ROLL CALL:
The roll was called and Councilmen ronsoheid, Jones, Osborn and President
Jodfrey, (4) , were noted Present. Absent: Councilman Lowe, (1).

REPORTS OF CenaTTES:
2. -Prom the City Manager, submitting the tentative budget for the fiscal year
1943-1944.
There being no objections, the budget was referred to the Committee of the Whole.
J. From the City Attorney, x eforrin g to a pending court action entitled, "-UNITED
STATES OF AMERICA, Plaintiff, vs. Certain Parcels, etc., 73,=== STEEL COMPANY,
a Pennsylvania corporation, et al., Defendants, No. 22561-R," and recanmending
that ho be authorized to prepPre and file an answer on behalf of the City of Ala-
meda, setting forth the City's interest in the real property involved - as more
particularly described jr paraphs 1, 2 and 3 Of the commthication - i.e. fee
simple title in Tract 28, a lien for delinquent taxes assessed to Anglo-California.
National Bank, San Francisco, for the years 1938-1943, inclusive, and a lien for
taxes for all parcels involved in the condemnation action, except Tract 28, for
the fiscal year 1943-1944.
After the pertinent features of this action were explained by the City Attorney,
Councilman Ensrnd moved tne recommendation of the City Attorney be approved
and that a value of 620,000, per acre be claimed by the City for the property in-
volved, plus a value on all mnwovcrIents thereon at the time of taking said
property - the value to be figured on the basis of present replacement costs.
The motion was seconded by Councilman Jones and on roll call carried by the fol-
lowing vote. Ayes: Councilmen. -9ranscheid, Jones, Osborn and President Godfrey,
(4). Noes: None. Absent: Councilman Howe, (1).
tv. From the City Attorney, pertaining to certain action entitled, "UNITED STATES
OF AL12I0A, Plaintiff, vs. Certain Parcels, etc., ALAMEDA BELT LINE, a. corporation,
et al., Defendants, No. 22676-G," and recommending that he be authorized to prepare
and file an answer on behalf of the City, setting forth the City's liens for taxes
and special assessrments in this matter.
As further discussion of the action disclosed the question of whether or not there
is an existing sewer through this property - although City records have not so
determined - and there being no objections, the matter was referred. back to the
City Attorney for a recheck with the City Engineer as to whether or not (9. sewer
does exist in this location.
From the City Attorney, with reference to a. certain court action entitled,
_TED, STATES OF ER=A, Plaintiff, vs. Certain Parcels, etc., ANGLO-C=FORNIA
NATIONAL E4i1N, et al., Defendants, No. 22481-G," and recommending that ]re be au-
thorized to prepare and file an answer on behalf of the City of Alameda, setting
forth the City's interest by requesting reservation of all easements necessary to
maintain the present sewer and power lines in the land subject of condemnation. and
setting forth the City's claims for severance damages in the event that such ease-
ments are not reserved and also claiming and setting forth the City's liens for
taxes and special assessments.
After further verbal explanation of this matter by the City Attorney, Councilman
hranscheid moved the recommendation of the City Attorney be apnroved and that he
be authorized to file an answer containing the specific points as above stipulated.
The motion was seconded by Councilman Osborn and unanimously carried.
6. From Mayor Godfrey, nominating Mr. A. C. Carrington as a member of the Alameda
Defense Council, to function thereon as Chairman of the Civil Protection Committee
for the term expiring June 10, 1944, Er. Carrington succeeds Jr. Joseph M. Long,
resigned.
Councilman Osborn moved the nomination. of Mayor Godfrey be approved and A. C.
Carrington be so appointed. The motion was seconded by Councilman Pranscheid and
unanimously carried.
UNFINISHED BUSINESS:
7. The request of Mr. Thomas T. Callan for a permit to transport gar age from
Government owned property through the streets of Alameda was again presented.
Upon advice from the City Attorney as to the obligation of the City toward the
Alameda City Garbage Association, to whom the City has given the exclusive risght
to collect and transport garbage - in that if the City were to grant to any party
other than the Alameda City Garbage Associationthout that Association's con-
sent, such permit as requested, the City would violate its contract and render
itself liable to damages - Councilman Osborn moved the permit as requested be
denied. The motion was seconded by Councilman Branscheid and unanimously carried..
RESOLUTIONS:
S. The following resolution was introduced by Councilman Jones, who moved its
adoption:
"Resolution No. 2896
Providing Additional Compensation for Certain Officers
and Employees of the City for the Month of July, 1943."
The motion to adopt said resolution was seconded by Councilman Branscheid and on
roll call carried by the following vote. Ayes: CounciLnen Branscheid, Jones,
Osborn and President Godfrey, (4) . Noes: None. Absent: Councilmen Howe, (1).
Thereupon the Mayor declared said resolution duly adopted and passed.
9. The following resolution was introduced by Councilman Branscheid, Who moved
its adoption:
"Resolution No. 2897
Authorizing City Manager to Make Application to the
Nederal Government on Behalf of the City of Alameda,
for Federal Assistance in Reconstruction and Repair
of Damaged Streets."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen 3rarscheid, Jones, Osborn
and President Godfrey, (4) . 'Noes: Hone. Absent: Councilman Howe, (1). There-
upon the —ayor declared said resolution duly adopted and passed.
10. The following resolution was introduced by Councilman Branscheid, who moved
its adoption.:
"Resolution No. 2898
Authorizing City Manager to Make Application to State
Director of Finance on Behalf of the City of Alameda
for State Assistance in the Maintenance of Utilities
of Civilian Defense Units in the City of Alameda."
The motion to adopt said resolution . was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Jones, Osborn
and President Godfrey, (4) . Noes: None. Absent: Councilman Howe, (1) . There-
upon the Mayor declared said resolution duly adopted and passed.
11. The following resolution was introduced by Councilman 3ranscheid, who moved
its adoption:
"Resolution No. 2099
Authorizing City Manag er to Make Application to State
Director of Finance on Behalf of City of Alameda for
State Assistance in 7?econstruction of the Control
Center in the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Osborn and on roll
call carried by the following vote. Ayes: Councilmen Dranscheid, Jones, Osborn
and President Godfrey, (4) . Noes: None. Absent: Councilman Howe, (1) . There-

BILLS:
12. An itemized List of Claims against the City of Alameda and the Fire Depart-
ment thereof in the total amount as follows, was presented to the City Council:

Councilman Branscheid moved the bilis and claims against the City in the amount
listed and itemized in the List of Claims filed with. the City Clerk on Taly 27,
1943, and presented to the Council at this meeting, be allowed and paid. The
motion was seconded by Councilman Tones and an roll cell carried by the follow.-

ADJOURNENT:
13. There being no further business to come before the meeting, the Council
