HELD TUESDAY EVENING, DECEMBER 3, 1940
The meeting convened at 8:00 o'clock P. M. with President Weichhart presiding.
ROLL CALL:
The roll was called and Councilmen Godfrey, Maurer, Morris and President Weichhart,
(4), were noted present. Absent: Councilman Carrington, (1).
MINUJ!J„S:
1. The minutes of the regular meeting of November 19, 1940, were approved as trans-
cribed.
WRITTEN COMMUNICATIONS:
From Mr. J. F. Hassler, City Manager of Oakland, setting forth the action taken
by the Traffic Committee, and approved by the Council of the City of Oakland, with
regard to prohibiting parking on both sides of Harrison Street between 6th and 8th
Streets and also the elimination of left turns at 7th, 8th and 9th and. Harrison Streets.
This communication was accompanied by a blueprint sketch of the tentative plan now being
considered by the Traffic Committee of Oakland to alleviate congestion at the Oakland
entrance to Posey Tube.
Councilman Godfrey stated it would be well to refer this letter and drawing to the Com-
mittee of the Whole for further consideration.

3. From Alameda County Mosquito Abatement District, requesting the Council to appoint
a Trustee to represent the City of Alameda for a term of two years beginning January 2,
1941.
The City Attorney was authorized to draw up the necessary resolution naming the appointee.
There being no objections, the communication was ordered filed.
4. From the Boy Scouts of America, requesting the use of the Council Chambers on Wed-
nesday evening, January 15, 1941, for the Annual Meeting of Council Members.
The City Attorney stated this particular date was that on which the City Planning Board
regularly met. It was suggested Mr. Barley, Scout Executive, contact the City Manager
and arrange for an evening on which there were no scheduled meetings.
Councilman Maurer moved the Boy Scouts of America be granted the use of the Council
Chambers some time in January which would be satisfactory and convenient to all con-
cerned. Councilman Godfrey seconded the motion and it was unanimously carried.

5. From Frank A. Gottstein, re sewage and drainage conditions on Webster Street.
There being no objections, the letter was ordered filed.
ORAL COMMUNICATIONS:
Judge Edward J. Silver addressed the Council, requesting that the matter of the
proposed reclassification of property at 9th Street and Central Avenue, scheduled for
consideration at this meeting, be postponed until the next regular meeting of the
Council to be held December 17, 1940. Judge Silver was assured there were no objec-
tions to laying this matter over until the next meeting.
7. Mr. Frank Gottstein addressed the Council, stating the City Manager should re-
quest the Oakland officials to have a sign put up at 7th and Harrison Streets, Oak-
land, notifying that a right hand turn against the red signal was permitted.
The City Manager stated he understood such a sign had been ordered and would probably
be installed very shortly.
HEARINGS:
8. The matter of the proposed restriction of truck traffic through Posey Tube was
continued from the regular meeting of November 19, 1940.
As had been suggested at the last meeting of the Council, a meeting was held at the
Naval Air Station to discuss possible solution of traffic problem. The following
representatives were present: Mr. Ben Morris, President of the Truck Owners Associa-
tion, Mr. E. H. Hart, Secretary-Treasurer of the Draymens' Association of Alameda
County, Mr. J. F. Hassler, City Manager of Oakland, Mr. John Marr, Planning Engineer
of Oakland, Mr. A. B. Moffitt of the Tide Water Associated Oil Company, dommander E.
C. Seibert of the Naval Air Station, Mr. Irwin F. Kurtz, of Bethlehem Steel Corpora-
tion, Mr. Van Horn, President of Encinal Terminals and others.
The City Manager reported that while there are still some heavy, slow-moving trucks
causing congestion in the Tube, there are not as many as there were a year ago, ac-
cording to recent survey figures.
The representatives of the various industries concerned, agreed to definitely see
that their trucks maintained a sufficient speed to keep traffic moving through the
Tube.
The City Manager stated he felt a satisfactory solution at this time would be the passage
of an ordinance, for at least a trial period, establishing a minimum speed limit of ten
miles per hour through the Tube, in view of the fact that all trucking interests have
signified their willingness to cooperate in adhering to this minimum speed.
OPENING OF BIDS:
9. Bids were presented and opened for furnishing 120 Street Lighting Standards to the
City of Alameda, as follows:
From Pacific Union Marbelite Co. $14,690.20
Accompanied by cashier's check in amount of 1,500.00
From Taper Tube Pole Co. 14,275.80
Accompanied by certified check in amount of 1,500.00
There being no objections, the bids were referred to the City Manager and City Attorney
for study and recommendation. After examination, the City Manager recommended contract
for furnishing 120 Street Lighting Standards to the City of Alameda be awarded to Taper
Tube Pole Co.
Councilman Maurer moved the recommendation of the City Manager be adopted; that con-
tract for furnishing 120 Street Lighting Standards to the City be awarded to Taper Tube
Pole Co. at its total bid price of $14,275.80 and check be returned to the unsuccessful
bidder. The motion was seconded by Councilman Morris and on roll call carried by the
following vote. Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4)
Noes: None. Absent: Councilman Carrington, (1).
REPORTS OF COMMITTEES:
10. The Mayor, City Manager and Auditor, submitted a report on the count of money,
taken November 27, 1940, stating there was at that time in the City Treasury the sum
of $565,125.37. There being no objections, the report was accepted and ordered filed.
11. At this time Councilman Maurer moved that consideration of the Report and Recom-
mendation from the City Planning Board concerning denial of proposed reclassification
of property at 9th Street and Central Avenue, scheduled for discussion under this head-
ing, be put over until the next meeting of the Council. The motion was seconded by
Councilman Morris and on roll call carried by the following vote. Ayes: Councilmen
Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Council-
man Carrington, (1).

12. From the City Attorney, with regard to the requested refund of a $2.00 fee paid by
Mr. A. Martine for a building permit to erect a greenhouse at 2915 Fernside Boulevard,
stating the Council has no authority to refund any portion of a fee paid for a building
permit.
Councilman Morris moved, seconded by Councilman Maurer, that refund of this $2.00 fee
be denied. On roll call the motion carried by the following vote. Ayes: Councilmen
Godfrey, Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Council-
man Carrington, (1).
ORDINANCES INTRODUCED:
13. Councilman Maurer introduced the following ordinance, after which it was laid
over under provision of law and the Charter:
"Ordinance No.
New Series
An Ordinance Amending Section 17-538 of the Alameda
Municipal Code and Adding Section 17-538i to Said
Code Regulating Speed in the Posey Tube."
UNFINISHED BUSINESS:
14. The City Manager stated that at the last regular meeting, the Council had received
bids for furnishing one new 1/2 ton Pick-up Truck for the Golf Course and upon his
recommendation, contract had been awarded to Doherty Bros. However, it was later dis-
covered this proposal did not meet Specifications.
Therefore, at this time the City Manager recommended the Council rescind its former
action and award contract for furnishing this 1/2 ton Pick-up Truck to F. H. Dailey
Motor Co., the next low bidder at the price of $425.37.
Councilman Maurer moved the action of the Council taken at its regular meeting of No-
vember 19, 1940, in awarding contract for Pick-up Truck to Doherty Bros., be rescinded.
The motion was seconded by Councilman Morris and on roll call carried by the following
vote. Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4). Noes:
None. Absent: Councilman Carrington, (1).
Councilman Maurer then moved the recommendation of the City Manager be adopted; that
contract for furnishing one 1941 model, 1/2 ton Pick-up Truck be awarded to F. H.
Dailey Motor Co. at the bid price of $425.37. The motion was seconded by Councilman
Morris and on roll call carried by the following vote. Ayes: Councilmen Godfrey,
Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman
Carrington, (1).
RESOLUTIONS:
15, The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2543
Adopting Specifications for Furnishing Five Two-Door
Sedans to the City of Alameda, Calling for Bids and
Directing the City Clerk to Advertise the Same."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Maurer, Morris and President
Weichhart,, (4). Noes: None. Absent: Councilman Carrington, (1). Thereupon the
Mayor declared said resolution duly adopted and passed.
16. The following resolution was introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2544
Cancelling City Taxes on Real Property Acquired by
the Veterans' Welfare Board of the State of California."
The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Maurer, Morris and President
Weichhart, (4). Noes: None, Absent: Councilman Carrington, (1 ) Thereupon the
Mayor declared said resolution duly adopted and passed.
17. The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2545
Cancelling City Taxes on Real Property Acquired by
the Veterans' Welfare Board of the State of California."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Maurer, Morris and President
Weichhart, (4). Noes: 'None. Absent: Councilman Carrington, (1). Thereupon the
Mayor declared said resolution duly adopted and passed.
18. The following resolution was introduced by Councilman Morris, who moved its
adoption:

Dedicating Certain Lands for Highway Purposes and
Designating the Same as "Main Street".
The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Maurer, Morris and President
Weichhart, (4). Noes: None. Absent: Councilman Carrington, (1). Thereupon the
Mayor declared said resolution duly adopted and passed.
19. The following resolution was introduced by Councilman Maurer, who moved its
adoption:

Designating Certain Lands Dedicated for Highway

The motion to adopt said resolution was seconded by Councilman Morris and on roll call

20. The following resolution was introduced by Councilman Godfrey, who moved its

The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Maurer Morris and President

Mayor declared said resolution duly adopted and passed.
21. The following resolution was introduced by Councilman Maurer, who moved its
adoption:
"Resolution No. 2549
Designating Certain Lands Dedicated for Highway
Purposes as "Atlantic Avenue".
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Maurer Morris and President
Weichhart, (4). Noes: None, Absent: Councilman Carrington, (1)'. Thereupon the
Mayor declared said resolution duly adopted and passed.
ORDINANCES PASSED:
22. "Ordinance No.
New Series
Amending Article 3, of Chapter 5, of Title XVII
of the Alameda Municipal Code by Adding Section
17-5324 Prohibiting Certain Vehicles in the
Posey Tube During Certain Hours."
Councilman Morris stated that pending a practical demonstration of the efficiency of
the proposed increasing of the minimum speed limit through Posey Tube and the volun-
tary restrictions to be offered by the various trucking interests as a solution to
the congested traffic condition in the Tube, he would move that the above titled or-
dinance be tabled. He stated further, he is doing this with a definite idea of await-
ing satisfactory results and if this attempt is not effective he is definitely in
favor of going on record as being exactly in accord with restrictions of the above
titled ordinance.
Being fully in accord with the motion as made by Councilman Morris and with the re-
marks that accompanied it, Councilman Godfrey stated he would second the motion. On
roll call the motion carried by the following vote. Ayes: Councilmen Godfrey,
Maurer, Morris and President Weichhart, (4). Noes: None. Absent: Councilman
Carrington, (1).

27. An itemized list of claims against the City of Alameda and the several depart-
ments thereof in the total amounts as follows, was presented to the City Council:
General Departments, $2,474.42; Police Department, $344.69; Civil Service Depart-
ment, 09.41; Pound Department, $1.63; Fire Department, $341.67; Street Department,
432,699.64; Health Department, $25.10; Recreation Department, 063.82; Park Depart-
ment, $1,198.16; Golf Course Department, $140.03; Store Department, 077.01;
Social Service Department, 045.79; Initiative Relief Fund, 115.00; Street Im-
provement Fund, 0786.00; Gas Tax Fund, No. 2, $5,429.36.
Councilman Godfrey moved that the bills and claims against the City in the amounts
listed,, itemized and amended in the List of Claims filed with the City Clerk on
December 3, 1940, and presented to the Council at this meeting, be allowed and paid.
The motion was seconded by Councilman Morris and on roll call carried by the follow-
ing vote. Ayes: Councilmen Godfrey, Maurer, Morris and President Weichhart, (4).
Noes: None. Absent: Councilman Carrington, (1).
28. Councilman Morris moved the meeting be adjourned to assemble in regular session
on Tuesday evening, December 17, 1940, at 8:00 o'clock P. M.
