1947-08-19 Regular CC MinutesREGULAR MEETING OF THE COUNC HELD TUESDAY EVENING AUGUST L OF THE CITY OF ALAMEDA 19 - - - 1947 The meeting convened at 8 :00 P. M. with President Branscheid presiding. ROLL CALL: The roll was called and Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5), were noted present. Absent: None. MINUTES 1. The minutes of the regular meeting held August 5, 1947, were approved as transcribed. HEARINGS: 2. The matter was presented concerning the appeal of Harry N. Jessen from the ruling of the City Planning Board, denying his petition for a Use Permit to conduct a real estate business in his dwelling at 1379 Pearl Street, which is in the "A -1" One - Family Dwelling District. -- Mr. Jessen was represented by counsel, who stated that Mr. Jessen has now been in the employment of the Government for some twenty -three years and plans to retire in about three years, at which time he will go actively into the real estate busi- ness. At the present time, it will be only a side line with him. He stated that the only purpose in filing the application was to enable Mr. Jessen to display a sign as required by the Real Estate Act. He pointed out that the sign in this case would be so placed on the residence that it would not be visible from the street - that nobody would be able to see the sign unless he came up on the side porch of the dwelling. Counsel cited the fact that there are other signs in the neighborhood - one being displayed by a Mr. Jasmann, Real :Estate Broker, and another by a "curtain laundry." He stated that Mr. Jessen was willing to have the permit provide that when he re- tires from his present Government position and goes into the real estate business actively, he will not carry on his business from these premises but will move into a regular place of business. Appearing for the protestants was Miss Almena Banta, 1375 Pearl Street, who stated that if the Council were going to allow people to go into business in that district, it would depreciate property values. She stated that many people had recently moved into the neighborhood, purchasing their homes at inflated prices and with the dis- tinct understanding that it would continue to be a strictly residential district. She pointed out that the other signs mentioned by Counsel for Mr. Jessen were there because they had been placed prior to the effective date of the Zoning Ordinance. Councilman Jones inquired as to whether or not the protestants were aware of the fact that without any authorization from the Council, other types of business could open up in that neighborhood and display signs advertising their particular line of business. IIe then requested the City Attorney to enumerate the various home occu- pations which are permissible in the "A -1" District. He stated that in the past, in cases of this kind, members of the Council have often gone out to inspect the premises in order that they might see for themselves the con ditions surrounding the application and stated that he felt that action should be taken in this particular instance. He thereupon moved this hearing be continued to the next meeting of the Council. The motion was seconded by Councilman Osborn and carried unanimously. REPORTS OF COMMITTEES: sF 3: From the City Planning Board, recommending the re-classification of property situated on the south side of Central Avenue, beginning 152.08 feet east of Fifth Street, with frontage of 63.33 feet and depth extending to the shore line of San Francisco Bay - known as 510 Central Avenue. It was requested that the property be rezoned from the "C" Multiple Dwelling District, to the "D" Commercial District in order that the petitioner might continue to operate his electrical contracting business. The matter was referred to "Introduction of Ordinances." 4. The City Manager stated he wished to make a further committee report dealing with the possible prevalence of rabies of dogs in the Estuary Housing Project. He stated that a person in the project had been bitten by a dog which, upon examination showed some symptoms of rabies and that it was felt, after investigation, the proper thing to do would be to quarantine all dogs in the project for an indefinite period. He stated that the biting dog had been brought in from Stockton. He also stated that the purpose of this report was to call the attention of the Council to the splendid cooperation given by Mr. Sanford in the matter of publi- cizing the quarantine and to publicly thank Mr. Sanford for his efforts. INTRODUCTION OF ORDINANCES: 5. Councilman Osborn introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series Reclassifying Property by Adding Section 40 to Ordinance No. 725, New Series." RESOLUTIONS: 6. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3601 Adopting Specifications, Special Provisions and Plans for the Cleaning of the North Side Sewer Running Along the Segregation Line in Alameda." The motion to adopt said resolution was seconded by Councilman Sweeney and on roll call carried by the following vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. At the request of Councilman Jones, City Engineer Froerer explained the reason for this cleaning, stating that the conduit had become so filled with silt that the line was not operating to its full efficiency and in order to obviate flooding conditions in this area the line should be cleaned out. 7. The following resolution was introduced by Councilman Sweeney, who moved its adoption: "Resolution No. 3602 Accepting Conveyance from Harold C. Ward and Frances M. Ward, His Wife, of Certain Real Property and Consenting to the Recordation Thereof." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. Mr. McMillan explained this resolution, pointing out that the property involved is that which the City is acquiring to expand Godfrey Park. 8. The following resolution was introduced by Councilman Anderson, who moved its adoption; "Resolution No. 3603 Appointing an Acting City Manager During the Absence of the City Manager." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon the President declared said resolution duly adopted and passed. FILING: 9. Financial Statement - Goodell, Byers & Co. - Bureau of Electricity, as at June 30, 1947. 10. Specifications - No. PW 8 -47 -10 - For Cleaning North Side Sewer. BILLS: 11. An itemized List of Claims against the City of Alameda and the several depart- ments thereof in the total amounts as follows, was presented to the City�Council at this meeting: General Departments, $p8,587.02; Police Department, 42,540.32; Civil Service Department, 79.81; Pound Department, 54.54 ;. Fire Department, $846.09; Health Department, 5657.86; Street Department, 43,584.16; Recreation Department, $962.97; Park Department, 14,622.93; Golf Course Department, p1,397.06; Store Department, 4892.23; Social Service Department, $81.44; Street Improvement Fund, $5,476.28; Parking Meter Operations Fund, $10.53; Gas Tax No. 1 Fund, $597.68; Gas Tax No. 2 Fund, $597.69; Special,Fire Alarm System Fund, $659.33; East Bay Municipal Utility District Fund, $1,989.58; Special Street Lighting Fund, 1,496.09; Planning & Engineering Fund, $403.41. Councilman Jones moved the bills as itemized in the List of Claims filed with the City Clerk on August 19, 1947, and presented to the Council at this time, be allowed and paid. The motion was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Anderson, Jones, Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None.
