Henry, submitting his resignation as a member of the City Planning Board. Councilman McCall moved the resignation of Mr. Henry be accepted. The motion was seconded by Councilman Haag and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. INTRODUCTION OF ORDINANCES: 8. Councilman Hove introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding Subdivision (74) to Section 17-432 Thereof, Relating to Stop Intersections." (Moreland Drive and Buena Vista Avenue) 11W BUSINESS: 9. At this time, President Kranelly, with the permission of the Council, brought up the subject matter of a letter from the Alameda Chamber of Commerce dated Octo- ber 22 concerning the installation of life-size reindeer and tri-colored garlands in the business districts. It was stated the Chamber is anxious to proceed with this project. Councilman Moresi pointed out these fittings would be the property of the Chamber, and inquired who is going to purchase them. The City Manager, upon request, explained there is a combination of funds. The City has annually appropriated in the budget a certain figure, which went usually for stringing the decorations, installing them and for the cost of the electric energy for liuhting. He said he did not know what appropriation the Chamber might want for this purpose. Councilman Moresi pointed out there has been a collection from the merchants. Mr. Froerer stated this amount of donation has been dwindling each year. Generally speaking, the Chamber of Commerce has collected this fund from the merchants group for the purpose of providing these decorations. He was not prepared to say what the situation would be in respect to this fund and the use of the City funds. Councilman Moresi felt the Council should know how this expense will be underwritten. President Kranelly stated it was his understanding there would be no recurrence of the expense. The City Manager was then requested to inquire as to the plans for underwriting this project, and the matter was laid over for consideration at the regular meeting to be held November 7. RESOLUTIONS: 10. The following resolution was introduced by Councilman Haag, who moved its adoption: "Resolution No. 5469 Amending Portion of Resolution No. 5376, Relating to Positions and Salaries, by Increasing Position of Engineering Aide from 4 to 5, and Decreasing Position of Senior Engineering Aide from 3 to 2, in the Street and Engineering Department." The motion to adopt said resolution was seconded by Councilman Hove and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. Upon request, the City Y.anager stated this resolution effects an addition of a lower classification and eliminates one higher classification. 11. The following resolution was introduced by Councilman Hove, who moved its adopticn: "Resolution No. 5470 Appointing Member of the Recreation Commission." (Terry Y. La Croix, Jr.) The motion to adopt said resolution was seconded by Councilman McCall and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. President Kranelly thereupon declared the foregoing resolutions duly adopted and passed. ORDINANCES FOR PASSAGE: 12' . "Ordinance No. 1199, New Series An Ordinance Authorizing the Acquisition of Certain Real Property Known as Encinal Project, Cal-4113." Councilman Moresi moved the ordinance be adopted as read. The motion was seconded by Councilman McCall and on roll call carried by the following vote. Ayes: Five, Noes: None. Absent: None. 13. "Ordinance No. 1200, New Series An Ordinance Authorizing the Conveyance of Quitclaim Deed of a Certain City Owned Easement to the United States of America." Councilman McCall moved the ordinance be adopted as read. The motion was seconded by Councilman Haag and on roll call carried by the following vote. Ayes: Five. Noes: None. Absent: None. 14. "Ordinance No. 1201, New Series An Ordinance of the City of Alameda Authorizing a Contract Between the City Council of the City of Alameda and the Board of Administration, California State Employees r Retirement System, Providing for the Participation of Said City of Alameda in Said State Employeesr Retirement System, Makin F Its Employees Members of Said System, with the Exception of Local Policemen, Firemen and Health Department Employees; Amending Ordinance No. 673 N.S., to Exclude Employees Who Enter into the State Employees? Retirement System." Councilman Haag moved the ordinance be adopted as read. The motion was seconded by Councilman Hove and on roll call carried by the following vote. Ayes: Five. Noe None. Absent: None, FILING: 15. Quitclaim Deed - Between the United States of America and the City of Alameda. 16.
