1947-07-15 Regular CC MinutesREGULAR MEETING OF THE COUNCIL 02 THE CITY OF ALAMEDA HELD TUESDAY EVENING, JULY 15, - - - - - - 1047 The meeting convened at 8:00 P. M. with President Branscheid presiding. ROLL CALL: i . The roll was called and Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held July 1, 1947, were approved as transcribed. WRITTEN COMMUNICATIONS: 2: From Mrs. Kathie Zahn of Albany asking the Council's assistance in correcting the prevailing practice of the State Motor Vehicle Department of permitting new cars to operate on the highways without identifying license plates, using only small windshield stickers which are not adequately lecIble. Following the reading of this communication, Councilman Jones suggesued that it was not within the province of the City Council to take any action. in this matter - but he felt that the proper disposition. of the letter would be to write to the Motor Vehicle Department, enclosing a copy of this letter and endorsing the sentiments expressed therein. Mrs. Zahn addressed the Council, statinN a letter similar to this one had been sent to all City Councils in the East Bay -and. she suggested that the Council forward her communication to the Motor Vehicle Department with the recommendation that the situa tion covered by her letter be corrected. Thereupon President Branscheid stated that the letter would be referred to the City Manager with. the request that he communicate with the Highway Division along the lines suggested. ORAL COMMUNICATIONS: 3. Several old-time residents of the Hotel Alameda, addressed the Council regard- ing the service upon them by the Hotel of eviction. notices, stating that they had been requested to either vacate the premises or pay a rental increased by some three or four hundred per cent. President Branscheid informed these people that the matter has come to the attention of the Council and that it is the Council's feeling that the increase Is exorbitant. He stated that a similar situation was current in all the surrounding communities and that this Council has been watching developments and trying to determine what can be done through the local Governmental agencies. He thereupon called upon. the City Attorney to offer a suggestion as to what he might feel could be done by the City of Alameda in this matter. Mr. Whitney stated that he had been working with the City Attorney of Oakland. on the matter and that Oakland is quite undecided as to just what it is going to do. Hb stated that they were awaiting word. from. Sacramento to see what the State is going to do about the situation. As far as the City of Alameda is concerned, Mr. Whitney stated there was some doubt in his mind as to whether or not the City could pass an ordinance freezing rents, Inasmuch as no emergency exists, - there being only one L. _ hotel in the City and it being very doubtful if a situation arising in one hotel would support an ordinance freezing rents. He also expressed some doubt as to whether or not such an ordinance could take care of evictions. He offered it as his opinion that what will happen in the future will depend almost entirely upon what the State decides to do. He pointed out that Oakland has not seen fit to proceed with such an ordinance and neither has the City of Berkeley - the feeling being in those cities that it _s very doubtful that a local ordinance can be enforced unless a very general emergency exists. Bids were presented and read for the project of reconstru ,,ing Park Street, from Otis Drive to the Tidal Canal, in accordance with Specifications, Special Pro- visions and .Plans therefor, No. P3 5-47-5, as follows: From Heafey-Eoore Co. 213,922.50 Accompanied by certified check in amount of - From Independent Construction Co., Ltd. - - Accompanied by certified check in amount of - 23,000.00 21,125.00 22,500.00 The bids were referred to the City Manager and City Engineer for study and recommendation. 5:/ Bids were presented and read for the project of reconstructing Webster Street, from Santa Clara Avenue to Atlantic Avenue, in accordance with Specifications, Special Provisions and Plans therefor, No. Pv: 5-47-6, as follows: From Lee J. REPONTS OF COUITTEES: 6. From the City Manager, recommending that contract be awarded to Central Cali- fornia Construction Company for the project of constructing the Sewage Pumping Plant on Bay Farm Island. Councilman Jones moved the recommendation of the City Manager be followed on the conditions specified in his report on this award and that the check be returned to the unsuccessful bidder. The motion was seconded by Councilman Anderson and on roll call carried by the following vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheld, (5). Noes: None. Absent: None. 7r/ From the City Uanager, recommending contract be awarded to the Alameda Times- Star for publishing all legal advertising during the fiscal year 1947-1948. Councilman Osborn moved the recommendation of the City Manager be accepted. The motion was seconded by Councilman Sweeney and on roll call carried by the follow- ing vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: Lone. 8:/. From F. J. Croll, Auditor and Assessor, submitting the gross assessment figures of the City for the year 1947, showing the assessed valuation to be .39,744.725., an increase of 5,508,045. over last year. This is the highest gain to have been made in one year. The communication was ordered filed. From Police Chief Doran, submitting his report of the lost, stolen and un- claimed property which has been delivered to the City Treasurcr . The report was ordered filed. 10. Vrom the Cl, Engineer, requesting that a refund of ,21.68 be made to Rubottom, Lambert Lewis because of short delivery on certain second-hand railway equipment purchased by them from the City. Councilman Osborn moved the amount of .21.68 be refunded to this firm as requested. The motion was seconded by Councilman Anderson and on roll call carried by the fol- lowing vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. RESOLUTIONS: 11. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3589 Authorizing Execution of A7reement with State of California Covering Expenditure of the 1/4 Cent Gas Tax Fund for State Highways for Fiscal Year 1947-1048." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheld, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. 12. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3590 Electing to Exercise Option to Purchase Real Property and Directing City Clerk to Give Notice of h Election." The motion to adopt said resolution was seconded by Councilman Anderson and on roll call carried by the following vote. Ayes : Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: ione. Absent: None. Thereupon the President declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 13. "Ordinance No. 925 New Series An Ordinance Authorizing the Acquisition of Certain. Real Property for Public Park ano Other Municipal Purposes." Councilman Jones moved the ordinance be adopted as read. The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Coun- cilmen. Anderson, Jones, Osborn, Sweeney and President Eranscheid, (5) . Noes: None. Absent: None. Mr. McMillan explained that this ordinance covers the acquisition of certain lands for the extension of Krusi Park. FILING: 14. Auditor's Balance Sheet - Month of June, 1947. 15. Memorandum of Agreement - Between State and City for Expenditure of 1/4 Cent Gas Tax Fund for State Highways. S: 16. An itemized List of Claims against the City of Alameda and the several depart- ments thereof in the total amounts as follows, was presented to the Council at this meeting: General Departments, '5,523.10; Police Department, 829.45; , Civil. Councilman Jones moved the bills as itemized in the List of Claims filed with the City Clerk on July 15, 1047, and presented to the Council at this time, be allowed and paid.
