The meeting convened at 8:00 o'clock F. M. with President Weichhart presiding.
ROLL CALL:
The roll was called and Councilmen 13ranscheid, Howe, Maurer and Frosidert

MTNUTES:
1. The minutes of the regular meeting of day 20, 1941, and of the adjourned regular
meeting of May 27, 1941, were approved as transcried.

A communication was presented from Elizabeth T. Lassen, enclosing a petition
signed by twenty,five taxpayers and parents, requesting the Council to give all possi-
ble add toward insuring protection against future floods on Bay Farm Island in order
to safeguard the present and proposed recreational activities on the island.
This matter was referred to the City Manage__ for study, with the request that he
report back his findings to the Council.

3. From the Lincoln-Versailles Dads club, enclosing resolution adopted by that or-
ganization, requesting the City of Alameda to provide a Municipal awimming Fool and
pledging the Club's wholehearted support in this endeavor.
Mayor Weichhart explained that the question of establishing a Municipal Swimming Pool
had for some time, been filed in the Committee of the Whole for consideration and
stated it was the opinion of the Council that the expense of constructing a pool such
as would be adequate for use by the public and which would comply with the standard
regulations of the A- A. U. would be far too great for the City to undertake without
obtaining the money from some source other than taxes. If it were shown that it is
the desire of the people of Alameda that such a pool be constructed, the Question
should be placed upon the ballot to be voted upon by the citizens of Alameda, the ex-
pense of construction to be borne by a bond issue.
The City Manager further explained that he would estimate the cost of such a pool to
be at least 0_10,000., not counting any possible expenditure for. the purchase of the
necessary land involved. It was his recommendation, particularly in these times of
national Emergency, that it would be most unwise to ask the people to pay for such a
project out of tax moneys, as it would mean an increase in the tax rate of approxi-
mately 40 cents. In his opinion, the only proper way to decide this matter is to
place the question on the ballot.
MT. Frank A. Gottstein addressed the Council against the establishment of a Municipal
SWimming Fool and Mr. Brian Fetherstonhaugh, representing the Lincoln-Versailles Dads
Club, spoke in favor of the project.
The communication frora Lincoln-Versailles Dads Club was then referrsd to the Committee
of the Whole.

From ti State of California Council of Defense, requesting the City Council to
adopt an ordinance creating a Local Defense Council to cooperate with the State and
other cities and counties involving the registration and use of citizen volunteers in •
this national Emergency. The matter was referred to "Ordinances introduced" and the
communication ordered filed.
5( From Pillsbury, Madison 4 Sutro, Attorneys, enclosing a petition from Kate G.
Pedersen, executrix of the estate of Lars A. Pedersen, deceased, requesting the aban-
donment and closing of all that portion of Atlantic Avenue lying north of a line drawn
uniformly parallel to and uniformly distant 40 feet northerly from the southerly line
of Atlantic Avenue. between the easterly line of Stanford Street and the easterly line
of Chestnut Street. There being no objections, the matter was referred to the City
Manager for report and recommendation.

b. From the County of hl st Board of Supervisors, requesting the City Council's
approval on the recommendation of the County Tay Collector that four certain pieces
of property within the City of Alameda, which. have been deeded to the State for non-
payment of delinquent taxes, be sold.
The Board of Supervisors had previously notified the Council that no property within
the City of Alameda would be sold without the approval of said Council.
She City ManaQ:er explained that the stated price for which these four parcels in ques-
tion would be sold is sufficient to cover both the Oity and County taxes and recom-
mended the Council agree to the sale.
Councilman Branscheid moved the recommendation of the City Manager be approved and the
four parcels as stated in the communication from the Board of Supervisors be sold for
delincuent taxes. The motion was seconded by Councilman Maurer and on roll call carried •
by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and President
Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1).
REPORTS OF COMMITTEES:
The City Manager verbally reported on the requested and proposed re-routing of
the San Francisco buses, Lincoln Avenue line, in a portion of the Fernside District
so that the buses coming from San Francisco to the eastern terminus located at High
Street and Fairview Avenue will be traveling along the same route as that Employed by
buses going to San FrancisCo. This plan would change the eastern terminus of the
Encinal Avenue line from Garfield Avenue and High Street to Liberty Avenue and High
Street.
The City Manager stated the investigation. was made at the request of approximately
300 property owners in this area and the request was prompted by the fact that at
present when the Lincoln Avenue buses from San Francisco are ahead of schedule, a
wait is made at the terminus before starting again on the San Francisco trip, delay-
ing passengers who wish to disembark further along the route. This change is recog-
nized as being feasible and satisfactory to the officials of the Key System and it
was the City Manager's recommendation that the Council request the Key System to ask
the Railroad Commission for permission to make the desired change.
Councilman Maurer moved, seconded by Councilman Howe, that the Key System be requested
to change the route as indicated. On roll call the motion carried by the following •
vote. Ayes: Council= Branscheid, Howe, Maurer and President Weichhart, (4) . Noes:
Lone. Absent: Councilman "Godfrey, (1).
Report was presented from the Mayor, City Manager and Auditor concerning the
count of money held May 224 1941, advising there was at that time the amount of
670,314.50 under the control or the City Treasurer, this being the amount which
should have been in the City Treasury. There being no objections, the report was
ordered filed.
. From the City Attorney, reporting on the roe-Jest from Victor A. Kaufenberg for
the refund of fees paid for building permits amounting to T,102.50. The permits had
been issued to cover the proposed construction of an apartment building to be located •
on the easterly line of Broadway south of San Jose Avenue, which construction was sub-
sequently abandoned.
The City Attorney stated it was his opinion the Council had no authority to refund
any portion of a fee voluntarily paid for a building permit.
Councilman Maurer moved the request of Mr. Kaufenberg for the refund of 102.50 cover-
ing fees for building permits be denied. The motion was seconded by Councilman
Branscheid and on roll call carried by the following vote. Ayes: Councilmen Brans-
cheid, Howe Maurer and. President Weichhart, (4) . Noes: None. Absent: Councilman
Godfrey, (1).
10. From the City Manager, recomtnending that contract for concession privileges at
Lincoln and Washington Parks for the fiscal year 1941-1942, be awarded to Louis A.
Alexander at his bid price of 952.0O.
Councilman Maurer moved the recommendation of the City Manager be approved; that con-
tract for concession privileges at Lincoln and Washington Parka be awarded to Louis A.
Alexander at his bid rice of 952 and that checks be returned to the unsuccessful
bidders. The motion was seconded by Councilman Howe and on roll call carried by the
following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. President Weichhart,
(4) . Noes: None. Absent: Councilman Godfrey, (1).
1.. From the City Manager ,recommending that contract be awarded to Powell Bros., Inc.
for furnishing Rock, Sand and Concrete Mix to the City ot Alameda for the fiscal year
1941-1942, at the prices quoted in its bid.
Councilman Branscheid moved the recommendation of the City Manager be approved; that
contract be awarded to Powell Bros., Inc. for furnishing Rock, Sand and. Concrete Mix
to the City for the fiscal year 1941-1942, at prices bid in its proposal and that
check be returned to the unsuccessful bidder. The motion was seconded by Councilman
Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid,
Howe, Maurer and President .Weichhart, (4) . Noes: None. Absent: Councilman Godfrey, (1).
12. From the City Manager, recommending that contract be awarded to Heafey-Moore
Company for furnishing Asphaltic Concrete to the City of Alameda for the fiscal year
1941-1942, at prices submitted in its proposal.
Councilman Maurer moved the recommendation of the City Manager be approved and contract,
be awarded to Heafey-Moore Company for furnishing Asphaltic Concrete to the City for
the fiscal year 1941-1942, at the prices submitted in its bid. The motion was seconded
by Councilman Branscheid and on roll call carried by the following vote. Ayes: Coun-

13. From the City Manager, recommendi ng contract be awarded to California Corrugated
Culvert Company for furnishing Corrugated Pipe and Culverts to the City of Alameda for
the fiscal year 1941-1942, at the prices submitted in its proposal.
Councilman Branscheid moved the recommendation Of the City Manager be approved and con-

14. From the City Manager, recommending contract be awarded to N. Clark L Sons for
furnishing Vitrified ironstone Sewer Pipe to the City of Alameda for tie fiscal year
1941-1942, at the prices submitted in its proposal.
Councilman Howsmoved, seconded by Councilman Branscheid, that recommendation of the
City IT,Tanager be approved and contract be awarded to N. Clark E Sons for furnishing
Vitrified. Ironstone Sewer Pipe to the City for the fiscal year 1941-1942, at prices
submitted in its proposal. On roll call the motion carried by the following vote.
Ayes: Councilmen Branscheid, Howe, Maurer and President Weichhart, (4). Noes: None.

17. 2-rom the City Clerk, certifying no protests had been filed within the time re-
quired by law or at all in connection with Resolution of Intention No. 2580, adopted
by the Council on April 15, 1941, concerning the proposed change of grade of Webster
Street. There being no objections, the report was ordered filed and the matter re-
ferred to "Resolutions".
ORDINANCES INTRODUCED:
18. Councilman Maurer introduced the following ordinance, after which it was laid over
under provision of law and the Obarter:

20. Continued from the regular meeting of May 20, 1941, was the matter of the proposed
c1osin of portions of Second, Spruce and Cypress Streets.
At the request of the City Attorney, and on motjon of Councilman Branscheid, seconded
by Councilman Howe, this matter was again continued until the regular meeting of tune
17, 1941. On roll call, the motion carried by the following vote. Ayes: Councilman
Branscheid, Howe, Maurer and President Weichhart, (4) . Noes: None, Absent: Council-
man Godfrey, (1).
NEW 3USINESS:
21. Councilman Maurer requested the City Manager to take steps toward eliminating the
nuisance of paper carriers calling "extras" during Sundays and Holidays in the City of
Alameda, it being his opinion that this practice is only one of annoyance and the con-
tents of the papers vended not of sufficient importance to warrant this practice.
The City Manager stated he would look into the matter and endeavor to have this annoy-
ance stopped.
RESOLUTIONS:
22. The following resolution was introduced by Councilman Maurer, who moved its
adoption:

Ordering Change and Modification of the Official
Grade of that Portion. of Webster Street Lying

The motion to adopt said resolution was seconded by Councilman Branscheid and on roll

23. The following resolution was introduced by Councilman Branscheid, who moved its
