1948-06-02 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF TEE CITY OF ALAMEDA HELD WEDNESDAY EVENING, JUNE 2, 1948 The meeting convened at 8:00 P. M. with President Branscheid presiding. ROLL CALL: The roll was called and Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4), were noted present. Absent: Councilman Jones, (1). MINUTES: 1. The minutes of the regular meeting held May 18, 1948, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. From George J. Zuras, 1702 Lincoln Avenue, requesting a refund of 17.20, paid for his personal property taxes, on which his veteran's exemption had been allowed. President Branscheid observed that this request is similar in nature to several pre- viously received and disposed of by the Council. He requested City Attorney Whitney to givethe Council a ruling in this instance. Mr. Whitney stated that, in his opinion, the refund could not be granted inasmuch as the payment was voluntarily made. He stated further that this same ruling would apply to the second written communication on the agenda this evening. Thereupon, Councilman Osborn moved that, in accordance with the City Attorney's rul- ing, the request be rejected. The motion was seconded by Councilman Sweeney and carried. 3. From Joe Thomson, 1543A Webster Street, requesting a refund of 02.58, paid for his personal property taxes, on which his claim for veteran's exemption was subse- quently filed. In the light of the City Attorney's ruling on the first written communication, Coun- cilman Anderson moved this request be denied. The motion was seconded by Councilman Osborn and unanimously carried. President Branscheid requested the clerk to notify the applicants for these refunds of the City Attorney's ruling in the matter. 4.. From the Tax Collector of Alameda County, requesting the written consent of the City of Alameda to an auction sale of certain tax-deeded properties situated in this City. The matter was referred to "Resolutions." OPENING CF BIDS: 5:` Bids were received and read for the furnishing of Non Premium and Ethyl Gasoline to the City during the fiscal year beginning July 1, 1948, in accordance with Speci- fications and Provisions No. MS 5-48-8, as follows: .184 per gal. One bid was submitted and read from Heafey-Moore Co. for furnishing Quarry Waste and Earth Fill at City Dump, in accordance with Specifications and Provisions therefor, No. MS 5-48-9. The bid was accompanied by a certified check in the sum of 0500. In connection with these Specifications, a call was also made for furnish- ing Top Soil, but no bid was received on this item. 95 The bid was referred to the City Manager and City Engineer for study and report. 7. One bid was presented and read from Heafey-Moore Co. for furnishing Crusher Run Base during the fiscal year 1948-49, in accordance with Specifications and Provisions No. MS 5-48-10. The bid was accompanied by a certified check in the amount of 225. The bid was referred to the City Manager and City Engineer for study and recom- mendation. 8Y One bid each was presented and read for the furnishing of Plant-mixed Surfac- ing Paving Mixtures and Penetration Type Asphaltic Emulsion during the fiscal year 1948-49, in accordance with Specifications and Provisions No. MS 5-48-11, as follows: From Heafey-Moore Co. (Paving Mixtures) Accompanied by certified check in amount of - 4.15 per ton $500.00 From American Bitumuls Company (Asphaltic Emulsion) 16.605 " Accompanied by certified check in amount of - - 66.42 The bids were referred to the City Manager and City Engineer for study and report. 9‘.' No bids were received on the call for the furnishing of Portland Cement Concrete Mix during the fiscal year 1948-49, in accordance with Specifications and Provisions No, MS5-48-12. 10' No bids were received on the call for the project of repairing Portland Ce- ment Concrete Sidewalk, Curb and Gutter during the fiscal year 1948-49, in accord- ance with Specifications and Provisions No. PW 5-48-3. 11. One bid was presented and read from Gallagher & Burk, Inc., for the project of constructing culverts during the fiscal year 1948-49, in accordance with Speci- fications, Special Provisions and Plans, No. PV 5-48-4. The bid was accompanied by a certified check in the amount of $2,000. The bid was referred to the City Manager and City Engineer for study and report. 12: Bids were submitted and read for the project of the resurfacing and repair of asphalt and bituminous pavement during the fiscal year 1948-49, in accordance with Specifications and Provisions therefor, No. PW 5-48-5, as follows: From Ransome Company Accompanied by certified check in amount of - - - 02,675. From Heafey-Moore Co. Accompanied by certified check in amount of - - - 2,700. The bids were referred to the City Manager and City Engineer for study and recom- mendation. 13; One bid from McGuire and Hester was presented and read for the project of constructing and installing an Interceptor Sewer System and Force Main on Bay Farm Island, in accordance with Specifications, Special Provisions and Plans No. PW 5-48-6. The bid was accompanied by a certified check in the amount of 20,000. The bid was referred to the City Manager and City Engineer for study and recom- mendation. REPORTS OF COMMITTEES: 14. From the City Manager, recommending that contract be awarded to J. Henry Harris, for the project of the improvement and reconstruction of Longfellow Park, in accordance with Alternate "B" of the Specifications, at his bid price of 22,965.10. Councilman Sweeney moved the City ManagerTs recommendation be approved; that con- tract be awarded to J. Henry Harris for the specified project and the bid check be returned to the unsuccessful bidder. The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent; Councilman Jones, (1). 15. From the Mayor, City Manager and Auditor, reporting on the Count of Money, held May 19, 1948, showing there was 02,492,675.07 in the City Treasury. The report was ordered filed. INTRODUCTION OF ORDINANCES: 16. Councilman Sweeney introduced the following ordinance, after which it was laid over under provisions of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Repealing Subdivision (19) of Section 17-342 and Adding a New Subdivision (19) Thereto, Relating to Two-Hour Parking." 17. "Ordinance Yo. New Series An Ordinance Amending Section 15-6210, Article 2, Chapter 6, Title 15, of the Alameda Municipal Code, Relating to Rates for Garbage Collections." Councilman Anderson moved this matter be tabled until the next meeting of the Coun- cil in order that further information on this subject might be obtained. The motion was seconded by Councilman Sweeney and unanimously carried. RESOLUTIONS: 18. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3724 Transferring 7,156.71 from Webster Street Storm Sewer Fund to the General Fund." The motion to adopt said resolution was seconded by Councilman Anderson and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 19. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3725 Fixing Time of Payment of Salaries and Compensation. The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Anderson, who moved its adoption: "Resolution No. 3726 Requesting Cancellation of Taxes on Property Acquired by the City of Alameda for Municipal Purposes." The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 21. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3727 Consenting to Sale by Tax Collector of Alameda County of Tax Deeded Lands." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 22. The following resolution was introduced by Councilman Csborn, who moved its adoption: "Resolution No. 3728 Creating the Position of 'Administrative Assistant to the City Manager' in the City Manager's Department of the City of Alameda, Prescribing the Duties and Fixing the Salary Thereof." The motion to adopt said resolution was seconded by Councilman Anderson and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. 23. The following resolution was introduced by Councilman Anderson, who moved its adoption: "Resolution No. 3729 Requesting Civil Service Board of the City of Alameda to Except Position from the Civil Service System of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). Thereupon the President declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 24. "Ordinance No. 936, New Series An Ordinance Amending the Alameda Municipal Code by Adding Subdivisions (20) and (21) to Section 17 -342, Relating to Two -Hour Parking." Councilman Osborn moved the ordinance be adopted as read. The motion was seconded by Councilman Anderson and on roll call carried by the following vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). 25. "Ordinance No. 937, New Series An. Ordinance Amending the Alameda Municipal Code by Amending Section 3 -5421 of Article 4, Chapter 5, Title III, Thereof." Councilman Sweeney moved the ordinance be adopted as read. The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Coun- cilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None. Absent: Councilman Jones, (1). FILING 26. Financial Statement - Goodell, Byers Rr Co. - Bureau of Electricity, as of April, 1948. 27. Auditor's Balance Sheet - Month ending May 31, 1948. BILLS; 28. An itemized List of Claims against some of the departments of the City of Alameda, in the total amounts as follows, was presented to the City Council at this meeting;: General Departments, 77.43; Webster Street Storm Sewer Fund, $13,010.75; Bay Farm Island Sewer Fund, $2,581.20. Councilman Osborn moved the bills as itemized in the List of Claims filed with the City Clerk on June 2, 1948, and presented to the Council at this time, be allowed and paid. The motion was seconded by Councilman Sweeney and on roll call carried by the followin vote. Ayes: Councilmen Anderson, Osborn, Sweeney and President Branscheid, (4). Noes: None.
