HELD TUESDAY EVENING, MAY 13, - - - - - - - - - - -1941
The meeting convened at 7:00 o'clock P. M. with President Weichhart presiding.
ROLL CALL:
The roll was called and. Councilmen Branscheid, Godfrey, Howe, Maurer and. President
Weichhart, (5), were noted present. Absent: None.

1. A communication was presented from the Mayor of the City of Livermore, extending
an invitation to the officials of this City and their wives, to attend a dinner meet-
ing of the East Bay Division of the League of California Cities to be held May 27,
1941, in Livermore. Mayor Weichhart urged all who could to attend and to so notify
the City Manager.

2. From the City Manager, recommending that the old wooden tank which was formerly
in Lincoln Park, the old iron fence which was formerly in McKinley Park and the old
wooden tank now located in Washington Park, be sold to Mr. T. E. Brown for the price
offered of $90. for all three items.
Councilman Maurer moved the recommendation of the City Manager be accepted. and the
above mentioned tanks and fence be sold to T. E. Brown for the sum of 90. The motion
was seconded by Councilman Howe and on roll call carried by the following vote. Ayes:
Councilmen Branscheid, Godfrey, Howe, Maurer and. President Weichhart, (5) . Noes:
None. Absent: None.
ORDINANCES INTRODUCED:
3. The following ordinance was introduced by Councilman Godfrey, after which it was
laid over under provision of law and the Charter:
"Ordinance No.

An Ordinance Approving the Form and. Terms of an
Indenture and. Agreement Granting to the City of
Alameda an Easement for Street or Highway Fur-
poses and Authorizing the Execution Thereof."
4. The following ordinance was introduced by Councilman Maurer, after which it was
laid over under provision of law and the Charter:
"Ordinance No.

An Ordinance Authorizing the Acquisition of Certain
Real Property Lying Adjacent to the City Hall."
NEW BUSINESS:
5. A report was presented from Goodell & Henry, Certified Public Accountants, on the
examination made of the legal advertising placed by the City of Alameda with the Ala-
meda Times-Star during the period from August, 1939, to May 1, 1941, and the charges
made for said advertising.
It was found that during the period from August, 1939, to August 22, 1940, the adver-
tisements were published in the manner which has been acceptable to the City for some
time past, namely: 6 on 6, the count showing eleven and a fraction lines to the inch.
Commencing August 22 , 1940, and continuing to February, 1941, it was found the adver-
tisements ran 6 on 6, the count showing ten and a fraction lines to the inch. This
is in violation of our present contract.
Subsequent to February 19, 1941, the advertisements inspected were found to be running .J
in the usual manner, namely: 6 on 6.
The bills for legal advertising during the period when the advertisements were run 6
on 6 amounted to $788.43, which represented an overcharge of 10%. The report recom-
mended the Council approve a refund of $78.84 from the Alameda Times-Star for reim-
bursement of any claim the City may have in this matter.
Before this report was submitted, it had been approved by the City Manager, City
Attorney, City Auditor and City Clerk.
Councilman Godfrey moved the report and recommendation of Goodell & Henry be approved
and payment of $78.84 be accepted from the Alameda Times-Star as full settlement and
compromise of this account with the Alameda Times-Star. The motion was seconded by
Councilman Branscheid and on roll call carried by the following vote. Ayes: 'Coun-
cilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5). Noes: None.

RESOLUTIQNS:
6. The following resolution was introduced by Councilman Branscheid, who moved its
adoption:
"Resolution No. 2597
Endorsing Assembly Bills No. 1440 and No. 1442."
The motion to adopt said resolution was seconded by Councilman Maurer and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and
President Weichhart, (5). Noes: None. Absent: Thereupon the Mayor declared said
resolution duly adopted and passed.
7. The following resolution was introduced. by Councilman Maurer, who moved i
adoption:
"Resolution No. 2598
Accepting Conveyance from San Francisco-Oakland
Terminal Railways of Certain Easement for Sewer
Purposes and Consenting to the Recordation Thereof."
The motion to adopt said resolution was seconded by Councilman Branscheid and on roll
call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer
and President Weichhart, (5) . Noes.: None. Absent: None. Thereupon the Mayor declared
said resolution duly adopted and passed.
8. The following resolution was introduced by Councilman Godfrey, who moved its
adoption:
"Resolution No. 2599
Accepting Conveyance from N. Clark & Sons of Certain
Easement for Sewer Purposes and Consenting to the
Recordation Thereof."
The motion to adopt said resolution was seconded by Councilman Howe and on roll call
carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer
and President Weichhart, (5). Noes: None. Absent: None. Thereupon the Mayor de-
clared said resolution duly adopted and passed.
ORDINANCES PASSED:

An Ordinance Amending Section 17-344 of the Alameda
Municipal Code by Adding Thereto Subdivisions (30)
to (39) Inclusive."
Councilman Eranscheid moved the ordinance as read be adonted. The motion was seconded
by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen
Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: Hone. Absent:
None.

An Ordinance Reclassifying Property by Adding
Section 15 to Ordinance No. 725, New Series."
Councilman Godfrey moved the ordinance as read be adopted. The motion was seconded by
Councilman Branscheid and on roll call carried by the following vote. Ayes: Council-
men Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None.

15. Councilman Godfrey moved the Council adjourn to meet in regular session on
Tuesday evening, May 20, 1941, at 8:00 o'clock P. M. The motion was seconded by
Councilman Branscheid and unanimously carried.
