REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA
HELD TUESDAY EVENING, MAY 1, 1945
The meeting convened at 8:00 P. M. with President Branscheid presiding.
ROLL CALL:
The roll was called and Councilmen Jones, Osborn, Sweeney and President
Branscheid, (4), were noted present. Absent: Councilman Howe, (1).
MINUTES:
1. The minutes of the regular meeting held April 17, 1945, were approved as
transcribed.
HEARINGS:
2. President Branscheid announced that the matter of the Report of Superin-
tendent of Streets on sidewalk repairs would now come on for hearing and
requested that anyone who might have any objections or protests to the contents
of said. Report now present same to the Council.
There being no response to this request, the Hearing was declared closed.
REPORTS OF COMMITTEES:
3. From the City Attorney, concerning condemnation proceedings to take certain
lands in the City of Alameda, which action is entitled, "UNITED STATES OF
AMERICA, Plaintiff, vs. 154.6 Acres of land, more or less, in the City of Ala-
meda, etc., LOUIS M. MacDERMOT, et al, Defendants, No. 2310.9-G," and recommend-
ing he be authorized to „prepare and file an Answer in said action..
The matter was referred to "Resolutions."
4'.( From the City Manager, recommending that contract be awarded to Henry Shirek,
doing business as Allied Painters and Decorators, for the project of painting the
interior and exterior of Health Center Building and Garage.
Councilman Jones moved the recommendation of the City Manager be approved; that
contract for the above project be awarded to Aliied Painters and Decorators and
that bid .checks be returned to the unsuccessful bidders. The motion was seconded
by Councilman Osborn and on roll call carried by the following vote. Ayes:
Councilmen Jones, Osborn, Sweeney and President Branscheid, (4). Noes: None.
Absent: Councilman Howe, (1).
RESOLUTIONS:
5. The following resolution was introduced by Councilman Osborn, who moved its
adoption:
"Resolution No. 3117
Confirming Report of Superintendent of Streets on
Sidewalk Repair and Ordering Notice of Lien Recorded
and Turned Over to Assessor and Tax Collector to Add
Amount to Tax Bill."
The motion to adopt said resolution was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4). Noes: None. Absent: Councilman Howe, (1). There-
upon the President declared said resolution duly adopted and passed.
6. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3118
Adopting Specifications for Furnishing One New Half-
ton Pick Up Truck to the City of Alameda, Calling for
Bids and Directing the City Clerk to Advertise Same."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4). Noes: None. Absent: Councilman Howe, (1). There-
upon the President declared said resolution duly adopted and passed.
7. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3119
Cancelling City Taxes on Real Property Acquired by the
Veterans' Welfare Board of the State of California."
The motion to adopt, said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and.
President Branscheid, (4). Noes: None. Absent: Councilman Howe, (1). There-
upon the President declared said resolution duly adopted and passed.
8. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3120
Transferring Funds from Budget Account 70b
(Miscellaneous-Contingent) to Budget Account
42p (Health Dept.-Building Upkeep)."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and.

9. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3121
Authorizing Execution of Proof of Loss and Release
in Claim for Insurance on Fire Truck."
The motion to adopt said resolution was seconded by Councilman Jones and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and.
President Branscheid, (4). Noes: None. Absent: Councilman Howe, (1). There-
upon the President declared said resolution duly adopted and passed.
10. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3122
Authorizing Increase in Amount of Emergency
,Revolving Fund of City of Alameda."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and

11. The following resolution was introduced by Councilman Osborn, who moved its
adoption:
"Resolution No. 3123
Authorizing Execution of an Agreement Between City of
Alameda and Bethlehem Steel Company for Distribution
of Award in Certain Condemnation Proceedings Instituted
by the United States of America; Authorizing Filing an
Application for Distribution; and Authorizing City
Attorney to File Stipulation."
The motion to adopt said resolution was seconded by Councilman Jones and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn., Sweeney and

12. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3124
Designating Access Highway Along Northerly Shore of
Bay Farm Island as Street of Major Importance."
The motion to adopt said resolution was seconded by Councilman Jones and on roll

13. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3125
Dedicating Certain Parcels of Land in the City of
Alameda as a Public Highway."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the,following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4). Noes: None. Absent: Councilman Howe, (1). There-
upon the President declared said resolution duly adopted and passed.
14. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3126
Resolution Authorizing the Taking of a Special Census
of the City of Alameda by the Bureau of the Census of
the United States; Authorizing the Execution of an
Agreement between the Director of the Census and the
City of Alameda for the Taking of Said Census; and
Appropriating Funds for the Cost Thereof."
The motion to adopt said resolution was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4) . Noes: None. Absent: Councilman Howe, (1). Thereupon
the President declared said resolution duly adopted and passed.
15. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3127
Establishing the Position of "Special Census Enumerator"
and Fixing Compensation Thereof."
The motion to adopt said resolution was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4) . Noes: None. Absent: Councilman Howe, (1) . There-
upon the President declared said resolution duly adopted and passed.
16. The following resolution was introduced by Councilman Osborn, who moved its
adoption:
"Resolution No. 3128
Authorizing the Filing of an Answer and Execution of
Offer to Accept and of Stipulation for Entry of Final
Judgment in United States vs. 154.6 Acres, etc. Louis
M. MacDermot, et al."
The motion to adopt said resolution was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4). Noes: None. Absent: Councilman Howe, (1). There-
upon the President declared said resolution duly adopted and passed.
17. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3129
Authorizing the Execution of Agreement with the State
of California Covering the Expenditure of the 1/4 Cent
Gas Tax Fund for the Fiscal Year 1945-1946."
The motion to adopt said resolution was seconded by Councilman Jones and on roll
call carried by the following vote. Ayes: Councilmen Jones, Osborn, Sweeney and
President Branscheid, (4) . Noes: None. Absent: Councilman Howe, (1) . There-
upon the President declared said resolution duly adopted and passed.
FILING:
18. Financial Statement - Goodell, Byers & Henry - Bureau of Electricity,
as of March 31, 1945.
19. Specifications - No. MS 5-45-2, for furnishing one Half-ton Pick Up
Truck for Street Department.
20. Auditor's Balance Sheet - Month ending April 30, 1945.

21. At this point, Councilman Jones asked that the meeting be referred back to
"Reports of Committees" and inquired as to the progress being made on Godfrey Park.
Mr. McMillan reported that work on Godfrey Park can now proceed as the City Engi-
neer has stated that equipment can be gotten in there this week; also, that the
leveling off of the park can be started as the ground is now dry enough to go
ahead with this work. The City Manager stated there is now some top soil avail-
able which is needed for grading purposes in this park and said that he was of
the opinion that for a sum not to exceed $1,000. the necessary work along this
line could be accomplished. He suggested that if the Council approves, he be
given permission to expend a sum not to exceed $1,000. out of account 70-b to
take care of this matter.
Councilman Osborn moved the City Manager be authorized to expend a sum not to
exceed $1,000. from account 70-b for the necessary top soil for Godfrey Park.
The motion was seconded by Councilman Sweeney and on roll call carried by the
following vote. Ayes: Councilman Jones, Osborn, Sweeney and President Brans-
cheid, (4). Noes: None. Absent: Councilman Howe, (1).

22. The President stated that he would like to appoint a committee to head up
the annual Flag Day celebration in the city of Alameda and thereupon appointed
Councilmen Jones and Sweeney as co-chairmen of the City's committee for the ob-
servance of Flag Day.
23. The City Manager stated that he had one or two other items to report on and
said that the sidewalk fronting the Zunino property on Calhoun Street which was
brought before the Council by petition several weeks ago has now been installed.
24. Mr. McMillan also reported that the sidewalk on Webster Street is now under
contract and work will be started within the next ten days. He stated further
that the work around the mouth of the Tube on the west side is proceeding very
satisfactorily and will be completed about the third week in May. As to the east
side, the Public Roads Administration has written the Maritime Commission in
Washington to get the necessary easements and the prospects for the early comple-
tion of the work in that location are very satisfactory.

25. There being no further business to transact, the Council adjourned to assemble
in regular session on Tuesday evening, May 15, 1945, at 8:00 P. M.
