1944-11-21 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING,_ NOVEMBER 21 -- - -1944 The meeting convened at 8:00 p. m. with President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Jones and President Godfrey, (4), were noted present. Absent: Councilman Osborn, (1) MINUTES: 1. The minutes of the regular meeting held November 8, 1944, were approved as transcribed. At this point, the President extended to Mr. Stanley D. Whitney, newly appointed Deputy City Attorney, greetings of the Council and a welcome into the official family of the City. WRITTEN COMMUNICATIONS: 2':J From Mr. George W. Coupe, requesting permission to move a dwelling known as 707 Haight Avenue to a lot situated on the southeast corner of Pacific Avenue and Chapin Street. The President stated that in view of the fact that the Council has no information on this matter, it would be referred to the Building Inspector for his investiga- tion of all the circumstances surrounding the proposed house moving, and his report and recommendation on the subject. REPORTS OF COMMITTEES: 3.' From the City Attorney, officially appointing Stanley D. Whitney to the office of Deputy City Attorney, effective as of November 16, 1944. The communication was noted and placed on file. 41 From the City Manager, recommending that contract be awarded to Lee Scaramelli for the project of repairing sidewalks, curbs and gutters of the City during the fiscal year ending June 30, 1945. Councilman Jones moved the recommendation of the City Manager be approved; that contract be awarded to Lee Scaramelli for the above mentioned project and that check be returned to the unsuccessful bidder. The motion was seconded by Council- man Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, (1). 5. From Mr. Thomas J. Craig, addressed to Mayor Godfrey, tendering his resigna- tion as a member of the Public Utilities Board of the City of Alameda. Mayor Godfrey's letter of response was also read at this time. Councilman Branscheid expressed the regret of the Council at the resignation of Mr. Craig and moved it be accepted. The motion was seconded by Councilman Jones and unanimously carried. 6. From the City Manager, with attached recommendation from the City Engineer, recommending the acceptance of performance of work under contract with the Grove Painting and Decorating Co. for the project of painting Fire Stations Nos. 1, 3 and 5, as it had been satisfactorily completed in accordance with the Specifica- tions. Councilman Branscheid moved the recommendation of the City Manager be approved and the contracts covering the above stipulated projects be accepted. The motion was seconded by Councilman Jones and unanimously carried. 7/ From the City Manager, recommending that Grove Painting and Decorating Co. be granted a ten -day extension of time to complete the painting of Fire Station No. 2, which work had been delayed due to inclement weather. Councilman Branscheid moved the recommendation of the City Manager be adopted and the request of the above firm be granted. The motion was seconded by Councilman Howe and unanimously carried. ORDINANCES FOR INTRODUCTION: 8. Councilman Jones introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Repealing Article.3, Chapter I, Title X of the Alameda Municipal Code and Adding Articles 3, 4 and 5 to Chapter I, Title X of Said Code, Relating to House Movers, Removal and Relocation of Buildings." UNFINISHED BUSINESS: 9. The matter of the resignation of H. Albert George from the office of City Attorney of the City of Alameda was again presented. Action on this subject had been put over from the regular meeting of the Council held October 17, 1944. President Godfrey commented on Mr. George's resignation with appropriate remarks and expressed the appreciati ©n of the Council for the splendid work done by Mr. George during his tenure of office. He stated, further, that the Council had always felt very happy and secure under his legal advice and guidance and all members believed Mr. George had rendered the City an outstanding service. Presi- dent Godfrey extended to Mr. George the best wishes of the Council for his future success. Councilman Howe then moved the acceptance of the resignation of H. Albert George as City Attorney, effective December 1, 1944. The motion was seconded by Council man Branscheid and unanimously carried. NEW BUSINESS: 10. Councilman Branscheid stated that it appeared to the Council, from the report of Jordan ,t Ticoulet, Auditors and Accountants, dated December 15, 1938, and from the affidavit of Vern Smith and other information that expenditures of City funds for investigation and police work of a secret character made by Ralph M. Bryant, City Manager, and Vern Smith, Chief of Police, during the period from October 5, 1932, to February 14, 1935, are satisfactorily accounted for and that there is no evidence of misappropriation, and he therefore moved that the City Attorney of the City of Alameda be authorized to dismiss that certain action pending in the Su- perior Court of the State of California in and for the County of Alameda, entitled, "City of Alameda, a municipal corporation, Plaintiff, vs. Vern Smith and Ralph M. Bryant, Defendants, No. 138033"of the records of said court. The motion was seconded by Councilman Howe and unanimously carried. 11: Councilman Branscheid moved that since the Council had advertised for sealed bids for the project of seal coating asphalt and bituminous pavement during the fiscal year ending June 30, 1945, under Specifications and Provisions No. PW- 10 -44 -9, and had received no bids for doing said work, the City Manager and City Engineer be authorized to make such public work without contract or further call forbids. The motion was seconded by Councilman Howe and on roll call carriedby the follow- ing vote. Ayes: Councilmen Branscheid, Howe, Jones, and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, (1). RESOLUTIONS: 12. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 3061 Adopting Specifications for Furnishing One New Business Coupe Automobile, Calling for Bids and Directing the City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, (1). Thereupon President Godfrey declared said resolution duly adopted and passed. 13. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No, 3062 Fixing the Salary of Position of City Engineer and Superintendent of Streets." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman. Osborn, (1). Thereupon President Godfrey declared said resolution duly adopted and passed. 14. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution= No. 3063 Fixing the Salary of the Position of Deputy Treasurer." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, (1). Thereupon President Godfrey declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 15. "Ordinance No. 863, New Series An Ordinance Authorizing and Directing the Execution of an Agreement Renewing Lease Made Between the City of Alameda and Alaska Packers Association, Dated February 5, 1920, for an Additional Term of Twenty- Five Years." Councilman Howe moved the ordinance be adopted as read. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, (1). 16. "Ordinance No. 864, New Series An Ordinance Adding to Chapter 4, Title X of the Alameda Municipal Code a New Article to be Known as Article 3, Providing an Alternative Procedure for Demolition or Repair of Buildings Unfit for Human Habitation or Occupancy." Councilman Branscheid moved the ordinance be adopted as read. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, (1). FILING: 17. Financial Statement - Goodell, Byers & Henry - City of Alameda, as at October 31, 1944 18. Specifications - For furnishing one Business Coupe 19. Annual Report - City of Alameda, for fiscal year 1943 -44. BILLS: 20. An itemized List of Claims against the City of Alameda and the several departments thereof in the total amounts as follows was presented to the Council at this meeting: General Departments, $8,554.00; Civilian Defense Department, $262.45; Police Department, $975.58; Civil Service Department, *33.87; Pound Department, $20.79; Fire Department, $1,900.87; Street Department, $3,758.19; Health Department, $930,01; Federal Recreation Facilities, $272.43; Recreation Department, $584.37; Park Department, $1,386.46; Golf Course De artment, $881.88; Store Department, $580.77; Social Service Department, 42.09; Initiative Relief Fund, $41.00; Street Improvement Fund, $2,561.89; East Bay Municipal Utility District Fund, $2,405.21. Councilman Branscheid moved the bills as itemized in the List of Claims filed with the City Clerk on November 21, 1944, and presented to the Council at this time, be allowed and paid. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones and President Godfrey, (4). Noes: None. Absent: Councilman Osborn, -(1). Councilman Branscheid questioned the telephone bills for the Civilian Defense Department, commenting upon the size of same and inquiring whether or not this telephone service could not be discontinued or curtailed. The City Manager explained that the bills up for passage at this meeting are old ones and that the telephone service in this department at the present time has been cut back to the point where the service is almost entirely for the housing projects. ADJOURNMENT: 21`: Councilman Jones suggested that the meeting be adjourned in honor and recognition of the splendid service rendered the City by H. Albert George, City Attorney. Mr. George replied, voicing his thanks to the Council for its expression of appreciation. He stated that while_he had worked mighty hard, he had enjoyed the work because it was performed.in.an atmosphere of friendliness and with a "swell bunch" of people. He thanked the Council for its good wishes and for the friendship that has been extended to him during the many years of service to the City.
