HELD TUESDAY EVENING, JUNE 26, - - - - - - - - - - - - - - 1945
The meeting convened at 7 :30 P. M. with President Branscheid presiding.
ROLL CALL:
The roll was called and Councilmen Howe, Jones, Osborn, Sweeney and President
Branscheid, (5), were noted present. Absent: None.
MINUTES:
1. The minutes of the regular meeting held June 19, 1945, were approved as
transcribed.
WRITTEN COMMUNICATIONS:
2. Goodell, Byers & Henry, Certified Public Accountants, submitting their
proposal for auditing City financial records during the fiscal year 1945 -1946.
The communication was referred to the Committee of the Whole for further study
and investigation.
3( From George B. Middleton & Co., Accountants and Auditors, submitting proposal
for City auditing services during the fiscal year 1945 -1946.
This communication was also referred to the Committee of the Whole for further
consideration and investigation.
4:' From County Tax Collector, requesting cancellation of City Tax Bill No. 6643,
for taxes levied against property sold by the County for taxes, the sale price
having included taxes covered by this bill.
The matter was referred to "Resolutions."
5. Mr. Rix Maurer, tendering his resignation as a member of the Board of
Education, effective at once.
The President explained the reason for this resignation was in order that Mr. Maurer
could be transferred from the Board of Education to the Public Utilities Board of
the City of Alameda.
Councilman Jones moved the acceptance of the resignation. The motion was seconded
by Councilman Sweeney and unanimously carried.
OPENING OF BIDS:
6: A bid was presented and read from the Alameda Times -Star for legal advertising
of the City of Alameda during the fiscal year 1945 -1946, as follows:
1st insertion $1.20 per square
2nd insertion .90 per square
3rd and subsequent insertions . 75 per square
The bid was referred to the City Manager for his recommendation.
REPORTS OF COMMITTEES:
7. From Mayor Branscheid, nominating Mr. M. C. Godfrey to the office of member
of the Board of Education, to fill the unexpired term of Rix Maurer, resigned,
which term will .expire June 30, 1947.
The matter was referred to "Resolutions."
8' From Mayor Branscheid, nominating Mr. Rix Maurer to the office of member of
the Public Utilities Board of the City of Alameda, to fill the term of Irving Coen,
resigned, which term will expire June 30, 1948.
The matter was referred to "Resolutions."
9Y From Acting City Manager, recommending that Henry Shirek, contractor for the
painting of the Health Center building, be granted a ten -day extension of time to
complete the work specified in the contract.
Councilman Howe moved the recommendation of the Acting City Manager be approved
and a ten -day extension of time be granted to the contractor. The motion was
seconded by Councilman Osborn and unanimously carried.
UNFINISHED BUSINESS:
10: Councilman Tones called the attention of the Council to the dissatisfaction
in the City concerning the acti.on.of the County Coroner in eliminating the
Deputy Coronership from the City of Alameda. He stated that the City Manager
had directed a letter to the Coroner, explaining the City's position in this
matter and protesting against the move. Councilman Jones asked the City
Manager, through the President, whether or. not there had been any reply to
his letter.
Mr. McMillan stated that no answer had been received up to the time he left for
Washington and since his return he has not checked his correspondence to deter-
mine whether or not one was received during his absence. He stated that in his
letter to the Coroner he requested that action on this matter be held up pending
his return from Washington. Mr. McMillan queried of the City Attorney if there
had been any reply to his letter to the Coroner.
Mr. Whitney stated he had checked with the Board of Supervisors and found they
had not received a copy of Mr. McMillan's letter to the Coroner. He had there-
upon undertaken to send a copy of that letter to the Board. He stated that a
reply from the Board of Supervisors to the copy of the letter sent to the Coroner
had been received, in which it was stated that the Supervisors could see no pur-
pose in delaying action in the matter and that in their opinion it was not prac-
ticable to continue the Deputy Coronership in the City of Alameda.
Following a general discussion of the matter in which the belief was expressed
that the City of Alameda had not been given opportunity to be heard on the ques-
tion, Councilman Jones moved that the City Manager be requested to write to the
Coroner asking for a full explanation in writing as to why our reasonable re-
quest for a slight delay in this matter has been ignored and that a copy of this
letter be directed to the Board of Supervisors. The motion was seconded by Coun-
cilman Osborn and unanimously carried.
RESOLUTIONS:
11. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3164
Cancelling Tax Bill No. 6643 for Fiscal Year 1944 -1945
Covering Property Sold at Auction by the County of Alameda."
The motion to adopt said resolution was seconded by Councilman Howe and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the president declared said resolution duly adopted and passed.
12. The following resolution was introduced by Councilman Osborn, who moved
its adoption:
"Resolution No. 3165
Authorizing Execution of Release of All Claims Against
Key System in Collision Between Police Car and Bus."
The motion to adopt said resolution was seconded by Councilman Sweeney and on
roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
13. The following resolution was introduced by Councilman Tones, who moved its
adoption:
"Resolution No. 3166
Resolution of Intention - To Order the Vacation of
portions of Calhoun Street in the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Howe and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
14. The following resolution was introduced by Councilman Howe, who moved its
adoption:
"Resolution No. 3167
Appointing Member of the Board of Education."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
The President stated that it was his feeling that the City of Alameda was very
fortunate in having a man of Mr. Godfrey's caliber accept the appointment to
this Board.
15. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3168
Appointing Member of the Public Utilities Board."
The motion to adopt said resolution was seconded by Councilman Howe and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
President Branscheid stated the City was indeed fortunate in having two such
outstanding men as Mr. Godfrey and Mr. Maurer accept service on these very im-
portant City Boards.
16. The following resolution was introduced by Councilman Sweeney, who moved its
adoption:
"Resolution No. 3169
APPROVING SECOND SUPPLEMENTAL MEMORANDUM OF AGREEMENT
for Expenditure of 1/4 Cent Gas Tax Allocated for
Streets of Major Importance."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
17. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 3170
Adopting Specifications, Special Provisions and
Plans for Resurfacing Gibbons Drive."
The motion to adopt said resolution was seconded by Councilman Sweeney and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
18. The following resolution was introduced by Councilman Sweeney, who moved
its adoption:
"Resolution No. 3171
Transferring $14,162.82 from the Alcoholic Beverage
Control Fund to the General Fund of the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Jones and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
19. The following resolution was introduced by Councilman Osborn, who moved its
adoption:
"Resolution No. 3172
Transferring $2,840.80 from the Initiative Relief
Fund to the General Fund of the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Howe and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
20. The following resolution was introduced by Councilman Howe, who moved its
adoption:
"Resolution No. 3173
Transferring $60,416.66 from the In Lieu Tax Fund
to the General Fund of the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Sweeney and on
roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
21. The following resolution was introduced by Councilman Osborn, who moved its
adoption:
"Resolution No. 3174
Transferring $150,000. from General Fund to
Capital Outlays Fund."
The motion to adopt said resolution was seconded by Councilman Sweeney and on
roll call carried by the following vote. Ayes: Councilmen Howe, Jones, Osborn,
Sweeney and President Branscheid, (5) . Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.
22. The following resolution was introduced by Councilman Osborn, who moved its
adoption:
"Resolution No. 3175
Establishing Certain Positions of Employment in the
City of Alameda and Fixing the Salaries and Rates of
Compensation for Such Positions and for All Charter
Offices and Positions Under the Jurisdiction of Said
City."
The motion to adopt said resolution was seconded by Councilman Jones and on roll
call carried by the following vote. Ayes: Councilmen Howe, Jones, Oshorn,
Sweeney and President Branscheid, (5). Noes: None. Absent: None. Thereupon
the President declared said resolution duly adopted and passed.

BILLS:
27. An itemized List of Claims against the City of Alameda and the several
departments thereof in the total amounts as follows, was presented to the
Council at this meeting: General Departments, $3,339.42; Civilian Defense
Department, $150.; Police Department, $1,262.82; Civil Service Department,
$83.67; Pound Department, $12.15; Fire Department, $1,662.36; Street
Department, $3,981.15; Health Department, $116.41; Recreation Department,
$970.80; Park Department, $2,067.07; Golf Course Department, $307.38;
Store Department, 218.49; Social Service Department, $15.88; Gas Tax
No. 1 Fund, $350.; Gas Tax No. 2 Fund, $15.; East Bay Municipal Utility
District Fund, $2,450.66.
Councilman Howe moved the bills as itemized in the List of Claims filed with
the City Clerk on June 26, 1945, and presented to the Council at this time,
be allowed and paid. The motion was seconded by Councilman Osborn and on
roll call carried by the following vote. Ayes: Councilmen Howe, Jones,
Osborn, Sweeney and President Branscheid, (5). Noes: None. Absent: None.
28. this time, Councilman Jones asked for a report by the City Manager on
his recent trip to Washington, D. C.
Mr. McMillan stated that the committee went to Washington primarily to ascertain
the attitude of the Army and Navy on the construction of a new tube and found
these services to be one hundred per cent cooperative. He stated that the com-
mittee consisted of Messrs. Hary Bartell of the County Board of Supervisors,
Chas. R. Schwanenberg, City Manager of Oakland; Sumner Graham, President of the
Alameda Chamber of Commerce, and himself. They were extended every courtesy by
the California Congressmen - Miller, Tolan, Havenner and others, who arranged
all of their appointments and who accompanied them on their calls to the Navy
Department.
In his opinion, the ultimate financing of the tube will be up to the Congressmen
whose job it will be to have funds for this purpose included in some appropria-
tion bill. He stated further that it was rather late as the regular budgets
were almost completed and that any appropriation for this purpose will have to
come through some deficiency bill after approval by all of the different agencies
concerned. He remarked that the Public Roads Administration, under whose juris-
diction the construction of the tube will ultimately fall, was most cooperative
all the way through and it was the belief of the committee that this agency is
desirous of having the tube built. In conclusion, Mr. McMillan stated that he
considered the position of the City to be very good in this matter for the reason
that for the first time this project has the backing and approval of the Army
and Navy.
ADJOURNMENT:
29. President Branscheid stated that it might be necessary to transact further
business during the current fiscal year and suggested that the meeting be ad-
journed to a later date in this week, proposing Friday evening, June 29, 1945,
at 6:00 o'clock.
Councilman Jones moved the Council adjourn to assemble in adjourned regular session
on Friday evening, June 29, at 6:00 o'clock, if such meeting is found to be neces-
sary. The motion was seconded by Councilman Howe and unanimously carried.
