The roll was called, and Councilmen Godfrey, Maurer, Morris and President Weichhart, (4), were noted present. Absent: Councilman Carrington, (1)• MINUTES: The minutes of the regular meeting of December 21, 1937, were approved as transcribed. WRITTEN COMMUNICATIONS: vl. Fourteen communications were presented from various independent grocers of Alameda, favoring the passage of an ordinance regulating the closing hours and days for retail food stores. The communications were referred to the Committee of the Whole to receive considelt ation at the time the Committee considers the passage of such an ordinance. v2. From the Railroad Commission of the State of California:, announcing the holding of a regional hearing on the matter of increases in rates, fares and charges by railroads on Monday, January 10, 1938, in the State Building at Los Angeles. The communication was ordered filed. 1'3, From Fred E. Stewart, member of the State Board of Equalization for the Second District, extending an invitation to attend a meeting of all alcoholic beverage licensees, which has been called Tor 8 o'clock P.M. January 5, 1938, at the Oakland Auditorium Theatre. After the City Manager, the City Attorney and'as many Members of the City Council as:Tossible were requested to attend, the communication was ordered filed. \14. From Ford E. Samuel, Postmaster,and also from James C. Fogarty, former members ofthe Board of Education, recommending that the new park at Linden Street and Haight Avenue be named after J. B. Lanktree, deceased, former member of the Board of Education. These communications were referred to the Committee of the Whole. Y5. From the League of California Municipalities, in reference to a decision of the Second District Court of Appeals which held that it was a violation of Section 337a of the Penal Code for a person to take bets for transmission to an agent at a licensed California race track, there to be placed by the agent through the peri-mutuel machines. The commu- nication was ordered filed. REPORTS OF COMMITTEES: /6. From the City Manager, in reference to a petition presented to the Council meeting held on October 5, 1937, protesting against the billboard on the south side of Buena Vista Avenue between Chapin and St. Charles Streets, and informing the Council that upon investigation it was found that the property owners adjacent to the sign and directly across the street from it have no objection to it remaining as placed. The communication was ordered filed. /7. From the City Manager and the Chief of Police, certifying that all moneys expended out of the Police Secret Fund hm been used for the purposes as set forth in the Charter. The report was ordered filed. V8, From Jordan & Ticoulet, informing the COuncil that they had made a detailed audit of the cash receipts and cash expenditures of the Bureau of Electricity for the month of November 1937, which agreed with the accounts of the City Treasurer and that the value- of major merchandise equipment was within the restrictions imposed by the Charter, and also that the report prepared by the Bureau dated November 30,1937, and submitted to the Council and City Auditor agrees with the books of account of the Bureau. The report was ordered filed. 9. From the Public Utilities Board Study Committee, recommending that the services of Mr. Lester S. Ready, Engineer, be secured to make an investigation of the methods employed by the Public Utilities Board in conducting its business. Councilman Maurer moved that the recommendation be received and it be referred to the Committee of the Whole for study and for a conference with Mr. Ready, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and. President Weichhart, (4). Noes: None. Absent: Councilman Carrington,(1). UNFINISHED BUSINESS: /10.' The recommendation of the City Planning Board, that the petition for reclassifica- tion of Southeast corner of Central Avenue and. Oak Street, from Business District, Class III, to Business District, Class V, for the purpose of maintaining a service station, be denied, was received from the Committee of the Whole for consideration. Councilman Morris moved that the recommendation be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Maurer, Morris and Presi- dent Weichhart, (3). Noes: Councilman Godfrey, (1). Absent: Councilman Carrington,(1). \al. A report was received from the City Manager concerning communication of Frank A. Gottstein presented to the Council on December 21,1937, in reference to the backing up of sewerage on Webster Street in the vicinity of the San Francisco Bay Airdrome. The report indicated that water from the storm sewer backed up through some of the catch basins on Webster Street on December 18 and 19, on which days there was an abnormally high tide, which condition only exists once a year, Webster Street grade has, gradually bee sinking over a period of years, and that at the present time it is about 9 inches lower than the original grade for a distance of approximately 2000 feet south of the entrance of Posey Tube, and it is the sinking of the grade that is responsible for backing up of the sewerage. The solution of the situation is to raise the grade of Webster Street, the cost of the improvement to be derived from the Gas Tax Fund and it is estimated that funds for this purpose would be available in two years. 12. Councilman Godfrey requested a report on the question of the erection of bill- boards in the vegetable gardens in the west portion of the City, which had been referred to the City Manager at the regular meeting held December 21, 1937. The City Manager informed the Council that a meeting had been arranged to take place within the next few days to discuss the situation with the erectors of the billboards. RESOLUTIONS: 13. Councilman Morris introduced and moved the adoption of "Resolution No. 2220 Consenting to Recordation of Grant of Easement", Councilman Godfrey seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington,(1). 14. Councilman Godfrey introduced and moved the adoption of "Resolution No. 2221 Cancelling City Taxes on Property Acquired by the Alameda Unified School District for School Purposes", Councilman. Maurer seconded the motion, and cn roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris andltesident Weichhart (4). Noes: None. Absent: Councilman Carrington, (1). 15. Councilman Morris introduced and moved the adoption aC Resolution No. 2222 Adopting Plans and Specifications for, and Authorizing the Construction of, 300 Feet of Twelve Foot Chain Link Fence at McKinley Park in the City of Alameda," Councilman Godfrey seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington, (1). 16. Councilman Maurer introduced and moved the adoption of "Resolution No. 2223 Resolution of Acceptance and. Consent to Recordation", Councilman Morris seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington,(1). 17. Councilman Morris introduced and moved the adoption of "Resolution No. 2224 Authorizing Execution of Agreement with Ruth E. Gornick and Arnold E. Cornick, her Husband", Councilman Maurer seconded the motion, and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent; Councilman Carrington,(1). ORDINANCES PASSED: 18. "Ordinance No. New Series Adopting Conveyance to the City of Alameda of Certain Lands", Councilman Maurer moved that the ordinance as read be adopted, seconded by Councilman Morris and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington,(1). 19. "Ordinance No. New Series Reclassifying Property (Property Known as 1333 Pearl Street)", Councilman Godfrey moved that the ordinance as read be adopted, seconded by Councilman Maurer and on roll call carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington,(1). FILING: 20. Financial Statement, Bureau of Electricity, for month of November 1937. 21. Notice of Public Work, closing of portion of Walnut Street. 22. Affidavit of Posting, re closing of portion of Walnut Street. BILLS: 23. An itemized list of claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $706.73.; Police Department, $1280.89; Pound Department, $16.48; Fire Depart- ment, $27.17; Street Department, 319.1O, Health Departmentt $168.54; Park Department, $97.78; Golf Course Department, $198.90; Store Department, $118.03; Social Service Department, $173.97; Initiative Relief Fund, $96.00; Street Improvement Fund, $182.70 and East Bay Municipal Utility District Payments Fund, $2498.44. Councilman Maurer moved, seconded by Councilman Godfrey, that the claims and bills against the City in the amounts as listed and itemized in the List of Claims filed with the City Clerk on January 4, 1938, and presented to the Council at this meeting be allowed and paid. On roll call this motion carried by the following vote: Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman Carrington, (1). 24.
