1941-04-15 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, APRIL 15, 1941 The meeting convened at 8:00 o'clock P. M. with President Weichhart presiding. ROLL CALL: The roll was called and Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5), were noted present. Absent: None. 1. The Council then proceeded to reorganize: Councilman Maurer moved Henry A. Weichhart be appointed. Mayor and. President of the Council of the City of Alameda for the next two years. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, and Maurer, (4) . Noes: None. Not Voting: President Weichhart, (1). Absent: None. 2. Councilman Branscheid moved Milton C. Godfrey be appointed Vice-President of the Council of the City of Alameda for the next two years. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Maurer and. President Weichhart, (4) . Noes: None. Not Voting: Councilman Godfrey, (1). Absent: None. 3. Mayor Weichhart welcomed Councilmen Anderson and Branscheid, as the two newly elected members of the Council. MINUTES: 4. The minutes of the regular meeting of April 1, 1941, and of the adjourned regular meeting of April 8, 1941, were approved as transcribed. WRITTEN COMMUNICATIONS: 5. A petition was presented, signed by ten property owners living in the 3200 block of Encinal Avenue, requesting a new sewer be installed on the north side of Encinal Avenue, as the present one is in poor condition. The City Manager replied that there is a definite need for a new sewer in this locality, installation of which is part of the sewer construction program contemplated and is to be taken care of as soon as possible. There being no objections, the petition was or- dered filed. 6. From Captain F. R. McCrary, Commanding Officer of the Naval Air Station of Alameda, giving notice of a conference to be held at the Air Station on Friday, April 18, 1941, for the purpose of discussing matters pertaining to the proposed additional tube under the Estuary between the Cities of Oakland and Alameda, and reouesting that a represen- tative of the City of Alameda be present at this meeting. Mayor Weichhart and. Councilman Branscheid stated they would attend the conference and Councilman Maurer said he would do so if it were possible. 7. From the Alameda Municipal Civil Service Employees Association, informing the Council of its ratification of the action of the employees of the Street, Park and Golf Course Departments in filing a certain petition with the Council which was presented at the regular meeting held March 18, 1941, requesting standardization of wages paid to employees of these departments. Councilman Godfrey requested that a letter be sent to this organization assuring it the matter is in Committee of the Whole for further consideration. The communication was then referred to the Committee of the Whole. ORAL COMMUNICATIONS: 8. Mr. Frank A. Gottstein addressed the Council regarding the erosion of soil and poor condition of the steps and bulkhead at the foot of Ninth Street on the Bay Shore. The City Manager stated that repair work at this location will be made as soon as the weather permits. OPENING OF BIDS: 9. Bids were presented and opened for furnishing tires and tubes to the City of Ala- meda for the fiscal year ending June 30, 1942, as follows: From E. & S. Tire Service Accompanied by certified check in amount of $100.00 From Tide Water Associated Oil Company Accompanied by certified check in amount of $100.00 There being no objections, these bids were referred to the City Manager and City Attor- •ey for study and recommendation. 10. Bids were presented and opened for furnishing crusher run rock to the City of Ala- meda for the remainder of the fiscal year ending June 30, 1941, as follows: From Superior Rock Co. (per ton) 1.24 Accompanied by certified check in amount of $500.00 From Heafey-Moore Co. (per ton)- Accompanied by certified check in amount of p1.04 $500.00 V 11. Bids were presented and opened for furnishing crusher run rock to the City of Ala- meda for the fiscal year ending June 30, 1942, as follows: From Superior Rock Co. (per ton )- 1.24 Accompanied by certified check in amount of $500.00 From Heafey-Moore Co. (per ton)- 1.04 Accompanied by certified check in amount of $500.00 There being no objections, these bids were referred to the City Manager and. City Attor- ney for study and recommendation. REPORTS OF COMMITTEES: 12. From the City Planning Board, notifying the Council it had approved the general lay-out of the United. States Housing Authority Project, the lay-out of the proposed streets and the proposed abandonment of certain existing streets pertaining to the plan for the development of this tract. This project will be constructed on portions of certain property lying between Brush Street and. Pacific Avenue and Atlantic Avenue and. Fourth Street. Councilman Maurer moved the action of the City Planning Board in approving the general plan of the United States Housing Authority Project, lay-out of proposed streets and the abandonment of certain existing streets be approved by the Council. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and. President Weichhart, (5). Noes: None. Absent: None. 13. From the City Planning Board, recommending that a street be opened on the north- west line of Pearl Street, 277.66 feet northeast from the northeast line of Lincoln Avenue, being 208 feet in length. Councilman Godfrey moved that the action of the City Planning Board be approved on the condition that this proposed street be paved and improved in accordance with require- ments of the City ordinances and to the satisfaction of the City Engineer. Also, that a deed of dedication be given to the City showing clear title. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and. President Weichhart, (5). Noes: None, Absent: None. 14. From the City Planning Board, recommending reclassification of the southern 34 feet of lot situated on the southeast corner of Webster Street and. Central Avenue, from the "A" One-Family Dwelling District, to the "D" Commercial District, to permit the total area of lot to be used for a commercial purpose. Councilman Maurer moved the recommendation of the City Planning Board be approved, seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: None. Absent: None. 15. From the City Manager, recommending that contract of Taper Tube Pole Company for furnishing light standards be accepted, and that this company be paid the amount due on the contract. CouncilMan Maurer moved the recommendation of the City Manager be adopted, that con- tract with Taper Tube Pole Company be accepted and amount due be paid, seconded by Councilman Anderson and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: None. Absent: None, V 16. From the City Manager, recommending that contract of Hall-Scott Motor Car Company be accepted, as complete installation of the new motor in fire engine truck No. 2, has been made to the satisfaction of the Fire Chief, and that the amount due on said con- tract be paid. Councilman Godfrey moved the recommendation of the City Manager be adopted and that contract of Hall-Scott Motor Car Company be accepted and the amount due be paid. Councilman Maurer seconded the motion and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: None. Absent: None. ORDINANCES INTRODUCED: 17. Councilman Maurer introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Adding Section 14 to Ordinance No. 725, New Series." 18. Councilman Godfrey introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by 19. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending the Alameda Municipal Code by Adding Section 7-213 to Article 1, Chapter 2 of Title VII Thereof." NEW BUSINESS: 20. The City Manager recommended that contract for furnishing crusher run rock to the City during the remainder of the fiscal year ending June 30, 1941, be awarded to Heafey- Moore Co., the low bidder, at the price of $1.04 per ton. Councilman Maurer moved the recommendation of the City Manager be approved; that con- tract be awarded to Heafey-Moore for furnishing crusher run rock to the City of Alameda at its bid price of $1.04 per ton and check be returned to the unsuccessful bidder. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: None. Absent: None. 21. The City Manager recommended that contract for furnishing crusher run rock to the City for the fiscal year ending June 30, 1942, be awarded to Heafey-Moore Co., the low bidder, at its bid price of $1.04 per ton. Councilman Maurer moved the recommendation of the City Manager be approved; that Heafey- Moore Co., be awarded contract for furnishing crusher run rock to the City of Alameda for the fiscal year ending June 30, 1942, at the price of $1.04 per ton and that bid check be returned to the unsuccessful bidder. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: None. Absent: None. 22. Councilman Godfrey inquired of the City Attorney if there were not some less cum- bersome method of handling recommendations and notices of action taken by the City Plan- ning Board, than is now practiced. The City Attorney advised he believed it preferable to continue as at present. 23. The matter of the proposed opening of Webster Street for a distance of 134 feet south, of Central Avenue, was presented. Mr. A. W. Stauber, representative of Safeway Stores, Incorporated, addressed the meeting with regard to this proposed opening as it is the intention of this company to do the work in connection with the opening of this street. After discussion, Councilman Maurer moved the City approve the construction of the street, extending south of the southerly line of Central Avenue for a distance of 134 feet, to grade as shown on the plat submitted, on condition that the street be paved and improved as provided by City ordinances and to the satisfaction of the City Engineer; that suitable deed of dedication be delivered to the City, together with title policy showing clear title of the dedicated portion. Also, upon further condition that an agreement of the adjacent property owners be submitted and delivered to the,City waiving claim for any damages they might sustain by reason of the change of or establishment of grade and that a proper deed or agreement of the owners of the property to the south of the proposed street be delivered to the City, conveying to the City the right to dis- charge water from said street on their land. Councilman Branscheid stated he thought it advisable, when matters were presented which involved the approval of the City Engineer, that such approval be submitted to to the Council in writing, rather than by verbal understanding. 24i. See Page 319. RESOLUTIONS: 25. The following resolution was introduced by Councilman Godfrey, who moved its adop- tion: "Resolution No. 2577 Authorizing Execution of Agreement with East Bay Municipal Utility District for Installation of Water Main in Clement Avenue Between Stanford Street and Chestnut Street in the City of Alameda." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 26. The following resolution was introduced by Councilman Maurer, who moved its adop- tion: "Resolution No. 2578 Resolution of Intention to Close Portions of Second Street, Spruce Street and Cypress Street in the City of Alameda." The motion to adopt said resolution was seconded by Councilman Anderson and on roll call carried by the following vote. "yes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de- clared said resolution duly adopted and passed. 27. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 2579 Creating Position of Junior Stenographer-Clerk in the Recreation Department of the City of Alameda and. Fixing Salary Thereof." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5). Noes: Non-e. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 28. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2580 Resolution of Intention to Change the Official Grades of that Portion of Webster Street Lying Between the Segregation Line and a Line Drawn Parallel to Said Segregation Line and Distant Northerly Therefrom 2500 Feet." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor de- clared said resolution duly adopted and passed. 29. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 2581 Resolution of Intention to Reclassify, on Council's Own Motion, Certain Real Property from the "G", "B" and "A" Districts to the "C" District." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey, Maurer and President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor de- clared said resolution duly adopted and passed. ORDINANCE PASan: 30. "Ordinance No. 753 New Series An Ordinance Authorizing Execution of an Indenture and. Agreement on Behalf of the City of Alameda with Southern Pacific Company, Conveying to the City of Alameda Certain Wharves, Piers, Slips and Railroad Tracks, and Granting to Southern Pacific Company a Revocable Non-Exclusive Right to the Use Thereof, and Leasing Certain Tide Lands in the City of Alameda to Southern Pacific Company." Councilman Godfrey moved the ordinance as read, be adopted, seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Anderson, Branscheid, Godfrey and President Weichhart (4). Noes: None. Not Voting: Council- man Maurer, (1). Absent: None. FILING: 31. Copy of Agreement with East Bay Municipal Utility District. BILLS: 32. Councilman Maurer moved the bills and claims against the City in the amounts listed and itemized in the List of filed with the City Clerk on April 15, 1941, and pre- sented to the Council at this meeting, be allowed and paid. At this point, Councilman Anderson read a letter addressed to himself, extending an invitation to the members of the Council to attend a celebration on the opening day of the yachting season, to be held. April 27, 1941. 34. There being no further business to come before the meeting, Councilman Maurer moved the Council adjourn to meet in adjourned regular session on Thursday afternoon, April 24, 1941, at 5:00 o'clock P. The Automatic Name Schedule Bond of Public Officials and the Bond of Loreme R. Beatie, City Clerk, carried by the American Surety Company of New York, were offered for approval.
