HELD TUESDAY EVENING, DECEMBER 17 1940
The meeting convened at 8:00 o'clock P. M. with President Weichhart presiding.
ROLL CALL:
The roll was called and Councilmen Carrington, Morris and President Weichhart,
were noted present. Absent: Councilmen Godfrey and Maurer, (2).
MINUTES:
1. The minutes of the regular meeting held December 3, 1940, were approved as
transcribed.
WRITTEN COMMUNICATIONS:
. A petition was presented from the Veterans' Welfare Board of the State of Cali-
fornia, requesting the cancellation of taxes on certain property in the City of Alameda.
There being no objections, the matter was referred to "Resolutions" and the petition
ordered filed.
3. At this time, Mr. S. C. Wright stated that on behalf of Messrs. Wynn Meredith,
Albert C. Agnew, Frank C. Stratford and Robert E. Christy, he respectively requested
permission to file a statement with the Council pertaining to the proposed Tube-Bridge
controversy, and asked that copies be made in order that the members may be apprised
of the details.
The City Manager stated he would see that copies were made available to the Council
members.
ORAL COMMUNICATIONS:
4. Mr. Frank Gottstein brought up the matter of the absence of a sign permitting a
right hand turn against the red signal at 7th and Harrison Streets, Oakland.
The City Manager stated an ordinance governing this matter was before the Council of
the City of Oakland for adoption and as soon as it is passed it will be in force immedi-
ately. Signs will then be erected and this problem eliminated.
5. Mr. Frank T. Correia addressed the Council concerning a lot at the foot of Park
Avenue.
Mayor Weichhart suggested he take the matter up with the City Manager so that details
could be presented to the Council for its information before any action was taken. •
OPENING OF BIDS:

6. Bids were presented and opened for furnishing five Four-Door Sedans to the City
of Alameda for use in the Police Department, as follows:
From Tom Henderson, Inc. $1,887.40
Accompanied by certified check in amount of 352.74
From Doherty Bros. 1,795.73
Accompanied by cashier's check in amount of 385.00
There being no objections, the bids were referred to the City Manager and City Attorney
for examination and recommendation.
REPORTS OF COMMITTEES:
7. From the City Planning Board, submitting its Report and Recommendation concerning
requested reclassification of two pieces of property on the westerly line of 9th Street,
south of Central Avenue and one piece of property on the southerly line of Central
Avenue, west of 9th Street, from Residential to Commercial District to allow construc-
tion of a drive-in market.
Judge Edward J. Silver, addressed the Council, giving details concerning the filing of
these petition and urging the reclassification be granted.
Mr. Homer Coffman spoke in protest of the proposed re-zoning of these properties.
Mr. A. W. Stauber, Manager of the Real Estate Department of the Safeway Stores, ad-
dressed the Council, presenting estimates and plans of the contemplated market.
After further discussion and a careful study of the zoning map, Councilman Carrington
stated he felt the Planning Board had gone into the matter very thoroughly before mak-
ing its recommendation. The Board had spent a great deal of time and the City had
expended considerable money in setting up the present zoning ordinance and, while he
believes the Planning Board and. Council will, at some future time, have to consider
re-zoning certain sections of the City for drive-in markets as they are the coming
thing, nevertheless he is opposed to granting this reclassification under the present
zoning regulations.
Mayor Weichhart stated he had every faith in the judgment of the Planning Board and did
not feel he should take any issue with it at this time. The zoning ordinance had been
discussed at joint meetings of the Planning Board and. Council and he believed the Coun-
cil must adhere to the Board's opinion in this matter.
Councilman Morris moved the recommendation of the City Planning Board be approved; that
reclassification of the properties in question be denied. The motion was seconded by
Councilman Carrington and on roll call carried by the following vote. Ayes: Council-
men Carrington, Morris and. President Weichhart, (3). Noes: None. Absent: Councilmen
Godfrey and. Maurer, (2).
ORDINANCES INTRODUCED:
8. Councilman Morris introduced the following ordinance, after which it was laid
over under provision of law and the Charter:
"Ordinance No.
New Series
An Ordinance Repealing Sections 17-441 and 17-442
of Article 4, Chapter 4, of Title XVII of the Alameda
Municipal Code and. Adding to Article 4, Chapter 4, of
Title XVII of the Alameda Municipal Code Two New Sec-
tions Numbered 17-441 and 17-442."
UNFINISHED BUSINESS:
9. Councilman Morris stated that some time ago he had said he would submit a proposal
before the next municipal election, for a Charter amendment changing the date of our
municipal election from March of every odd numbered year to coincide with that of the
November General Election held every even numbered year. He stated further he contem-
plates making a motion at the next regular meeting of the Council that the City Attorney
be directed to draw up the necessary document to introduce a Charter amendment to this
effect.
Councilman Morris said he had obtained certain data and was procuring more concerning
the comparative cost and percentage of actual votes cast between a City election and
when combined with a general election.

10. Councilman Carrington inquired of the City Attorney concerning an ordinance govern-
ing distribution of handbills and also establishing business licenses. He stated there
has been discussion upon these two subjects at various times but believed the matters
should be definitely acted upon by the adoption of ordinances which could be enforced.
The City Attorney stated the adoption of a tax ordinance is much more important than
establishing business licenses.
Councilman Carrington reiterated the passing of an ordinance regulating the distribu-
tion of handbills should be taken care of and suggested that such be prepared for
adoption. He also stated it was his belief that several matters pending in the Com-
mittee of the Whole File should be disposed of by the present Council.
RESOLUTIONS:
11. The following resolution was introduced by Councilman Carrington, who moved its
adoption:

Appointing Burnett Hamilton on Board of Trustees
of the Alameda County Mosquito Abatement District."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Morris and President
Weichhart, (3). Noes: None. Absent: Councilmen Godfrey and. Maurer, (2). Thereupon
the Mayor declared said resolution duly adopted and passed.
12. The following resolution was introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2551
Appointing Member of Retirement Board."
The motion to adopt said resolution was seconded by Councilman Carrington and on roll
call carried by the following vote. Ayes: Councilmen Carrington, Morris and President
Weichhart, (3) . Noes: None. Absent: Councilmen Godfrey and. Maurer, (2) . Thereupon
the Mayor declared said resolution duly adopted and passed.
13. The following resolution was introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2552
Fixing Salary of Junior Stenographer-Clerk."
The motion to adopt said resolution was seconded by Councilman Carrington and on roll
call carried by the following vote. Ayes: Councilmen Carrington, Morris and President
Weichhart, (3) . Noes: None. Absent: Councilmen Godfrey and Maurer, (2) . Thereupon
the Mayor declared said resolution duly adopted and passed.
14. The following resolution was introduced by Councilman Carrington, who moved its
adoption:
"Resolution No. 2553
Adopting Specifications for Furnishing One (1) Four-
Door Sedan to the City of Alameda, Calling for Bids
and Directing the City Clerk to Advertise the Same."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Morris and President
Weichhart, (3) . Noes: None. Absent: Councilmen Godfrey and Maurer, (2) . Thereupon
the Mayor declared said resolution duly adopted and passed.
15. The following resolution was introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2554
Adopting Specifications for Furnishing One (1)
Combination Pumping Engine, Hose Carrier, Salvage
Unit and Booster Pump Water Tank Assembly to the
City of Alameda, Calling for Bids and Directing
the City Clerk to Advertise the Same."
The motion to adopt said resolution was seconded by Councilman Carrington and on roll
call carried by the following vote. Ayes: Councilmen Carrington, Morris and President
Weichhart, (3). Noes: None. Absent: Councilmen Godfrey and Maurer, (2). Thereupon
the Mayor declared said resolution duly adopted and passed.
16. The following resolution was introduced by Councilman Carrington, who moved its
adoption:
"Resolution No. 2555
Cancelling City Taxes on Real Property Acquired
by the Veterans' Welfare Board of the State of
California."
The motion to adopt said resolution was seconded by Councilman Morris and on roll call
carried by the following vote. Ayes: Councilmen Carrington, Morris and President
Weichhart, (3). Noes: None. Absent: Councilmen Godfrey and Maurer, (2). Thereupon
the Mayor declared said resolution duly adopted and passed.
17. With reference to the resolution about to be introduced, the City Manager stated
the Committees appointed by the Mayors of the Cities of Oakland and Alameda, recom-
mended that an official resolution be passed by the City Councils of the two Cities
and the Board of Supervisors of Alameda County, making request to the Government for
funds to build an additional connection between the two Cities and also that, at the
proper time, representatives be sent to Washington to contact proper Governmental
Agencies. He stated further, that a similar resolution had already been adopted by
the Board of Supervisors of Alameda County and the Council of the City of Oakland.
The following resolution was then introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2556
Urging that Funds be Made Available From the National
Defense Appropriations for the Construction of a New
Highway Connection Between Oakland and Alameda."
The motion to adopt said resolution was seconded by Councilman Carrington and upon
roll call carried by the following vote. Ayes: Councilmen Carrington, Morris and
President Weichhart, (3). Noes: None. Absent: Councilmen Godfrey and Maurer, (2).
Thereupon the Mayor declared said resolution duly adopted and passed.
ORDINANCES PASSED:
18.
"Ordinance No. 739
New Series
An Ordinance Amending Section 17-538 of the Alameda
Municipal Code and Adding Section 17-538 to Said
Code Regulating Speed in the Posey Tube."
Councilman Morris moved the ordinance as read be adopted, seconded by Councilman
Carrington.
At this point, Councilman Morris stated that within the very near future another sur-
vey should be taken of traffic conditions in this vicinity to determine if any improve-
ment were manifest and if a definite improvement was not apparent the Council may still
have to seriously consider the passage of the original ordinance restricting truck
traffic through Posey Tube during certain hours.
The City Manager stated that the County man on duty reports conditions are better but
that another check is to be made the latter part of this week or the first part of
next, to ascertain the present situation. It is intended that a close check be kept
on the traffic condition from time to time. Truck operators have shown every will-
ingness to cooperate.
A discussion was held concerning various steps taken to clear up traffic situation
on Oakland side of Posey Tube - elimination of parking on both side of Harrison
Street between 6th and 8th Streets and prohibition of left-hand turns at 7th, 8th and
9th and Harrison Streets.
Roll was then called and the ordinance was adopted by the following vote. Ayes:
Councilmen Carrington, Morris and President Weichhart, (3). Noes: None. Absent:
Councilmen Godfrey and. Maurer, (2).
FILING:
19. Affidavit of Publication - Notice to Bidders - Furnishing Five Four-Door
Sedans to Police Department.
BILLS:
20. An itemized list of claims against the City of Alameda and the several depart-
ments thereof in the total amounts as follows, was presented to the City Council:
General Departments, $5,699.26; Police Department, $244.04; Civil Service Depart-
ment, $80.91; Pound. Department, $37.16; Fire Department, $268.38; Street Depart-
ment, $1,179.85; Health Department, $211.91; Recreation Department, $42.02; Park
Department, $1,377.49; Golf Course Department, $619.04; Store Department, $120.73;
Social Service Department, $78.45; Initiative Relief Fund, $51.75; Street Improve-
ment Fund, $436.02; Gas Tax Fund, No. 2, $186.32; East Bay Municipal Utility
District, $2,307.61.
Councilman Carrington moved, seconded by Councilman Morris, that the bills and claims
against the City in the amounts listed.and itemized in the List of Claims filed with
the City Clerk on December 17, 1940, and presented to the Council at this meeting, be
allowed and paid. On roll call the motion carried by the following vote. Ayes:
Councilmen Carrington, Morris and President Weichhart, (3) . Noes: None. Absent:
Councilmen Godfrey and Maurer, (2).
21. Councilman Morris moved the meeting adjourn to assemble in adjourned regular
session at 5:00 o'clock P. M. Friday, December 20, 1940.
