E. with President Dranscheid presiding. ROLL CALL: The roll was called. and Councilmen Anderson, Osborn, Sweeney and President Branscheld (4), were noted present. Absent: Councilman Jones, (1). MINUTES: 1. The minutes of the regular meeting held April 4, 1050, were approved as transcribed. WRITTEN COMMJNICATIONS: 2. From the Department of Education StPto of California transmitting certifi- cates of completion of the Teacher Training Course by inspector Robert .1). Allen and Sergeant Joseph E. Bertrand of the Pollee Department. Following the reading of this communication, President Branscheld presented the certificates to Inspector Allen and Sergeant Bertrand. - stating that he was very 71ad to have the report of their completion of this course and he felt It was „). another step in. the direction. of encouraging all departments to keep abreast of the latest developments in their respective fields. He congratulated the offi- cers upon the completion. of the course and assured them. the City was very happy to have accorded them the opportunity for this training. On, behalf of himself and inspector Allen, Sergeant Bertrand thanked the Council for allowing them permission. to attend the school. From the Kev System. Transit Lines, setting forth the increased local rates requested in. Its application. to the State Bablic Utilities Commission. Councilman. Sweeney moved the City Manager be requested to Inform the Key Systeni . that this Council is definitely on record as protesting any fare increase until it can be shown that it is justified. The motion was seconded by Councilman Osborn. Speaking on the question, President Dranscheid observed that this was an opportune time for the Council to take this position Inasmuch as it has gone along with.. the increases requested by the Key System because of the Company's increased cost of operation. He pointed out that up to the present time, several rate increases have been granted, but stated that the situation has now reached the point where the cost of transportation, If permitted to advance, might become a detriment to the City of Alameda. He stated it was his feeling that until such time as this increase can be justified, the Council should go on record as opposing it Upon call for the question, the motion was unanimously carried. 41 From the Alameda Citizens Transportation Association, notifying the Council of its filing of a protest with the Public Utilities Commission concerning the Key Systerrt's application for an increase in local fares. The communication was ordered filed. From West Alameda Association, regling a complaint concerning the exces- sive speeding on the more important streets in the west end of the Citv creating a hazardous condition. This matter was referred to the City Manager for his study and report. 6. From Y. E. Lee, requesting division of diagram and assessment No. CO into 22 parcels, pursuant to Section 27, Refunding Assessment Bond Act of 1035, as referred to by Section 19-641 of the Alameda Eunicipal Code. This covers Yr. Lee's property lying north of Maintiand Drive on Bay Farm Island. Councilman Osborn stated that in. view of the fact that this division of 31r. Lee's assessment will help him. In the development of his property, he would move the request be granted. The motion was seconded by Councilman Anderson and on roll call carried by the fol- lowing vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Dranscheid, (4). Nees: None. Absent: •councilman Jones, (1 ). • HEARINGS: 7. An appeal was presented by krs. E. R. Stewart from the decision of the City Planning Board. In refusing to rezone portions of the west side of Union Street. From the City:Planning Board, notifying the Council of the adverse action by the Board on its lesolution of Intention to rezone a portion of the west side of Union Street, south from on Antonio Avenue, from the "A" One-Family Dwelling District to the "C" Multiple Dwelling District - and recommending that the property de- scribed not be reclassified. Following the reading of this report on the matter of rezoning a portion of Union Street, which is the subject of this hearing, Mrs. Stewart addressed the Council, stating she felt she was not accorded a fair hearing before the Planning Board inasmuch as two blocks on Union Street were posted that should not have been in cluded. She pointed out she had asked for the rezoning of only one block between Dayton and Clinton Avenues and had been advised that was all she needed. She stated also that she was advised that since the bullding is so far removed from the people on Palmera Court they couid not be affected in any way. President Branscheid called for remarks from. any persons opposing the request, and there was no resnorise. The President troupon stated that in matters of this kind, the Council should have an opportunity for further study, and suggested it be continued to the next meeting. Councilman Anderson made a motion to this effect. Councilman Sweeney seconded the motion and stated he would like to take a look at the property and see what the situation is. Councilman Osborn stated he would like to ask Mrs. Stewart :f she is interested in the area south from San Antonio Avenue, or that just from Clinton Avenue to the Bay. Mrs. Stewart replied that she is interested only in the most southerly block. Councilman Anderson inquired if Mrs. Stewart was the owner of the property. She answered that she was not and was merely interested in purchasing t. The question was called for and the motion to continue the matter was unanimously carried. OPENING BIDS: • v,-- E3 Bids were presented and read for the project of the reconstruction of San Jose Avenue from. Chestnut Street to High Street, in accordance with Specifications, Special Provisions and Plans, therefor, No. 17 2-50-14, as follows: From Gallagher & Burk, Inc. - - 147,072.30 Accompanied by certified check in amount of - 15,000.00 Prom Indenendent Construction Co. 151,237.75 Accompanied by certified check in amount of - - 16,000.00 Q•• Bids were submitted and read for the furnishing of Parking Meters for the re- mainder of the fiscal year ending June 30, 1550, in accordance with Specifications therefor, No. MS 4-50-7, as follows: From Duncan Meter Corporation 70.74 each Accompanied by certified check in amount of - .500.00 From The Michaels Art Bronze Co. REPORTS OF COMMITTEES: 11/ From the City Manager, recommending that Health Cfficer David Frost be autho- rized to attend the meeting of the California. Conference of Local Health Officers. at San Diego, from May 1, to 3, 1950, and .150. be appropriated for this purpose. Councilman Osborn moved the City Manager's recommendation be approved: that Dr. Frost attend the specified meeting and the sum ef !150. be allowed. for his e3rn,Donses. The notion was seconded by Councilman Sweeney and on roll call carried by the fol- lowing vote. Ayes : Councilmen Anderson, Osborn, Sweeney and President Branscheld, (4). Noes: None. Absent: Councilman Jones, (1). 12. From the City Manager, recommending that contract be awarded to Cochran and Celli for furnishing one new 1950, 3/4-Ton Walk-In Typo Van fax the street painting crew of the Police Department, at the total net price of 331.48. 375 Councilman Sweeney stated that in view or the conditions outlined in Er. 7roerer's letter, he would move the recommendation be adopted and contract awarded to the designated firm for furnishing the Van and that the check be returned to the un- successful bidder. The motion was seconded by Councilman Anderson and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, Noes: None. Absent: Councilman Jones, (1). 13 From the City Planning Board, recommending the reclassification of that cer- tain portion of the south side of Lincoln Avenue, between Third and Fourth Streets, being more specifically described in the Board's Resolution of Intention - from the "A" One-Family Dwelling District to the "A-1" One-Family Dwelling District. The matter was referred to "Introduction of Ordinances." 14. From J. :,-,cLaverty, Jr., tendering his resignation from the office of Commis- sioner of the Housing Authority of Alameda. Councilman Osborn stated that, with great regret, he would move the acceptance of Er. EcLavertyls resignation and remarked that it would be well to instruct the City Clerk to write a letter to 1:r. EcLaverty, expressing the City's appreciation of services rendered. The motion was seconded by Councilman Anderson and unanimously carried. President Branscheid observed that Mr. 7:cLaverty has served a long time on the Housing Authority and the Commission, during his tenure of office, has done a very worthwhile job. He stated Er. EcLaverty was to be congratulated, together with other members of the Housing Authority, upon the fine service and the City was very sorry to lose him. The question was called and the motion was unanimously carried. 15. From the City Attorney's Office, informing the Council that the full amount of a judgment has been paid in the suit of the City vs . John L. Daum, et al, for tangible personal property taxes in the sum of 139.32, plus costs of 2.50 - and requesting authority to file a satisfaction of judgment to close the case. Councilman Osborn moved the City Attorney's office be authorized to proceed as outlined. The motion was seconded by Councilman Sweeney and unanimously carried. 16:7- From City Attorney Whitney, concerning certain condemnation proceedings against Zilltam Paul and Nellie Laura 'aton, relative to the acquisition of their property for Liarshall Way. He requested authority of the Council to offer the sum of fl,5,100. to Er. and Lrs. Eaton in settlement of their claims. Councilman Anderson moved the City Attorney's request be granted, and he be autho- rized to proceed with this litigation. The motion was seconded by Councilman Sweeney and unanimously carried. INTRCDUCTIC7 OF ORDINANCES: 17• Councilman Anderson introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Addinj Section 56 to Ordinance No. 725, New Series. vrINISHED BUSINESS: 18.V Again presented was the matter of the City :'anager's recommendation to award contract to Garland Chevrolet Co., the sole bidder, for furnishing a 1950 Two-Door Sedan for the Purchasing Department. Hr. Froerer also requested authority to dis- pose of two vehicles, without replacement - 1240 Ford Sedan, T',nsineerng Depart- ment and a 1933 1/2-Ton Chevrolet Delivery Truck, Police Department. He explained that it is pro,posed to establish a motor pool of all vehicles needed by departments located in the City Hall - with the exception of the Fire, Police and 7,uilding cars Councilman Osborn stated that in view of the fact that Mr. Froerer has assured the Council there will be an economy effected through the handling of cars as outlined in his communication, he would move the recommendation be followed. The motion was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Dranscheid, (4). Noes: None. Absent: Councilman Jones, (1). RESOLUTIONS: 19. The following resolution was introduced by Councilman Anderson, who moved its adoption.: "Resolution No. 4152 Cancelling City Taxes on Property Acquired by the City of Alameda for Municipal Purposes." (Marshall Way) The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following veto. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheld, (4) . Noes: Nene, Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 4153 Requesting Cancellation of County Taxes on Property Acquired . by the City of Alameda for Municipal Purposes.' (Marshall Way) The motion, to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the followin7 vote. Ayes: Councilmen Andersen, Osborn, Sweeney and President pranscheid, (4). Noes: None, Absent: Councilman Jones 1) , • 0 Thereupon the President declared said resolution duly adopted and passed. 21. "Resolution No. Authorizing the Execution of Memorandum. of Agreement With the State of California for Expenditure of Gas Tax Allocation for Major City Streets for the Fiscal Year 1950-1951." Councilman Osborn moved this resolution be held. over until the next meeting of the Council. The motion was seconded by Councilman Sweeney and unanimously carried. 22. The following resolution. was introduced by Councilman. Prior to adjournment, President Branscheid stated his attention had been called by Councilman Osborn to the fact that there had been some greyhounds turned loose en Bay Farm Island and permitted to hunl, the wi]d rabbits in that area. T10 stated the situation has becoLlle very bad, inasruch as the dogs have chased the rabbits onto the Golf Course and have provided some very unpleasant and inhumane spectacles for the people on the Course. He stated he had asked for the preparation of an ordinance prohibiting the train- ing of the hounds on Bay Farm Island. Councilman Osborn stated he had witnessed a most inhumane event last Saturday when three hounds cornered a rabbit on the Golf Course and ,'it on a very tough show before a large group of people watching a golf exhibition. ADJOURNMENT: 27. There being no further business to come before the rieetiog, the Council adjourned, to assemble in regular session on Tuesday evening, Bay 2, 1950, at 6:00 o'clock.
