1952-09-16 Regular CC Minutes269 REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, SEPTEMBER 16, 1952 The meeting convened at 8:00 olclock P. M. with President Osborn presiding. ROLL CALL: The roll was called and Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4)1 were noted present. Absent: Councilman Jones, (1). MINUTES: 1. The minutes of the regular meeting held September 2, 1952, were approved as transcribed, WRITTEN COMMUNICATIONS: 2. From Middleton, Suman & Hackleman, submitting further explanation of their position with regard to their auditing services. President Osborn ordered the communication filed. ORAL COMMUNICATIONS: 3. Mr. William McCall addressed the Council with the request that the City Manager look into the possibility of preserving the approaches and those portions of the old Bay Farm Island Bridge which would not interfere with navigation in order that they could be used for fishing piers or docks for small boats. He stated there are several groups interested in developing this matter - the Marina Yacht Club, for one. President Osborn stated he had recently noticed a number of children fishing along this point and they seemed to be very enthusiastic. He also remarked that he would like to compliment Mr. McCall on his interest and enthusiasm in this matter. He inquired if the City Manager had any comments. Mr. Froerer stated it would be necessary for him to investigate the situation because, so far as he knows, the plans are to entirely remove the old structure. 4./ Mr. Emil Kudrna, representing the Retail Trades Committee of the Alameda Chamber of Commerce, stated that on behalf of this Committee he wanted to ask if it is possible to revise the ordinance so that requests to use the electroliers for advertising posters or placards could be submitted to the City Manager for his approval or disapproval. He stated that when the trades have "special" days, such as "Dollar" Day or for Christmas shopping, they would like to use this means of advertising. Upon inquiry, the City Attorney stated that, at present, permission must be obtained from the Public Utilities Board before the poles can be used for such purposes - and that is only for those poles belonging to the City. The City Manager stated he thought advertising of any kind is prohibited on any poles. President Osborn stated it would be well for the City Manager and City Attorney to make a full investigation and report before any decision is made. President Csborn stated he recalled that about a year ago permission had been granted to the merchants along Park and Webster Streets to use certain staffs for flags and pennants. Mr. Kudrna remarked that this system had not worked out satisfactorily and he felt the use of the electroliers would be more advantageous. Mr. Froerer asked Ir. Kudrna if he meant just the City electroliers and Mr. Kudrna answered in the affirmative. Councilman Anderson asked the City Attorney if it would be legal to make something of this kind possible for a certain number of times during the year. Mr. Clark replied that if it were made available to one, it would have to be for all and it could not be restricted. :President Osborn asked Mr. Clark to investigate this phase of the matter. REPORTS OF COMMITTEES: 5. %/From the City Manager, recommending contract be awarded to Gallagher and Burk, Inc., for the project of Santa Clara Avenue Resurfacing and Culvert Construction, at their low-bid price of $78,524.55. Councilman Anderson moved the City Manager's recommendation be adopted; that contract be awarded to the designated firm for this project at the price quoted and the bid bond be returned to the unsuccessful bidder. The motion was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None. Absent; Councilman Jones, (1). 6. ./From the City Manager, requesting that William W. Ward, Jr., Welfare co- ordinator of Civil Defense, be authorized to attend the Welfare Conference, sponsored by the Federal Civil Defense Administration School, to be held at St. Mary's College on October 0, 9, and 10, 1952 - and ',325. be appropriated for this purpose. Councilman Sweeney moved the City Manager's request be granted; that Mr. Ward be authorized to attend the specified conference for the period indicated and 025. be appropriated for his expenses. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None. Absent: Councilman Jones, (1). 7. /From the City Manager, recommending that Neil Clark, Administrative Assistant, be permitted to attend the course in Human Relations, held by the Industrial Section East Bay Chapter National Safety Council, at the Old Hearst Ranch in Pleasanton on September 24, 1952, and :fl,>15.00 be appropriated for this purpose. Councilman Branscheid moved the City Manager's recommendation be adopted; that Mr. Neil Clark be permitted to attend this course and 15. be appropriated for his expenses. The motion was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and Presi- dent Osborn, (4). Noes: None. Absent: Councilman Jones, (1). 8. From the City Manager, recommending that the following members of the Engineering Department be permitted to attend certain courses offered by the University of California Extension Division, to be held in the evenings:""Design of Small Buildings for Lateral Forces" to be attended by Mark J. Hanna, Chief Design Engineer, Russell Reed, Assistant Civil Engineer and John H. Wright, Junior Civil Engineer - "Land Surveying" to be attended by George Henschel, Survey Party Chief. It was pointed out that the tuition fees for these courses are 09.00 and ;18.00, respectively, per person and therefore, recommended that c'45. be appro- priated for t his purpose and also that permission be granted to use a City auto- mobile for their transportation. Councilman Anderson moved the City Manager's recommendations be approved; that these employees be authorized to take these courses, 045. be appropriated for their expenses and they be allowed to use a City car for transportation. The motion was seconded by Councilman Sweeney and on roll call carried by the follow- ing vote. Ayes: Councilmen Anderson, Branscheid Sweeney and President Osborn, (4). Noes: None. Absent: Councilman Jones, (1). Councilman Anderson stated he thought it was very commendable of these men to want to spend their own time in the evenings taking these courses and any organi- zation which has that type of employee is very fortunate. UNFINISHED BUSINESS: 9.1 The matter was called up concerning the consideration of the proposals for auditing services, submitted by Goodell, Byers & Co. and Middleton, Suman Hackleman. President Osborn stated this matter will be carried over to a subsequent meeting. Councilman Branscheid stated the Council had before it a report from Middleton, Suman & Hackleman, for the fiscal year ended June 30, 1952, which was signed only with the firm name and he asked if that type of signature is sufficient and could it be considered legal. Mr. Suman was present and stated this type of signature is a peculiarity of certified public accountants and is used by all such firms which he knows about. City Attorney Clark stated he thought the firm who formerly performed this service always signed its reports with the firm name and by a member thereof. He asked Mr. Suman if he would have any objection to signing the report submitted by his firm and he answered, "None whatever". Mr. Clark stated he would have Mr. Hackleman sign the report tomorrow. Upon Councilman Anderson's inquiry, President Osborn clarified the situation as to when this matter would come up again - stating it would be under the heading of "Unfinished Business" at the next meeting. 271 RESOLUTIONS: 10 The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 4660 Adopting Specifications for Furnishing to the City of Alameda One (1) New, Latest Model 4-Door, 8- ( Cylinder Sedan with Radio and Heater, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 11. The following resolution was introduced by Councilman Anderson, who moved its adoption: "Resolution No. 4661 Abolishing Certain Positions of Employment in the City Attorney's Office, City Manager's Office, Park Department and Recreation Department." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 12. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 4662 Amending Portions of Section 8(a) and Section 12 of Resolution No. 4596, Relating to Salary Schedule and Schedule of Positions, Creating Certain New Positions of Employment and Establishing Their Salary Range and Step, and Adding Salary Range Numbers 44a, 47a, 71a, 74 and 75." The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None, Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 13. The following resolution was introduced by Councilman Anderson, who moved its adoption: "Resolution No. 4663 Appointing an Acting City Manager in the Absence of the City Manager." (J. P. Clark) The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilman Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. FILING: 14. Financial Statement - Middleton, Suman & Hackleman - Bureau of Electricity, for month of July, 1952. 15. Specifications - No. MS 9-52-13 - For furnishing 4-Door Sedan for City Manager. BILLS: 16. An itemized List of Claims against the City of Alameda and the several depart- ments thereof, in the total amounts as follows, was submitted to the Council at this meeting: General Departments, ,,%,495.33; Civil Defense Department, ',1,141.29 Police Department, 4,1,249.55; Fire Department; ;,927.31; Street Department, G21657.88; Health Department, 029.33; First Aid. Councilman Sweeney moved the bills as itemized in the List of Claims filed with the City Clerk on September 16, 1952, and presented to the Council at this time, be allowed and paid. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Sweeney and President Osborn, (4). Noes: None. Absent: Councilman Jones, (1). 17. At this point, President Osborn again inquired if there was anybody who desired to address the Council. Mr. Frank Gottstein responded by requesting that an investigation be made of the situation in the two blocks on Webster Street, from Buena Vista Avenue to the segregation line, stating that parking meters should be installed there. He also suggested that a police officer should be stationed at Webster Street and Atlantic Avenue while the barricade is there. President Osborn stated Mr. Gottstein's suggestion is worth investigating and he asked the City Manager with regard to the feasibility of installing parking meters along this point. Upon Councilman Anderson's inquiry, City Manager Froerer stated the City had tried the matter of having no parking from 4:00 to 6:00 o'clock P. M. on both sides of Webster Street, from Buena Vista Avenue northerly and also that of preventing left-hand turns into Atlantic Avenue during those hours. He stated it had not been a fair trial as long as there was the obstruction at Atlantic Avenue and Webster Street. He said the City proposes to again give this system a further trial as to its efficacy. He stated, however, that in the matter of parking meters, they would also function during the other hours of the day and he would investigate this situation. ADJOURNMENT: 18.
