HELD TUESDAY EVENING NOVEMBER 19, 1940
The meeting convened at 8:00 o'clock P. M. with President Weichhart. presiding.
ROLL CALL:
The roll was called and. Councilmen Carrington, Godfrey, Maurer, Morris and. Presi
dent Weichhart, (5), were noted present.
MINUTES:
1. The minutes of the regular meeting of November 6, 1940, and the adjourned regular
meeting of November 8, 1940, were approved as transcribed.
WRITTEN COMMUNICATIONS:
2. From Faulkner, Oakes and Faulkner, requesting an opportunity to submit a proposal
covering auditing of City records when this matter again receives the attention of the
Council. There being no objections, the communication was ordered filed.

3. From the Fernside Home Owners' Association, requesting that new street lights be
installed in the Fernside Tract, similar to those in the Fernside Marina District.
There being no objections, the communication was ordered filed.
4. From A. Martine, requesting the refund of a 2.00 fee paid for permit to construct
a greenhouse at 2915 Fernside Boulevard. This communication was accompanied by a let-
ter from the Building Inspector explaining that the time limit within which this struc-
ture should have been erected had expired and giving his opinion that the refund of
this fee was entirely at the discretion of the Council. There being no objections,
the matter was referred to the City Attorney for recommendation.
5. At this time, Councilman Maurer moved the request of the Fernside Home Owner's
Association for new street lighting standards in the Fernside District, be referred to
the Committee of the Whole for further consideration. There being no objections, this
was so ordered.
6. From the Pacific Bridge Company, requesting a permit from the City Council to
erect a seven-foot fence around property now occupied by it on the northerly line of
Clement Avenue between Stanford and. Willow Streets.
The City Manager recommended this permit be granted. Thereupon, Councilman Maurer moved,
seconded by Councilman Carrington, that permit be granted to Pacific Bridge Company to
erect a seven-foot fence around above mentioned property. On roll call the motion
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and. President Weichhart, (5). Noes: None. Absent: None.
ORAL COMMUNICATIONS:
7. Mayor Weichhart inquired if anyone in the audience wished to address the Council
on any matters other than the proposed regulations of traffic in Posey Tube, saying
that matter would come up later in the program.
HEARINGS:
The matter of the proposed traffic restriction in Posey Tube was continued from
the regular meeting of the Council held. November 6, 1940.
The Clerk announced having received communicationsof protest against the rumored traffic
restrictions from the following: Naval Air Station, Encinal Terminals, two letters
from Bethlehem Steel Company, N. Clark & Sons, Tide Water Associated Oil Company,
Independent Grocers' Alliance Distributors, Inc., and General Engineering and. Dry Dock
Company.
The Mayor requested the City Manager to make a report on this matter as follows:
"The investigation now being conducted by the City of Alameda and. City of Oakland,
regarding truck traffic in Posey Tube, has not been completed. We are not in a posi-
tion at this time to make a definite recommendation regarding limiting truck traffic
through the Tube during certain periods. I have had several meetings with represen-
tatives of industries and interests affected by the proposed ordinances and. I will
continue to meet with representatives of the City of Oakland, the Naval Air Station,
the Draymen's Association and various industries interested and believe that a satis-
factory solution to the problem can be worked out. I recommend that your Honorable
Body take no action on the proposed ordinance at this time, but continue the hearing
until a later date when a complete report can be presented to you.
Mr. E. H. Hart, representing the Draymen's Association of Alameda County, addressed the
Council in opposition to prohibiting trucks from using Posey Tube during the peak hours
and spoke on various other phases of transportation through the Tube relative to re-
ceiving building materials and supplies promptly by Alameda Industries and the Naval
Air Station,

it is his intention to confer further on this matter with repre-

and members of various industrial organizations in Alameda and. Oakland with the object
in mind of arriving at some satisfactory agreement with regard to regulating truck
traffic through Posey Tube.
Councilman Morris stated that as the City Manager has said, further consideration and
serious deliberation will be given this matter; whereas various letters of protest
have been sent in by interested industries, no practical suggestions have been offered
in solution of the problem. Further time must be allowed for additional study whereby
some concrete suggestions may be submitted which will definitely solve these traffic
problems. This is too important a question before the Council, for it to be stampeded
into immediate action. It is self-evident that reasonable concessions must be made by
the protesting industries. Councilman Morris advised the protestants not to be unduly
impressed by the seeming delay in reaching a solution of the problem at this time.
Mr. Rosefield addressed the Council along this same general topic.
Councilman Morris then moved the regular order of business be suspended by unanimous
consent and the Council proceed under the heading of "Ordinances Passed". The motion
was seconded by Councilman Maurer and _unanimously carried.

Accepting Grant of Easement from Alameda Belt Line

Councilman Godfrey moved the ordinance as read be adopted. The motion was seconded by
Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen
Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None.

An Ordinance Amending Section 17-344 of the
Alameda Municipal Code by Adding Thereto
Subdivisions (15) to (29) Inclusive."
Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by
Councilman Carrington and on roll call carried by the following vote. Ayes: Council-
men Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5). Noes: None.

11. "Ordinance No. 738
New Series
Amending Article 3, of Chapter 5, Title XVII of the
Alameda Municipal Code by Adding Sections 17-5322
and 17-5323 Regulating Transportation of Flammable
Liquids and Explosives in Posey Tube."
Councilman Carrington moved the ordinance as read be adopted. The motion was seconded
by Councilman Maurer and on roll call carried by the following vote. Ayes: Council-
men Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes: None.

Amending Article 3, of Chapter 5, Title XVII of the
Alameda Municipal Code by Adding Section 17-5324
Prohibiting Certain Vehicles in the Posey Tube
During Certain Hours."
Councilman Morris moved that consideration of the above titled ordinance be continued
until the next regular meeting of the Council.
Mr. C. C. Howard addressed the Council regarding transportation in Posey Tube and in
general. Mr. Gottstein again addressed the Council on the matter.
Councilman Godfrey made the statement that while he is willing to vote for continu-
ance of the matter until the next meeting of the Council, he wishes to go on record
as still being very much of the opinion that truck traffic in the Tube must definitely
be regulated, but he is also willing to listen to statements and suggestions of the
people who are responsible for this congested condition.
The motion was seconded by Councilman Carrington and on roll call carried by the fol-
lowing vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and President
Weichhart, (5). Noes: None. Absent: None.
Councilman Godfrey now moved the Council return to the regular order of business. The
motion was seconded by Councilman Morris and unanimously carried.
OPENING OF BIDS:
f3. Bids were presented and opened for the furnishing of one new 1941 Model, steel
cab Pick-up Truck to the City of Alameda, for use at the Golf Course, as follows:

There being no objections these bids were referred to the City Manager and City Attorney
for study and recommendation.
After perusal, the City Manager recommended that contract for furnishing this truck to
the City be awarded to Doherty Bros. at the price as stated in its bid.
Councilman Godfrey then moved the recommendation of the City Manager be adopted; that
contract be awarded to Doherty Bros. at price bid and checks be returned to the un-
successful bidders. The motion was seconded by Councilman Carrington and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None.
REPORTS OF COMMITTEES:
14. From Wallace Merriam, tendering his resignation as a member of the Retirement
Board of the City of Alameda, to take effect at the Council's earliest convenience.
Councilman Maurer moved the resignation of Mr. Merriam be accepted with regret,
seconded by Councilman Carrington and on roll call carried by the following vote. Ayes:
Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes:
None. Absent: None.
15. From the City Planning Board, submitting its report and recommendation on petitions
to reclassify certain property lying on the westerly line of 9th Street, 56 feet south
of Central Avenue, with a frontage of 54 feet and property lying on the southerly line
of Central Avenue, beginning 89 feet west of 9th Street, with a frontage of 31 feet,
from Residential to Commercial use.
On account of illness, continuation of this matter until the next regular meeting of
the Council was requested by Judge E. J. Silver, Attorney for the petitioners.
Councilman Morris moved consideration of this re-zoning matter be continued until the
next regular meeting of the Council, seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None.
16. From the City Manager, recommending the Council pass a motion requesting the City
of Oakland to eliminate all left turns at 7th and Harrison Streets and 8th and Harri-
son Streets and to investigate the possibility of widening of 6th Street in order to
allow right turns to be made at the Oakland Portal to Posey Tube.
Councilman Maurer moved the recommendation of the City Manager be adopted, seconded
by Councilman Carrington and on roll call carried by the following vote. Ayes:
Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5). Noes:
None. •Absent: None.
17. Councilman Morris stated he had several times expressed to the Council his belief
in the necessity of prohibiting parking on the east side of Harrison Street, Oakland,
for at least several blocks above 7th Street and moved the Council of the City of Ala-
meda go on record as requesting the Oakland City Council to take the necessary steps
to prohibit parking on the east side of Harrison from the Oakland entrance to Posey
Tube to llth Street. The motion was seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None.
RESOLUTIONS:
18. The following resolution was introduced by Councilman Carrington, who moved its
adoption:
"Resolution No. 2537
Adopting Specifications for Furnishing Lighting
Standards to the City of Alameda, Calling for Bids
and Directing the City Clerk to Advertise the Same."
The motion to adopt said resolution was seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly adopted and passed.
The City Manager explained that the lighting standards purchased under this bid would
be for the installation of lights on Santa Clara Avenue from Broadway to High Street,
on Park Street from Clement Avenue to Blanding Avenue and on Central Avenue, from
Webster Street east as far as possible.
19. The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2538
Accepting Conveyance from the Regents of the University
of California of Certain Lands for Highway Purposes and
Consenting to the Recordation Thereof."
The motion, to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and. President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly adopted and passed.
20. The following resolution was introduced by Councilman Carrington who moved its
adoption:
"Resolution No. 2539
Accepting Conveyance from Delfina Carpaneto of Certain
Lands for Highway Purposes and. Consenting to the
Recordation Thereof."
The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly adopted and passed.
21. The following resolution was introduced by Councilman Carrington who moved its
adoption:
"Resolution No. 2540
Accepting Conveyance from Delfina Carpaneto of Certain
Lands for Highway Purposes and Consenting to the
Recordation Thereof."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call

and President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly adopted and passed.
22. The following resolution was introduced by 'ounciIman Maurer who moved its adoption:

Accepting Conveyance from Giuseppe Carpaneto and. Maria
Carpaneto of Certain Lands for Highway Purposes and.
Consenting to the Recordation Thereof."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly adopted and passed.
23. The following resolution was introduced by Councilman Morris who moved its adoption:
"Resolution No. 2542
Approving Application of Key System for Operation
of Commuter Service in the City of Alameda."
The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Godfrey, Maurer, Morris
and President Weichhart, (5). Noes: None. Absent: None. ,Thereupon the Mayor de-
clared said resolution duly adopted and passed.

27. An itemized list of claims against the City of Alameda and the several departments
thereof in the total amounts as follows, was presented to the City Council: General

Health Department, $135.05; Recreation Department, 229.44; Park Department, $623.13;

Councilman Godfrey moved that the bills and claims against the City in the amounts
listed and itemized in the List of Claims filed with the City Clerk on November 19,
1940, and presented to the Council at this meeting, be allowed and paid. The motion
was seconded by Councilman Carrington and on roll call carried by the following vote.
Ayes: Councilmen Carrington, Godfrey, Maurer, Morris and. President Weichhart, (5).
Noes: None. Absent: None.
28. There being no further business to come before the Council, the meeting adjourned
to meet in regular session on Tuesday evening, December 3, 1940, at 8:00 o'clock P. M.
