REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA
HELD.TUESDAY EVENING, MAY 20, 1952
The meeting convened at 8:00 o'clock P. P. with President Osborn presiding.
ROLL CALL:
The roll was called and Councilmen Anderson, Sweeney and President Osborn, (3),
were noted present. Absent: Councilmen Branscheid and Jones, (2).
MINUTES:
1. The minutes of the regular meeting held May 6, 1952, were approved as trans-
cribed.

( 2. Bids were opened and read for the project of Installing a 24 inch Storm Water
Pump and Auxiliary Equipment at the existing Northside Sewer Storm Water Pumping
Plant, in accordance with Specifications, Special Provisions and Plans therefor,
No. Pj 2-52-3, as follows:

The bids were referred to the City Manager and Ci ty Engineer for study and recom-
mendation-
ORAL COMMUNICATION"S:
3V Frank Gottstein addressed the Council, stating he had complained about
glass on the beaches sometime ago, which had resulted in signs being placed about,
warning people against this practice. He said he noticed several children had been
cut lately at ':fashington Park and he felt some attention should be given this matter
before it becomes more serieus. He Pointed cut that he had noticed some of the
signs had been removed. He suggested some plain clothes Renee Officers should be
assigned to patrol the beaches and arrest those who destroy the signs and throw
bottles around.
President Osborn asked the representatives of the press to write up a story in their
papers concerning this dangerous condition. He pointed out that there just are not
enough police officers and personnel to keep the beaches clean and maintain a safe
condition continuously.
Upon inquiry, City Engineer Maynard replied that men are assigned to the park
beaches and clean them up each morning, but sometir-es after a heavy crowd over the
week-end; it is difficult to keep the debris cleaned up.
It was suggested that perhaps the Auxiliary Police Officers might aid In this work.
President Osborn asked the City lianager to take this natter up with Sgt. Stewart
and ascertain if these men would be willing to help out in this manner.
Councilman Anderson said he agreed with what has been said, and asked if the City
Attorney could inform the Council as to the City's liability in this respect. Mr.
Clark stated there is a provision in the Municipal Code which definitely covers
this situation. He referred to Sec. 15-612, in which the throwing of glass,
etcetera, is prohibited upon any public street, highway or grounds. He explained
that the City's position with regard to liability is to exercise ordinary care in
keeping the beaches clean and if this is done, the City is relieved of liability.
Mr. Gottstein stated he thought that if People throw bottles around, it is a mis-
demeanor on their part and they could be arrested on that charge. President
Osborn pointed cut the problem is to catch them doing it.
City Manager Froerer exnlaired that henceforth on busy days two men from the Park
Department will patrel the beaches and anyone caught tossing bottles around will
be prosecuted if necessary.
4./ Mr. Alvin Svendsen, 2850 Jackson Street, addressed the Council, stating he
had lived here about ten years. He felt there is one particular thing which would
add a great deal to Alameda and that is a swimming, pool. He pointed out that the
neighboring City of Oakland has five or six swimming nools and the boys and girls
in Alameda are forced to go there to swim. 7e remarked that several years ago a
p011 was taken and the greatest number or votes was cast for a swimming Pool.
He felt it would be a very fine investment for the City of Alameda to have such
a pool. He asked why Alameda cannot have one in each end of the City.

President Osborn answered that this matter has been under consideration for a great
many years - many arguments having been expressed for and against. He stated that,
at the present tire, there are no funds available for the construction of such a
pool. He said he felt it is a question which will require much more consideration.
He pointed out that tonight there are only three members of the Council present
and he suggested one of these members might comment at this time. He concluded by
stating that, from what he has been told, and experiences he has heard about from
other cities, his own personal opinion is that nunicipally-owned and operated
swimming pools are great problems.
Councilman Sweeney stated this question has come up off and on for many years.
He stated that, in checking into the situation, Oakland has many troubles with
its pools - but said this does not necessarily mean there should be no swimming
pool here. He said he understood there has been a movement on for a certain
type of swimming pool which has been worked out with the Board of Education
and suggested Councilman Anderson might explain it because he was more familiar
with the matter.
Councilman Anderson stated there is such a program contemplated. The program
started might not fulfill that which is in mind because there are problems to
be ironed out, but he felt the problems can be worked out and a solution obtained.
He said he felt he knew where the money can come from - the taxpayers money lies
in the City Treasury. It is the people's money - it is there - and he cannot
understand why it cannot be used for tbe building of swimming pools. He suggest-
ed IVIr, Svendsen contact him for details of the program and said he felt that
eventually the City would have swimming pools - or know the reason why.
Yr. Svendsen said he believed the money should be used for this purpose or, if
necessary, float bonds to finance swimming pools which would be supervised by
life guards and give children the opportunity to learn to swim.
Councilman Anderson further explained that this matter has been presented to
the following organizations: Senior Chamber of Commerce, Junior Chamber of
Commerce, American Legion, Alameda Parent-Teachers' Association, Lincoln-Edison
Dads' Club and two others, all of which have approved the proposed program for
establishing swimming pools in Alameda. He said that each one has appointed a
representative to act on a committee to frame the policy and are now concerned
with submitting a plan.
Mr. Gottstein said he felt a swimming pool in the east end of Alameda iouid be
supported but one in the west end would not go over as those people go for surf
swimming. He thought the taxpayers would not approve of too many tanks.
President Osborn concluded the discussion by pointing out that a definite program
for swimming pools is underway and until that plan is more un-to-date, no
definite action can be taken.
REPORTS OF COFYI_TEES:
5./ From the City Manager, recommending contract be awarded to Taper Tube Pole
Company, the oily bidder, for furnishing 7 Pendant Type Street Lighting Standards
to be used in Street Lighting Assessment District No. 1 (1952) at the bid price
of ,1,066.86 - in accordance with Specifications therefor, No. MS 4-52-5,
Councilman Anderson moved the City Nranager's recommendation be anproved; that
contract be awarded to this firm for furnishing the specified Tighting Standards.
The motion was seconded by Councilman Sweeney and on roll call carried by the
following vote. Ayes: Councilmen Anderson, Sweeney and President Osborn, (3).
Noes: None, Absent: Councilmen Branscheid and Jones, (2).
6. From City Manager, reporting that all work on the construction of a Traffic
Channel at Fernside Boulevard and High Street has been satisfactorily completed
and recommending that it be accepted and the Notice of Completion be ordered
filed.
Councilman Sweeney moved the City Manager's recommendation be adopted; that this
project be accepted and the Notice of Completion be filed, The motion was
seconded by Councilman Anderson and unanimously carried.
7. From City Manager, reporting that all work of painting and decorating the
interior of the Health Center Building has been satisfactorily completed and
recommending that it be accepted and Notice of Completion be ordered filed.
Councilman Sweeney moved the City Manager's recommendation ho adopted; that the
work on this'proiect be accepted and the Notice of Completion be filed. The
motion was seconded by Councilman Anderson and unanimously carried.
INTRODUCTION OF ORDINANCES:
8. Councilman Sweeney introduced the following ordinance, after which it was
laid over under provision of law and the Charter:

10. The following resolution was introduced by Councilman Anderson, who moved
its adontion:

The motion to adopt said resolution was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes : Councilmen Anderson, Sweeney and

Thereupon the President declared said resolution duly adopted and passed.
Councilman Sweeney asked that the City Manager explain this resolution. rr.
Froerer stated that the monies collected from the parkinp: meters are Placed in the
Parking Meter Fund and et intervals are transferred to the General Fund for the
operation and maintenance of the parking meters. Upon Councilman Sweeney's inquiry,
City Manager Froerer answered that this money must be exnended only for narking
meter operations.
11. The following resolution was introduced by Councilman Sweeney, who moved
its adoption:
"Resolution No. 4594
Transferring 22,017.50 from the Alcoholic Beverage
Control Fund to the General Fund."
The motion to adopt said resolution was seconded by Councilman Anderson and on roll
call carried by the following vote. Ayes : Councilmen Anderson, Sweeney and
President Osborn, (3). Noes: None. Absent: Councilmen Branscheid and Jones, (2).
Thereupon the President declared said Resolution duly adopted and passed.,
12. The following resolution was introduced by Councilman Sweeney, who moved
its adoption and requested that it be read in full:

in the Latter of Rates for Water Service in the City
of Alameda, and Related Natters."
The motion to adopt said resolution was seconded by Councilman Anderson and on roll

15. The following resolution was introduced by Councilman Sweeney, who moved
its adoption;

Adopting and Approving the Revised and Amended
"Position Classification Plan" of the Service of
the City to Supersede That Now in Effect;
Providing for Certain Officers, Assistants,
Denuties, Clerks and Employees of the City of
Alameda and -Fixing the Compensation Thereof;
and Repealing Resolution No. 4404 and Amend-
ments Thereto."

14. The following resolution was introduced by Councilman Sweeney, who moved
its adoption.:

In Memoriam to Barney Ralph.
v7ITH DEEP sap-m, the Council of the City of Alameda
records the death of one of its former employees, BARNEY RALPH,
who had faithfully served the City of Alameda for eighteen years
as a Police Officer - and who, having been severely injured in
the line of duty, was retired on a disability pension in 1946,
'N0J, TTEEFOR7, flE IT RESOLVED, that, in recognition of
Er. Ralph's courageous and conscientious effort in the performance
of his duties, and his spirit of cooperation and friendliness with
his associate Officers, the Council of the City of Alameda hereby
expresses its sense of personal loss and its sincere appreciation
for the excellent service so whole-heartedly rendered by this fine
Officer.
'BE IT FURTHER RESOLVED, that this Resolution be spread in
full upon the minutes of this meeting, and that a copy thereof
be transmitted to the family of 17:r. Ralph, that it may extend to
its members a sincere expression of sympathy and condolence; and
'BE 17 FURTNER RESOLVED, that when this meeting of the
Council of the City of Alameda adjourns, it shall do so in
respect to the memory of BARNEY RALPH, retired."

Councilman Sweeney moved the bills as itemized in the List of Claims filed with the
City Clerk on Nay 20, 1952, and submitted to the Council at this tire, be allowed
and paid. The motion was seconded by Councilman Anderson and on roll call carried
by the following vote. Ayes: Councilmen Anderson, Sweeney and President Osborn,
(3). Noes: None. Absent: Councilme-1 i3ranscheid and Jones, (2).
30. At this time, Councilman Sweeney noted the presence of Mr. Bill McCall and pointed
out that he had been responsible for brin7ing the State Fish and Game Commission
to the City of Alameda for its meeting. He complimented Mr. N'Call for the
successful meeting and for his interest in arranging to have it in Alameda.
Mr. McCall remarked that the Commission had said Alameda was a very fine place
in which to hold its meeting - the attendance had been the largest of any meeting
for sometime, and it would like to be invited back anain in the future.
President Osborn stated he thought it was a compliment to the City that the Fish
nnid -Tame Commission had held its meeting here and said the Council is indebted to
1:;r. NcCall for his efforts in making necessary arrangements.
31. President Osborn announced that the next regular meeting of the Council will
be held on Wednesday, June 4, due to the fact that the State Primary Election will
be Tuesday, June 3, a legal holiday.
ADJOURNPENT:
32. There being no further business to come before the meetin,7, the Council
adjourned in respect to the memory of BARNEY RALPH, retired Police Officer -
to assemble in re7ular session on Prednesday, June 4, 1952, at 3:00 o'clock.
