1943-06-01 Regular CC Minutes21 REGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, JUNE 1, --------- 1943 The meeting convened at 8:00 p. m. with President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5), were noted present. Absent: None. MINUTES: 1. The minutes of the regular meeting held May 18, 1943, were approved as transcribed. ORAL COMMUNICATIONS: 2. Mr. Frank Gottstein addressed the Council requesting information with regard to the installation of certain trolley wires and other indications to resume train service in downtown Oakland, specifically on Washington and Seventh Streets. 3. On motion of Councilman Branscheid, seconded by Councilman Howe and unani- mously carried, the regular order of business was suspended and the meeting pro- ceeded under "Unfinished. Business". UNFINISHED BUSINESS: 4. The matter of the proposed reclassification of that certain property lying east of Pernside Boulevard, from the "A" One-family Dwelling District to the "C" Multiple Dwelling District, was again presented. This matter was continued from the last regular meeting of the Council held. May 18, 1943. A letter was presented from Judge Edward. J. Silver, requesting further postpone- ment of action by the Council in this matter until the meeting of July 6, 1943, as representatives of the National Housing Authority desire to appear and it will be impossible for the proponents to have additional material ready for presenta- tion before that time. Councilman Branscheid then moved the request be granted and action postponed until the regular meeting of the Council to be held July 6, 1943. The motion was seconded by Councilman Howe and unanimously carried. There being no objections, the meeting then proceeded under the regular order of business. OPENING OF BIDS: 5. Bids were presented and read for furnishing one Portable Maintenance Roller to the City of Alameda, as follows: From Jenison Machinery Co. - - - Accompanied by certified check in amount of - From Spears-Wells Machinery Co., Inc. REPORTS OF 0 OMMITTEES : 6. From the Board of Education, with regard to the seriousness of the impending schoolhousing shortage situation due to the increased population of the City. There being no objections, the Communication was ordered filed. 7. From Mayor Godfrey, nominating Mr. Harold B. Fisher to the office of member of the City Planning Board for a term commencing July 1, 1943, and expiring June 30, 1948. There being no objections, the matter was referred to "Resolutions". 8. From Mayor Godfrey, nominating Dr. Donald D. Luni to the office of member of the Board of Education for a term beginning July 1, 1943, and expiring June 30, 1948. There being no objections, the matter was referred to "Resolutions". 9 From the City Planning Board, recommending the reclassification of property now owned by Joseph B. and. Dahlia C. Bruzzone and Frank J. and Susan. A. Bruzzone, beginning at the intersection of Eighth Street and Central Avenue, running thence westerly on the north line of Central Avenue 320 feet. This property has a depth of 273.71 feet running northerly to the southern line of Taylor Avenue with front- az_e on Taylor Avenue of 320 feet running easterly to Eighth Street and running thence southerly 273.71 feet to the point of beginning. This property is proposed to be reclassified from the "B" Two-to-four Family Dwelling District to the "C" Multiple Dwelling District. Councilman Branscheid moved the recommendation of the City Planning Board be adopted and the above referred property be reclassified as petitioned. The motion was seconded by Councilman Osborn. At this time Mayor Godfrey inquired if anyone in the audience wished to speak on this matter and. Mr. Charles Meyers, a resident in the vicinity of the property in question, responded. Mr. Meyers requested that the minutes of this meeting show a declaration by the proponents of this reclassification that the type of construc- tion of the buildings to be erected, landscaping and the project in general, as presented to the City Planning Board and at this meeting, will be completed as now proposed. Mr. Walter I. Dahl, representative of the parties who are to erect this multiple dwelling group, addressed the Council in response to this request and stated it was the definite intention of the sponsors of this project to carry out the ori- ginal plan, as stated; to subscribe in every way to the regulations imposed by the City on such type of construction; that restrictions are now being prepared relating to the operation and occupancy of the buildings and that his office is more than willing at all time to operate for the best results of the project as a whole. The sponsors will welcome any further inquiries by interested parties. These statements of Mr.. Dahl were acceptable to Mr. Meyers and the Mayor requested the substance of this discussion to be included in the minutes. The motion to reclassify this property was then unanimously carried. From the City Manager, recommending that D. Bruce Greenwade, Executive Secre- tary of the Civil Service Board, be authorized to attend the Western Regional Con- ference of the Civil Service Assembly to be held in Yosemite Valley, June 4, 5 and 6, 1943, and that 50. be appropriated to cover his expenses. Councilman Howe moved the recommendation of the City Manager be approved; that Mr. Greenwade be authorized to attend the above referred to conference and the amount of $50. be appropriated to cover his expenses. The motion was seconded by Coun- cilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. v/ 11. From the Treasurer and Tax Collector, referring to a recent amendment of the Revenue and Taxation Code of the State of California which changed the delinquent penalty on taxes due November 1 and unpaid on December 5, from 8 to 6 per cent. Tax sale at public auction was also changed, providing that property be sold to the State only and excluding public buyers. This action was taken to prevent sale of property belonging to taxpayers serving in the armed forces who are protected by the Soldiers' and Sailors' Relief Act of 1940. The Tax Collector recommended that comparable changes be made in the City ordinance governing taxes. There being no objections, the matter was referred to "Ordinances for Introduction". 12. From the City Attorney, recommending that he be authorized to file an answer in that certain action entitled, "UNITED STATES OF AMRICA, Plaintiff, vs. Certain Parcels of Land, etc., ALASKA PACKERS ASSOCIATION, et al., Defendants, No. 22546-G." Councilman Jones moved the recommendation of the City Attorney be approved and that he be authorized to file an answer in the above entitled action. The motion was seconded by Councilman Branscheid and unanimously carried. ORDINANCES FOR INTRODUCTION: 13. Councilman Branscheid introduced the following ordinance, after which it was referred to "Ordinances for Passage". "Ordinance No. New Series An Ordinance Amending The Alameda Municipal Code by Adding a New Section 3-638 to Title III Thereof." 14. Councilman Howe introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending The Alameda Municipal Code by Amending Section 3-5416 of Title III Thereof." 15. Councilman Jones introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Adding Section 22 to Ordinance No. 725, New Series." 16. Councilman Osborn introduced the following ordinance, after which it was laid over under provision of law and the Charter: rdinance No. New Series An Ordinance Amending The Alameda Municipal Code by Adding Subdivision (27) to Section 17-341 Thereof Relating to One Hour Parking." RESOLUTIONS: 17. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2859 Appointing Member of City Planning Board." The motion to adopt said resolution was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 18. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 2860 Appointing Member of the Board of Education." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5) . Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 19, The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2861 Approving Form of Agreement for Evacuation Mutual Aid Between City of Alameda, County of Alameda and Certain Other Municipalities and Public Corporations in Alameda County, and Authorizing Execution Thereof." The motion to adopt said resolution was seconded by Councilman Branscheid, and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. There- upon. the Mayor declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2862 Approving Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax Allocated for State Highways." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5) . Noes: None, Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 21. The following resolution was introduced by Councilman Osborn, who moved its adoption: "Resolution No. 2863 In Memoriam of Henry H. Meyers "In recognition of the long and untiring services of Henry H. Meyers in the field of zoning adjustment and development, the Council of the City of Alameda wishes to express its sense of personal loss in the death of Mr. Meyers, and its appreciation of his splendid efforts as a member of the City Planning Board. "By his death the City of Alameda has lost a beloved associate whose outstanding ability as an architect reflected high honor on the results the City Planning Board and the City Council has endeavored to accomplish, and whose memory is a worthy inspiration for all time. With the sense of community-loss is mingled deep sympathy for the members of his family. "BE IT THEREFORE RESOLVED that this resolution be spread upon the minutes of this meeting and a copy be transmitted to Mrs. Meyers that it may extend to her and to the members of the family an expression of sincere sympathy and heartfelt condolence. "RESOLVED, FURTHER, that when this Council adjourns it do so in respect to the memory of Henry H. Meyers." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2864 Authorizing Execution of Release to United States of America for Washington Park Bath House." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 23. The following resolution was introduced by Councilman Jones, who moved its adoption: "Resolution No. 2865 Authorizing. the Acquisition of Certain Real Property for Street and Highway Purposes (Atlantic Avenue) and Accepting and Consenting to Recordation of Deed." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President.Godfrey, (5). Noes: None. Absent: None. There- upon the Mayor declared said resolution duly adopted and passed. 24. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2866 Adopting Specifications and Provisions for Painting Exterior of City Hall and Garage in the City of Alameda, Calling for Bids and Directing City Clerk to Advertise Same." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). There- upon the Mayor declared said resolution duly adopted and passed. 25. - The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2867 Adopting Specifications for Furnishing Gasoline to the City of Alameda for the Fiscal Year 1943-1944, Calling for Bids and Directing the City Clerk to Advertise Same." 2 The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. The following resolution was introduced by Councilman Jones, who moved its adoption: olution No. 2868 Resolution of Intention to Reclassify Certain Real Property from the "B" District to the "C" District." The motion to adopt said resolution was seconded by Councilman Osborn and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 27. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2869 Authorizing Filing of Partial Disclaimer in Eminent Domain Proceedings." The motion to adopt said. resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None, Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. ORDINANCES FOR PASSAGE: 28. "Ordinance No. 824, New Series An Ordinance Amending The Alameda Municipal Code by Adding a New Section 3-638 to Title III Thereof." Councilman Branscheid moved the ordinance be adopted as read. The motion was seconded by Councilman Jones and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5). Noes: None, Absent: None, FILING: 29. Agreement for Evacuation Mutual Aid. 30. Financial Statement - Goodell, Byers & Henry - Bureau of Electricity, as of April 30, 1943. 31. Specifications - For painting exterior of City Hall and Garage. 32. Specifications - For furnishing Gasoline to City. 33. Form of Release - Washington Park Bath House. BILLS: 34, An itemized List of Claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $1,285.98; Social Service Department, $69.88; Encinal Avenue Improvement Fund, $1,740. Councilman Jones moved the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on June 1, 1943, and presented to the Council at this meeting, be allowed and paid.
