1941-05-06 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD :TUESDAY EVENING MAY 6 1941 The meeting convened at 8:00 o'clock P. M. with President Weichhart presidin ROLL CALL: The roll was called and Councilmen Branscheid, Godfrey, Maurer and President Weichhart, (4) were noted present. Absent: Councilman Anderson, (1). MINUTES: 1. The minutes of the regular meeting of April 15, 1941, and the adjourned regular meeting of April 24, 1941, were approved as read. WRITTEN COMMUNICATIONS: 2. A letter was presented from Councilman Curtis Anderson, tendering his resignation as a member of the Council of the City of Alameda, effective immediately. 3. A letter was presented from Jr. Walter V. Howe, tendering his resignation as a member of the Civil Service Board of the City of Alameda, effective immediately. 4. Councilman Godfrey moved the regular order of business be suspended and the Coun- cil proceed under the headings of "New Business" and "Resolutions". The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Maurer and President Weichhart, (4) . Noes: None. Absent: Councilman Anderson, (1). NEW BUSINESS: 5. Councilman Maurer moved the resignation of Curtis Anderson, as a member of the Council of the City of Alameda be accepted. The motion was seconded by Councilman Godfrey and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Maurer and President Weichhart, (4) . Noes: None. Absent: Councilman Anderson, (1). 6. Councilman Maurer moved the resignation of Walter V. Howe, as a member of the Civil Service Board of the City of Alameda be accepted. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Council- men Branscheid, Godfrey, Maurer and President Weichhart, (4) . Noes: None. Absent: None. RESOLUTIONS: 7. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 2583 Appointing Walter V. Howe to the Office of Councilman on the Council of the City of Alameda." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, G-od±rey, Maurer and President Weichhart, (4) . Noes: None. Absent: None. 8. At this point Mr. Howe took and filed his oath of office before the City Clerk and thereupon took his seat on the Council. 9. Councilman Maurer then moved the regular order of business be resumed, seconded by Councilman. Branscheid and on roll call carried by the following vote. Ayes: Council- men Branscheid, Godfrey, Howe, Maurer and President Weichhart, '(5). Noes: None. Absent: None. WRITTEN 00fIMUNICATIONS, Continued.: 10. From the Veterans' Welfare Board of the State of California, petitioning cancella- tion of certain taxes appearing on the records as a lien against property in the City of Alameda owned by the Board. There being no objections, the matter was referred to "Renlutions". 11. From the League for Local Liquor Control, concerning lieuor as it may relate to local governments. There being no objections, the communication was ordered filed. 12. From Mr. 5. W. Powell, 1013 Mound Street, requesting permission to move a house from 2505 Central Avenue to 2830 Fillmore Street. On recommendation of the City Manager, Councilman Branscheid moved this reeuest be granted, subject to restrictions and regulations pertaining to house moving as set forth in the Municipal Code. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. 13. From the Southern Pacific Company, acknowledging receipt of communication from the City Clerk informing it of the proposed lease to the United Engineering Company of certain tidelands adjacent to the railroad company's property. The Southern Pacific Company stated it has no objections to the proposed lease to the United. Engineering Company or to its provisions. There being no objections, the communication was ordered filed. ORAL C OMMUNIO AT I ONS : 1 . The City Manager reported the wall at the foot of Ninth Street had been repaired. There should be no further falling away of that end of the street. v/ 15. The City Manager explained the Memorandum of Agreement, resolution for the execu- tion of which will be adopted at this meeting, covering the improvement of Webster Street and that bids will probably be called for this work at the next regular meeting of the Council. Construction is expected to be started shortly after July 1, 1941. 36, The City Manager reported on the status of the proposed new tube to parallel Posey Tube.. Information has been received from Mr. Webster of the Oakland Chamber of Com- merce, who has been in Washington, D. C., with regard to obtaining this tube. It ap- pears favorable that this project will go through and definite information thereon should be received in a few days. 17. Councilman Maurer inquired about the schedule of completion of the road to the Naval Air Station and was told by the City Manager that it should be finished in about three weeks if the weather permits. REP OR TS OF OMMITTEES: n. From the City Planning Board, recommending denial of the petition of Mrs. Marie No to reclassify the northeast corner of Morton Street and Encinal Avenue, from the "G" Multiple Dwelling District, to the "D" Commercial District. Mr. Stanley Whitney, Attorney, was present and spoke in behalf of the petitioner. Mrs. Nicolini, Miss Marian and Er. Burneister, addressed the Council in opposition to this re-zoning. At the request of the petitioner, the matter was, on motion of Councilman Godfrey and seconded by Councilman Branscheid, continued until the next regular meeting of the Council. On roll call the motion carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None, 19. From the City Planning Board, submitting report and recommendation on the matter of the proposed reclassification of the area described in the Council's Resolution of Intention, No. 2581, (United States Housing Authority Project) to the "B" Two-to-Four Family Dwelling District, instead of the "C" Multiple Dwelling District, as stated in the Resolution of Intention. Councilman Godfrey moved, seconded by Councilman Branscheid, that the recommendation of the City Planning Board. be approved and this property be reclassified to the "B" Two-to- Four Family Dwelling District. On roll call the motion carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5). Noes: None. Absent: None. 20. From Mr. Charles M. Romanowitz, member of the Public Utilities Board, requesting a leave of absence from the State of California for a period of three weeks commencing April 29, 1941. Councilman Branscheid moved the request of Mr. Romanowitz be granted and he be allowed a leave of absence from the State for three weeks commencing, April 29, 1941. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and. President Weichhart, (5) . Noes: None. Absent: None. 2. From the City Manager, recommending that Charles R. Lohmeyer, Executive Secretary of the Civil Service Board, be authorized to represent the City of Alameda at the Eleventh Annual Western Regional Conference of the Civil Service Assembly, to be held in Los Angeles May 26 to May 28, 1941, and that a sum not to exceed $50. be appropriated' for his expenses. Councilman Maurer moved the recommendation of the City Manager be approved; that Mr. Lohmeyer be authorized to attend the above referred to Conference and that a sum not to exceed $50. be allowed for his expenses. Councilman Branscheid seconded the motion and on roll call it carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. 22. From the City Manager, recommending that contract for furnishing tires and tubes to the City of Alameda for the fiscal year 1941-1942, be awarded to the M & S Tire Ser- vice, the low bidder of bids opened April 15, 1941. Councilman Maurer moved the recommendation of the City Manager be adopted and that con-; tract be awarded to the M & S Tire Service for furnishing the City of Alameda with tires and tubes during the fiscal year 1941-1942; and that check be returned to the unsuccess- ful bidder. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and Presi- dent Weichhart, (5). Noes: None. Absent: None. 23. From the City Attorney, regarding disclaimer by the City of Alameda on the United States condemnation action pending in Federal Court effecting property of The Regents of the University of California. There being no objections, the matter was referred to "Resolutions". ORDINANCES INTRODUCED: 24. Councilman Maurer introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-344 of the Alameda Municipal Code by Adding Thereto Subdivisions (30) to (39) Inclusive." 25. Councilman Godfrey introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Reclassifying Property by Adding Section 15 to Ordinance No. 725, New Series." RESOLUTIONS: 26. The following resolution was introduced by Councilman Maurer, who moved its adoption: TT Re olution No. 2584 Cancelling City axes on Real Property Acquired by The Veterans' Welfare Board of the State of California." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and. President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 27. The following resolution was introduced by Councilman Godfrey, who moved its adoption: ItR olution No. 2585 App roving Memorandum of Agreement for Exoenditure of 1/4 Cent Gas Tax Allocated for State Highways." The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2586 Adopting Specifications for Furnishing One (1) Station Wagon to the City of Alameda, Calling for Bids and Directing the City Clerk to Advertise the Same." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer . and President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor de- clared said resolution duly adopted and passed. 29. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2587 Adopting Specifications for Furnishing Lumber to the City of Alameda During Fiscal Year Beginning July 1, 1941 and Ending June 30, 1942, Calling for Bids and Directing the City Clerk to Advertise the Same." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted.and passed. 30. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 2588 Adopting Specifications for Furnishing Corrugated Pipe and Culverts to the City of Alameda for the Fiscal Year 1941-1942, Calling for Bids and Directing the City Clerk to Advertise the Same." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and. President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de- clared said resolution duly adopted and passed. 31. The following resolution was introduced by Councilman Godfrey, who moved its adoption: "Resolution No. 2589 Adopting Specifications for Furnishing Vitrified. Ironstone Sewer Pipe to the City of Alameda for the Fiscal Year 1941-1942, Calling for Bids and Directing the City Clerk to Advertise the Same." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and. President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor declared said resolution duly adopted and passed. 32. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2590 Adopting Specifications for Furnishing Rock, Sand and Concrete Mix to the City of Alameda, for the Fiscal Year 1941-1942, Calling for Bids and. Direct- ing the City Clerk to Advertise the Same." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2591 Adopting Specifications for Furnishing Portland Cement to the City of Alameda for the Fiscal Year 1941-1942, Calling for Bids and Directing the City Cle'rk to Ad- vertise the Same." The motion to adopt said resolution was seconded by Councilman 'Branscheid and on roll call carried by the following vote.
