HELD TUESDAY EVENING JULY 16 1940
The meeting convened at 8:00 o'clock P. M. with President Weichhart presiding.
ROLL CALL:
The roll was called and Councilmen Carrington, Godfrey, Maurer, Morris and
President Weichhart, (5), were noted present.
MINUTES:
1. The minutes of the regular meeting held July 2, 1940, were approved as transcribed.
WRITTEN COMMUNICATIONS:
From the Alameda Chamber of Commerce, enclosing copy of letter addressed to the
Supervisor of Census, regarding Alameda's 1940 Census count and inquiring of the Coun-
cil if it wishes to plan a separate additional census enumeration.
The City Manager explained the correct procedure to be taken for filing a protest of
the census figures with the Census Bureau at Washington, D. C.
Councilman Godfrey moved the City Manager be instructed to compile all available data
and make a formal protest of the 1940 census in Alameda and ask that a census retake
be made if necessary. The motion was seconded by Councilman Carrington and on roll
call carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer,
Morris and President Weichhart, (5). Noes: None. Absent: None.
3. From the Bethlehem Steel Company, advising that Tynan Avenue east of Webster
Street was closed at 5:50 o'clock P. M. July 3, 1940, to 6:15 o'clock P. M. July 4,
1940. A portion of this street is closed once a year in order to maintain it as a
private thoroughfare. There being no objections, the communication was ordered filed.
4. From the East Bay Division League of California Cities, giving notice of the next
regular bi- monthly meeting to be held in San Leandro July 19, 1940, at 7:00 o'clock
P. M. The City Manager was requested to ascertain how many City officials would be
able to attend this meeting and to make the necessary reservations.
5. From the Hollywood Post No. 939, Veterans of Foreign Wars of United States, re-
questing an appropriation of $250.00 from the City of Alameda for expenses in sending
its drill team to the National Convention to be held in Los Angeles in August of this
year.
Councilman Morris moved the request be referred to the Committee of the Whole, seconded
by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen
Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent:
None.
6. From the American Legion Uniformed Bodies Association, Alameda Post No. 9, present-
ing various advantages that might be derived from a campaign to advertise the attrac-
tions of the City of Alameda at the coming State Convention of the American Legion to
be held at San Diego, August 11 to 14, inclusive, and requesting favorable consideration
of publicity campaign therein stated. There being no objections, this communication was
referred to the Committee of the Whole..
ORAL COMMUNICATIONS:

7. Mr. Frank Gottstein addressed the Council with reference to congestion of Oakland
going traffic from Alameda near Oakland entrance to Posey Tube; to congestion of traf-
fic on Webster Street and his suggestion that 8th Street be made a boulevard thorough-
fare thereby taking some of the traffic from Webster Street, and inquiring of the City
Manager what had been done regarding these matters.
The City Manager replied he had so far heard nothing definite from the City Manager and
the Planning Engineer of Oakland regarding congestion at Oakland entrance to Posey Tube,
but expects some information after the next meeting of the Safety Council of the City
of Oakland, and he will then report on the question at the next meeting of the Council.
Upon inquiry of Mr. Gottstein regarding what has been done about investigating the mat-
ter of reducing traffic on Webster Street, the City Manager said he had no opportunity
since he returned from his vacation, to investigate the matter of routing traffic away
from Webster Street but he will have a report on this matter also at the next meeting.
He stated further, there is definite difference of opinion as to the advisability of
the use of pedestrian traffic signs. In his opinion they are a definite benefit and
possibly one or two stop and go signs will be installed on Webster Street, as well as
at the intersection of Buena Vista Avenue and Park Street.
g Mr. Charles H. King, representing the Special Site Sign Company of Oakland, ad-
dressed the Council regarding the license fees for outdoor advertising signs and re-
quested a reduction in the amount of the license fee.
Councilman Morris suggested that as an ordinance is on the agenda for introduction,
pertaining to the matter of licenses for outdoor advertising, this matter be discussed
under the proper heading. Mayor Weichhart stated that Mr. King had been requested to
appear before the meeting to present his case. Mr. King was then requested to await
further discussion on this question under "Introduction of Ordinances ".
REPORTS OF COMMITTEES:
9. An affidavit was presented from the City Manager and the Chief of Police, that
moneys expended out of the Police Secret Fund of the City of Alameda during the period
from December 31, 1939, to June 30, 1940, have been expended in the manner provided by
Section 17 -11 of the Charter of the City of Alameda, for investigation and police work
of a secret character and for no other purposes. There being no objections, the com-
munication was ordered filed.
10. From the City Manager, recommending that Fire Chief Thomas M. Lane, be granted
permission to represent the City of Alameda at the Pacific Coast Association of Fire
Chiefs' Convention, to be held in Tacoma, Washington, July 31, to August 3, 1940, in-
clusive, and that he be allowed an amount not to exceed 480.00 for expenses.
Councilman Morris moved the recommendation of the City Manager be approved, seconded
by Councilman Carrington and on roll call carried by the following vote. Ayes: Coun-
cilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5) . Noes: None.
Absent: None.
11. From the City Manager, recommending that an old discarded hose reel, which was
removed from a piece of equipment of the Alameda Fire Department, be sold to the City
of Hayward for the amount of 02.50, which sum is the amount the City of Hayward has
offered for the reel.
Councilman Maurer moved that the recommendation of the City Manager be approved and the
old reel be sold to the City of Hayward for the sum of 02.50. The motion was seconded
by Councilman Morris and on roll call carried by the following vote. Ayes: Councilmen
Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None. Absent:
None.

12. From the Building Inspector, requesting that the temporary revocable permit is-
sued by the Council to Mrs. Kate M. Stow to conduct a boarding house on premises known
as 1617 Central Avenue be revoked, as the third floor of the building on said premises
is being occupied without fire protection and plumbing has been installed contrary to
regulations of the City.
Mrs. Pauline A. Carver, present owner of the premises, has been notified on several
occasions that City ordinances are being violated.
After discussion, Councilman Maurer moved that the matter of revocation of the tem-
porary permit to operate a boarding house on the premises known as 1617 Central Avenue
be set for hearing on Tuesday evening, August 6, 1940, and the owner of the premises
be notified to appear to show cause, if any she has, why her temporary permit should
not be revoked. The motion was seconded by Councilman Morris and on roll call carried
by the following vote. Ayes: Councilmen_ Carrington, Godfrey, Maurer, Morris and
President Weichhart, (5). Noes: None. Absent: None.
The City Manager stated he would also request the Building Inspector and the Sanitary
Inspector to be present at this hearing to advise the Council what steps had been
taken in notifying Mrs. Carver of her violation of City regulations.
ORDINANCES INTRODUCED:
13. Councilman Godfrey stated that under this heading it would be proper to discuss
the ordinance for outdoor advertising licenses, after which the City Attorney ex-
plained the two ordinances which he had prepared, one of which is to be introduced
at this meeting. The license under one ordinance is based on the gross receipts of
sign rentals and the other, on the square footage of sign area rented.
After detailed discussion of the two ordinances, Councilman Maurer moved to bring the
ordinance, computing the license upon the annual gross receipts of advertising sign
companies, before the Council for action. There was no second to this motion and
after further discussion, Councilman Godfrey offered for introduction
"Ordinance No.
New Series
Amending Sections 548 and 549 and Repealing Sections
550, 551 and 552 of Article 3, Chapter VIII, of
Ordinance No. 1, New Series, Relating to Licenses for
Outdoor Advertising; and Adding New Sections Numbered
550 and 551,"
which ordinance is the same as copy submitted by the City Attorney but with the minimum
license fee beginning at 4100.00 and each license fee thereafter increasing 050.00 with
each subsequent item of annual gross receipts as stated in the scale of annual gross
receipts and license fees incorporated in said ordinance.
The City Clerk then read the revised schedule of gross receipts and corresponding li-
cense fees as determined upon and incorporated in the ordinance as introduced.
Mr. Gottstein addressed the Council at this point on advertising signs.
14. Councilman Carrington introduced the following ordinance, after which it was laid
over under provision of law and the Charter:

15. Councilman Maurer introduced the following ordinance, after which it was laid
over under provision of law and the Charter:

Enlargement, Alteration, Repair, Moving, Removal,
Demolition, Conversion, Occupancy, Equipment, Use,
Height, Area and Maintenance of all Buildings and /or
Structures in the City of Alameda; Providing for the
Issuance of Permits and Collection of Fees Therefor;
Providing Penalties for the Violation Thereof; Re-
pealing Ordinances No. 387, New Series, No. 460, New
Series, No. 530, New Series and No. 551, New Series
and all other Ordinances and Parte of Ordinances in
Conflict Therewith."
UNFINISHED BUSINESS:
16. Councilman Morris stated that at the last regular meeting of the Council he spoke
of the complaint made by Mrs. Cresstetto concerning lumber being dumped on a lot adja-
cent to her property on Brush Street and requested the City Manager to investigate the
matter, as he believed the time had expired within which notice had been given to abate
nuisances by persons dumping this lumber. The City Manager replied he would make a
report in this regard.
NEW BUSINESS:
7. Councilman Morris stated that in line with the present day trend of administrations
making provision for leaves of absence with pay for those employees who may be either
called for military service or volunteer for military training, he moved the City
Attorney be directed to prepare the necessary amendments to the pension ordinance and
to the civil service ordinance to provide for thirty days leave with pay and to pre-
serve the civil service and pension status of said employees of the City of Alameda.
The motion was seconded by Councilman Carrington and on roll call carried by the fol-
lowing vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President
Weichhart, (5). Noes: None. Absent: None.
RESOLUTIONS
18. Councilman Godfrey introduced and moved the adoption of
"Resolution No. 2501
Providing for the Amount per Diem for Officers and
Employees of the City of Alameda for Traveling
Expenses."
Councilman Carrington seconded the motion and on roll call carried by the following
vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart,
(5). Noes: None. Absent: None.
19. Councilman Morris introduced and moved the adoption of
"Resolution No. 2502
Awarding Contract for Legal Advertising to Times -
Star Publishing Company for Fiscal Year 1940 - 1941."
Councilman Godfrey seconded the motion and on roll call carried by the following vote.
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5).
Noes: None. Absent: None.
20. Councilman Maurer introduced and moved the adoption of
"Resolution No. 2503
Resolution of Intention to Close Portions of Clay
Street and Fillmore Street in the City of Alameda."
Councilman Godfrey seconded the motion and on roll call carried by the following vote.
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5).
Noes: None. Absent: None.
ORDINANCES FOR PASSAGE:

Councilman Carrington moved that this matter be continued until the regular meeting of
the Council to be held August 6, 1940. The motion was seconded by Councilman Morris
and carried unanimously.

25. An itemized list of claims against the City of Alameda and the several depart-
ments thereof in the total amounts as follows, was presented to the City Council:

Councilman Godfrey moved that the claims and bills against the City in the amounts
listed and itemized in the List of Claims filed with the City Clerk on July 16, 1940,
and presented to the Council at this meeting, be allowed and paid. The motion was
seconded by Councilman Morris and on roll call carried by the following vote. Ayes:

None. Absent: None.
26. There being no further business to come before the Council, the meeting adjourned
