HELD TUESDAY EVENING, JULY 3, 1951
The meeting convened at 8 :00 o'clock P. M. with President Osborn presiding.
ROLL CALL:
The roll was called and Councilmen Anderson, Branscheid, Jones, Sweeney and
President Osborn, (5), were noted present. Absent: None.
MINUTES:
1. The minutes of the regular meeting held June 19, 1951, and the adjourned
regular meeting held June 27, 1951, were approved as transcribed.
WRITTEN COMMUNICATIONS:
2( From Alameda Lodge No. 509, Loyal Order of Moose, applying for a permit to
sponsor the Kraft Shows, to be held July 24, to 29, 1951.
President Osborn outlined in detail the situation with which the Council was con-
fronted a few weeks ago, when the Veterans of Foreign Wars Post in Alameda made a
request for a permit to sponsor the West Coast.,Shaws at a time immediately preced-
the date for which the American Legion Post of Alameda had previously been granted
a permit to sponsor the,Foley & Burk Shows.
He pointed out that in that case by reason of the conflict in dates, it was decided
to deny the Veterans of Foreign Wars a permit, with the request that the organiza-
tion apply for a permit for a later time in the season. He stated, further, that
in line with this suggestion, the Veterans of Foreign Wars had made application for
a later date and had been granted a permit to sponsor a show during the early part
of September.
He indicated that the present application from the Loyal Order of Moose was for a
period immediately preceding the time for which the_Veterans of Foreign Wars had
been granted the permit mentioned. He expressed the opinion that it would not be
fair to the Veterans' organization to grant the permit requested in this instance.
Councilman Jones stated that he was in accord with President Osborn's thinking on
this subject and suggested it might be appropriate for the various organizations
that contemplate sponsoring shows to get their applications before the Council in
the early part of the calendar year and thus permit the Council opportunity to
allocate the time with fairness to all concerned. He stated that, with full recog-
nition of the merit of the desires of the Loyal Order of Moose in this matter, it
seemed to him the Council could not, in fairness, reverse the policy already es-
tablished in its relations with the Veterans of Foreign Wars. He stated he felt
the Moose should have the opportunity, together with any,_other organization, to
sponsor a show in Alameda, but not at the expense of any commitments that have
already been made.
At Councilman Jones' invitation, through the President, a representative of the
Veterans of Foreign Wars addressed the Council and stated that the granting of the
permit requested by the Loyal Order of Moose would conflict seriously with the
time allocated to his organization and directed the attention of the Council to
the arrangements which the Veterans of Foreign Wars was forced to make under like
circumstances when its contemplated date was conflicting with that granted to the
American Legion.
Councilman Jones suggested that Mr. E. U. Priddy, Secretary of the Moose Lodge,
might like to speak on the question. Mr. Priddy stated that his organization had
no desire or intention to conflict with dates granted any other organization, point-
ing out that he did not know any other application for a permit of this character
was on file and that, in view of the conflict in time, he would be happy to with -
draw his request and submit it at some future date.
President Osborn stated that, in view of this statement by Mr. Priddy, the request
would be considered as having been withdrawn.
Councilman Branscheid suggested the Council extend its thanks to Mr. Priddy and the
Loyal Order of Moose for taking this very fair attitude in the matte

ORAL COMMUNICATIONS:
4. Mr. Frank Gottstein addressed the Council on the matter of the Second Tube
under,the,Estuary, deploring the failure of the State Legislature to enact legis-
lation which would have provided this facility. He suggested that, since all
other efforts had failed, the course to be pursued would be to sue the State for
its failure to construct a Second Tube as provided in the Hoover -Young Bridge
Report.
President Osborn pointed out to Mr. Gottstein that there is now a plan under which
it will be unnecessary to have legislation to refinance the Bridge. This plan is
being considered by the Toll Bridge Authority and the only permission necessary to
be obtained is from the Federal Government. He stated that if such permission can
be obtained it is highly _probable that the plan will be followed through and the
funds will be forthcoming for a Second Tube. He stated the Council has great
hopes that this plan will be consummated and indicated that the Toll Bridge Au-
thority recognizes it cannot afford to let the present Bridge go, toll, free.
In response to a request by President Osborn, City Manager Froerer outlined the
plan mentioned by President Osborn, stating that the Bay Area Council has had
several meetings on this matter and there is a definite attempt being made to
reconcile the differences between the west and east sides of the Bay on the Bridge
proposal and it looks as though it will come about. He stated that if it can be
accomplished, he is reasonably certain that the Toll Bridge Authority will under-
take the refinancing of the present Bridge, out of which financing will come a
Second Tube for Alameda.
President Osborn expressed the belief that under these conditions, it would not
be wise for the City to start a suit, stating that until such time as the City
finds it is without any other recourse, it would be best to go along with the
State Authority.
Councilman Anderson pointed out that Mr. Gottstein had proposed this matter of
suing the State some time back and that, following such proposal, he had person-
ally discussed the subject with the City Attorney and had been assured by him that
the facts in the case are not as stated by Mr. Gottstein.
He stated that the difference of opinion as to what the facts in the matter are,
arises from the situation that, while the Tube and the money with which to build
it, was provided for at one time in proposed legislation - when the final legisla-
tion was enacted, these provisions had been deleted. He indicated that, in view
of the responsibility of undertaking such a suit and the cost of prosecuting same,
he, as a member of the Council, would not give this suggestion favorable considera-
tion.
Mr. Gottstein brought the discussion to a close by stating that, in his opinion,
the matter of a Second Tube had been kicked around so long and by so many different
people, that he felt it.would be wise to drop the matter of a Second Tube and bend
every effort for the construction of another Bridge across the_Estuary.
REPORTS OF COMMITTEES:
5: From Adolph Camisa, expressing his regret that he cannot accept the appoint-
ment to the office of member of the Social Service Board for a term beginning
July 1, 1951.
President Osborn stated he had received this letter with real regret as he had felt
Mr. Camisa would make a very good member of the Social Service Board and would have
taken great interest in the work.
Councilman Jones moved the resignation of Mr. Camisa be accepted. The motion was
seconded by.Councilman Sweeney and unanimously carried.
6. From the Department of Public Utilities, requesting that the Alameda Municipal
Electrical Code be amended as set forth in Resolution No. 1188, adopted by the
Public Utilities Board.
Councilman Jones moved this matter be referred to the City Attorney for the prepara-
tion of the.requested ordinances. The motion was seconded by Councilman Branscheid
and unanimously carried.
7. From City Manager, stating that Manuel Enos, contractor for the construction
of storm sewer laterals on Fillmore Street, has requested a sixty -day extension of
time for the completion of his contract and recommending that such be allowed.
Councilman Anderson moved the City Manager's recommendation be adopted and the con-
tractor be granted a sixty -day extension of time in which to complete the work on
this project. The motion was seconded by Councilman Sweeney and unanimously
carried.
RESOLUTIONS:
8. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
Therefore, Mr. Froerer recommended the contract for this project be awarded to
McGuire and Hester, the low bidder, at the price of $8,732.
Councilman Branscheid moved the City Manager's recommendation be followed; that
contract be awarded to the designated firm and the bid checks be returned to the
unsuccessful bidders. The motion was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Jones,
Sweeney and President Osborn, (5) . Noes: None. Absent: None. _

18. An itemized List of Claims against the City of Alameda and several of the
Departments thereof, in the total amounts as follows, was presented to the Council
at this meeting: General Departments, 0400.25; Engineering Department Deposit
Fund, $20.; Gas Tax No. 2Fund, $16,967.20; Civil Defense Department, $35.91;
Councilman Sweeney moved the bills as itemized in the List of Claims filed with
the City Clerk on July 3, 1951, and submitted to the Council at this time, be
allowed and paid. The motion was seconded by Councilman Anderson and on roll
call carried by the following vote. Ayes: Councilmen Anderson, Branscheid,
Jones, Sweeney and President Osborn, (5). Noes: None. Absent: None.
ADJOURNMENT:
19. There being no further business to come before the meeting, the Council
adjourned - to assemble in regular session on Tuesday evening, July 17, 1951,
at 8 :00 o'clock.
