HELD TUESDAY AFTERNOON, APRIL 8t 1941
The meeting convened at 5:00 o'clock P. M. with President Weichhart presiding.
ROLL CALL:
The roll was called and Councilmen Godfrey, Morris and President Weichhart, (3),
were noted present. Absent: Councilmen Carrington and Maurer, (2).
ORAL COI LUNICATIONS:
1. Councilman Morris brought to the attention of the Council the condition of the
baseball diamond at Lincoln Park in order that this matter might be in mind should
money be available in the future for park improvements.
2. Councilman Morris stated he felt it vital that a new Police and Fire Pension
Ordinance should be prepared and placed on the ballot at the next municipal election.
REPORTS OF COMMITTEES:
3. The City Manager presented and explained in detail an agreement which has been
negotiated with the Southern Pacific Company, covering the acquisition by the City of
certain tracks and piers in west Alameda and leasing to the Southern Pacific Company
approximately 0.9018 acres of tide lands.
The City Manager stated that for the past several months negotiations have been going
on with the Southern Pacific Company with regard to certain property lying immediately
west of its property on which is situated the car repair shops in west Alameda. The
Southern Pacific Company in turn is to give to the City two railroad tracks of between
11,000 and 12,000 feet in length, running from the Peralta Grant Line to the site of
the former Alameda Mole, including piers and piling.
After this explanation, the City Manager recommended the Council file the form of
agreement covering this lease and that the ordinance authorizing the lease be intro-
duced. Councilman Godfrey moved the agreement as drawn and presented at this meeting,
referring to the above lease, be filed. Councilman Morris seconded the motion, re-
questing record be made of the fact that he is seconding this motion only to permit
this document to be placed on file and to make possible the bringing this matter before
the Council for further consideration at a later time, and his second is in no way to
be construed as his being in favor of the agreement, it being his belief that the City's
action in the matter is too hasty.
On roll call the form of lease was then ordered filed by the following vote. Ayes:
Councilmen Godfrey, Morris and President Weichhart, (3) . Noes: None. Absent: Coun-
cilmen Carrington and Maurer, (2).
ORDINANCES INTRODUCED:
4. Councilman Godfrey introduced the following ordinance, after which it was laid
over under provision of law and the Charter:
"Ordinance No. , New Series
An Ordinance Authorizing Execution of an Indenture and
Agreement on Behalf of the City of Alameda with Southern
Pacific Company, Conveying to the City of Alameda Certain
Wharves, Piers, Slips and Railroad Tracks, and Granting
to Southern Pacific Company a Revocable Non-Exclusive
Right to the Use Thereof, and Leasing Certain Tide Lands
in the City of Alameda to Southern Pacific Company."
NEW BUSINESS:
5. Councilman Godfrey inquired what action should be taken by the Council, and when,
concerning the amount to be paid by the United States Housing Authority in lieu of taxes
on its project in Alameda. It was explained that at the time the valuation of the proj-
ect is established, the in lieu taxes will be stipulated by the City.
RESOLUTIONS:
6. The following resolution was introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2575
Adopting Specifications for Furnishing Crusher Run Rock
to the City of Alameda During Fiscal Year Ending June
30, 1941."
The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Morris and President Weich-
hart, (3). Noes: None. Absent: Councilmen Carrington and Maurer, (2). Thereupon
the Mayor declared said resolution duly adopted and passed.
7. The following resolution was introduced by Councilman Morris, who moved its
adoption:
"Resolution No. 2576
Adopting Specifications for Furnishing Crusher Run
Rock to the City of Alameda During Fiscal Year
Ending June 30, 1942."
The motion to adopt said resolution was seconded by Councilman Godfrey and on roll call
carried by the following vote. Ayes: Councilmen Godfrey, Morris and President Weich-
hart, (3). Noes: None. Absent: Councilmen Carrington and Maurer, (2). Thereupon
the Mayor declared said resolution duly adopted and passed.
ORDINANCES PASSED:
8. "Ordinance No. 752
New Series
An Ordinance Repealing Ordinance of the City of
Alameda No. 550, New Series Entitled 'An Ordinance
for Regulation of the Construction, Maintenance,
Location, Operation, and Licensing of Moving Pic-
ture Theatres.'."
Councilman Morris moved the ordinance as read be adopted, seconded by Councilman Godfrey
and on roll call the motion carried by the following vote. Ayes: Councilmen Godfrey,
Morris and President Weichhart, (3). Noes: None. Absent: Councilmen Carrington and
Maurer, (2).
FILING:
9. Specifications - For furnishing Crusher Run Rock for fiscal year ending
June 30, 1941.
10. Specifications - For furnishing Crusher Run Rock for fiscal year ending
June 30, 1942.
11. Auditor's Balance Sheet - Month ending March 31, 1941.
12. There being no further business to come before the meeting, the Council adjourned
to meet in regular session on Tuesday evening, April 15, 1941, at 8:00 o'clock P. M.
