M. with President ':/eichhart presiding. ROLL CALL: The roll was called and. Councilmen 3ranscheid, Godfrey, Howe, Maurer and President :/eichhart ) L , were noted present. Absent: None, MINUTES: 1. The minutes of the regular meeting of May 6, 1941 and of the adjourned regular meeting of May 13, 1941, were approved as transcribed. WRITTEN•COMMUNIPATIONS: 2!/..• • A communication was presented from Bethlehem Steel Company, in reply to a verbal inquiry made by the City Manager concerning the performance of that company under the agreement dated August 4, 1916, between the City of Alameda and the Union Iron Works Company, informing that the stipulations of paragraphs 2, 3 and 5 have been complied with. There being no objections, the matter was referred to the City Manager and City Attorney for further attention. 3 From The Pacific Telephone and Telegraph Company, requesting a revocable permit be granted by the City of Alameda to lay a buried cable along the west side of the Municipal Bathhouse located in Washington Park, Alameda. The matter was referred. to "Resolutions". -t/ 4. From Victor A. Kaufenberg, applying for refund of :1_02.50 paid to the Building Department for building permits pertaining to the contemplated construction Of an apartment building at 1151 Broadway, which construction has now been abandoned. Councilman Godfrey moved the request be referred to the City Attorney. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, . Noes: None. Absent: None. ). A communication addressed to the City Manager was presented. from the State Depart- ent of Public Works, Division of Highways, advising that the present diagonal parking permitted on Webster Street is contrary to the provisions of Sention No. 588 of'the Vehicle Code of the State of California and requesting that arrangements be made to establish parallel parking on Webster Street to conform to the regulations of the sec- tion quoted. Councilman Branscheid moved the City Manager be instructed to enforce the State regula- tions regarding parking on. Webster Street. The motion was seconded by Councilman Howe and unanimously carried. ORAL CO=ICATINS: O. Mr. Frank A. Gottstein addressed the Council with regard to progress being made toward obtaining another Subaqueous Tube para.:11oling Posey Tube and discussed various phases of transportation. OPENIEG OF BIDS: Rr' Altheun authorization was given at the regular meeting f the Council held May 0, 1941, to advertise fOr bids for the furnishing o one station wagon to the City, no bids were received. Councilman. Godfrey moved. that as no bids were received, the City 'Manager be authorized to purchase a station wagon in the open. market. The motion carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and Presi- dent Weichhart, (5) . Noes: None. Absent: None. UNFINISHED BUSINESS: 16. Continued from the regular meeting of May 6, 1941, was the matter of the proposed reclassification of the northeast corner of Morton Street and Encinal Avenue, from the "C" Multiple Dwelling District to the "D" Commercial District. Mr. Stanley D. Whitney, Attorney, addressed the Council in further support of the petitioner, Mrs. Marie. Nott. Mrs. Nicolini spoke in protest of this rezoning. Councilman Godfrey then moved the recommendation of the City Planning Board to deny this petition for reclassification, be approved. The motion was seconded by Council- man Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. 17. The matter of the proposed closing of portions of Second, Spruce and Cypress Streets, . instituted by Resolution of Intention No. 2578, adopted by the Council on April 15, 1941, was presented and a statement read from the City Clerk giving notice that no pioteste against the closing were filed within the time required by law, or at all. Councilman Branscheid moved that further consideration of this matter he postponed un- til the regular meeting of the Council to be held June 3, 1941. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. RESOLUTIONS: 18. The followingnresolution was introduced by Councilman Maurer, who moved it adoption: "Resolution No. 2600 Granting Revocable Permit to the Pacific Telephone and Telegraph Company to Maintain a Cable on Municipal Bath- house Property." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Mayor Weichhart stated he desired to nominate Er. Albert S. Ridley as a member of the Civil Service Board, to fill the unexpired term of Walter V. Howe, reSigned, which term expires June 30, 1945. 20. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2601 Appointing Member of the Civil Service Board." The motion to adopt said resolution was seconded. by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. Thereupon the Mayor de- clared said resolution duly adopted and passed. ORDINANCES PASSED: 21. "Ordinance No. 760 New Series An Ordinance Approving the Form and Terms of an Indenture and Agreement Granting to the City of Alameda an Easement for Street or Highway Purposes and Authorizing the Execution Thereof." Councilman Godfrey moved the ordinance as read be adonted. The motion was seconded by Councilman ?)ranscheia, and on roll call carried by the following vote. Ayes: Council- men Branscheid, Godfrey, Howe, Maurer and President WeichhaYt, (5). Noes: one Absent: None. 22. "Ordinance No, 761 An Ordinance Authorizing the Acquisition of Certain Real Property Lying Adjacent to the City Hall." Councilman 13ranscheid moved the ordinance as read be adonted. The motion was seconded by Councilelar Eaurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Godfrey, Howe, Maurer and President Weichhart, (5) . Noes: None. Absent: None. BILLS: 23.
