1945-01-30 Special CC MinutesSPECIAL NEETING.OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING IANUARY 0 - 1945 The meeting convened at 6:30 P. M. with President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5), were noted present. Absent: None. REPORTS OF COMMITTEES: From Mayor Godfrey, presenting the Call and Notice of Special Meetin which was read as follows and ordered filed. "CALL AND NOTICE OF SPECIAL MEETING To the Members of the City Council City of Alameda, California Gentlemen: YOU AND EACH OF YOU ARE HEREBY NOTIFIED that a special meeting of the Council of the City of Alameda is hereby called and will be held on Tuesday, the 30th day of January, 1945, at the hour of 6:30 P. M. of said day, in the Council Chamber, City Hall, Alameda, California. The purpose of the aforesaid special meeting is to introduce an ordinance entitled, "AN ORDINANCE AIENDING ORDINANCE NC. 673, NEW SERIES, ENTITLED 'AN ORDINANCE ESTAB- LISHING A RETIREMENT, PENSION AND INSURANCE SYSTEM FOR OFFICERS AND EMPLOYEES OF THE CITY OF ALA1EDAt. 1, A copy of this ordinance, which has heretofore been delivered to you, is hereby referred to and made a part hereof. The minutes of the regular meeting held January 16, 1945, and of the special meeting held January 30, 1945, were approved as transcribed. WRITTEN 00ELUNIC ATIONS : 2'.; From Robinson, Price & Macdonald, Attorneys for United Engineering Company, advising of compliance with terms of lease between it and City, dated September 30, 1939, concerning the expenditure of at least $50,000. for the construction of wharves, docks, piers, slips, railway tracks, shop buildings, dredging and fill- ing on the property. The communication. was ordered filed. From the County of Alameda, Office of Tax Collector, with regard to sale at public auction of certain property situated in City of Alameda, more specifically described in the letter, and requesting a statement from the Council as to the minimum startind bid acceptable. Councilman Osborn moved that in view of the large amount of delinquency against this property and the probability of its increasing to the point where the property would become unmarketable, the Council signify its agreement to the sale at public auction at a minimum bid of 2,000. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. 4; From the City of Berkeley, explaining its plan to procure an airport centrally located for all communities of the East Bay area, to be constructed as a postwar project and inviting the City of Alameda to appoint two delegates as its represen- tatives at future meetings of the committee acting in this matter. President Godfrey appointed Councilmen Jones and I:owe to represent the City of Alameda, which appointments were approved. 5:x From United States Naval Air Station, accepting Revocable Permit granted to the City of Alameda covering its use of a 29-foot strip of Government property adjoining the Naval Air Station. The communication was ordered filed. OPENING OF BIDS: 6, Bids were presented and read for the furnishing of one new Tractor Loader for the Street Department in accordance with Specifications and Provisions No. HS 1-45-1, as follows: From Industrial Equipment Company - - - - Accompanied by certified check in amount of From Edward R. Bacon Conwany - - Accompanied by Bid Bond in amount of - 2,072.72 207.28 3,177.50 350.00 These bids were referred to the City Manager and City Engineer for their study and recommendation, REPORTS OF COMMITTEES: 7. From the Pension Board of the City of Alameda, approving the Report on the Police and Fire Pension Fund, covering the fiscal periods from February 1, 1925, to June 30, 1944, filed by Goodell, Byers & Henry. The communication was ordered filed. 8V. From the City Attorney, recommending that he be authorized to file a Partial Disclaimer in the action entitled, "United States of America, Plaintiff, vs. Cer- tain parcels of land in the City of Alameda, County of Alameda, State of California, Anglo-onlifornia National Bank, et al., Defendants, No. 22481-G." oLOti The matter was referred to "Resolutions." 9. From the City Planning Board, recommending the reclassification of certain property owned by Alaska. Packers Association, situated north of Buena Vista Avenue and bounded in general by the west line of Grand Street, north line of Eagle Avenue and west line of Hibbard Street - from the "B" Two-to-Four Family Dwelling District, to the "G" Light Industrial District. This matter was referred to "Ordinances for Introduction." ORDINANCES FOR INTRODUCTION: 10. Councilman Howe introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-432 of Article 3, Chapter 4, Title XVII of the Alameda lainicipal Code, by Adding Subdivisions (18) and (19) Thereto." 11. Councilman Jones introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Adding Section 27 to Ordinance No. 725, New Series." NEW BUSINESS: 12. City Manager McMillan stated he wished to inform the Council concerning the latest plans of the United States Navy to increase its housing accommodations in the City of Alameda by three hundred units. He reported that in company with two members of the City Planning Board and representatives of civic organizations of the City, he had met with the heads of the Naval Air Station this afternoon at which time the Navy outlined its plans for the erection of these units. Ir. ic1,7illan stated that all desirable open building sites in the City were dis- cussed with the Navy being predisposed in favor of the Krusi Park area. He said that he went on record on behalf of the City as favoring the location of these housing units on Bay Farm Island, with the suggestion that by rebuilding the levee and doing some filling, this property would make an acceptable site. He stated that the Office of Defense Transportation does not want ony housing units any further removed from present trans portation facilities than is absolutely necessary. He requested that the Council, if it felt his position to be the correct one, signify its Willingness to his going ahead on the lines already taken. The Council, through the expression of its individual members, stated it believed the City Manager was working in the right direction and wished him to proceed along that line. RESOLUTIONS: 13. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 3086 Authorizing Filing of Parti 1 Disclaimer in Eminent Domain Proceedings." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon President Godfrey declared said resolution duly adopted and passed. 14. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 3087 Transferring $4,000. from the Library Fund to the General Fund." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon President Godfrey declared said resolution duly adopted and passed. 15. The following resolution was introduced by Councilman Osborn, who moved, its adoption: "Resolution No. 3088 Oreatin ttie Position of Senior Civil Engineer in the Street Department of the City of Alameda and Prescribing the Duties Thereof." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. There- upon President Godfrey declared said resolution duly adopted and passed. Councilman Jones queried if this would be a promotional examination and in re- sponse to this question, the City Engineer stated it would not be, that anyone now in the Engineer's office with the proper qualifications would be eligible to take the examination but that it would also be open to anyone in the City. 16. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 3089 Fixing the Salary of Position of Senior Civil Engineer in the Office of the Street Department of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon President Godfrey declared said resolution duly adopted and passed. 17. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No, 3090 Cancelling City Taxes on Property of the United States of America." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Lranscheid, Howe, Tones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon President Godfrey declared said resolution duly adopted and passed. 18. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 3o91 Providing for the Awarding of Service Badges," The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid,Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon President Godfrey declared said resolution duly adopted and passed. 19. The following resolution was introduced. by Councilman Jones, who moved its adoption: "Resolution No. 3092 Creating and Establishing One (1) Additional Position of Sergeant in the Police Department of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the foil owinr, vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Woes: None. Absent: None. There- upon President Godfrey declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 20. Councilman Osborn stated that a vote taken on passage of an ordinance entitled, 'An Ordinance Amending Ordinance No. 673, New Series, entitled "An Ordinance Es- , tablishing a Retirement, Pension and Insurance System for Officers and Employees of the City of Alameda,'" proposing to amend Ordinance No. 673, New Series, was inadvertently taken by the Council on January 16, 1945, when only four members of the City Council were present and,it appearing that it is necessary in order to peas said ordinance that there bean affirmative vote of five members of said Council, and it further appearing that said vote would not have been taken on January 16, had the requirements of the Charter been called to the attention of the Council, Councilman Osborn therefore moved that the vote on the motion to pass and adopt an ordinance entitled, "An Ordinance Amending Ordinance No. 673, New Series, entitled An Ordinance Establishing a Retirement, Pension and In- surance System for Cfficers and Employees of the City of Alameda,'" taken by this Council at its regular meeting held January 16, 1945, be rescinded. The motion was seconded by Councilman Jones and on roll call carried by the follow- ing vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. 21. "Ordinance No. 866 New Series An Ordinance Amending Ordinance No, 673, New Series, Entitled "An Ordinance Establishing a Retirement, Pension and Insurance System for Officers and Employees of the City of Alameda." Councilman Jones moved the ordinance be adopted as read. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None, 22. "Ordinance No. 867, New Series An Ordinance Leasing Certain Portions of the Alameda Municipal Golf Course to the United States of America. It Councilman Osborn moved the ordinance be adopted as. read. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. 7 NG: • 23.
