1941-08-05 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, AUGUST 5, 1941 The meeting convened at 8:00 o'clock P. M. with President Weichhart presiding. ROLL CALL: The roll was called and. Councilmen Branscheid, Howe, Maurer and President Weichhart, (4), were noted present. Absent: Councilman Godfrey, (1). MINUTES: 1. The minutes of the regular meeting of July 15, 1941, and the adjourned regular meeting of July 29, 1941, were approved as transcribed. WRITTEN COMMUNICATIONS: VI 2. A communication was read from Mr. F. A. Dailey, 3215 Bayo Vista Avenue, protesting against the awarding of the contract for the construction of the Sanitary Sewage Pump- ing Plant at Otis Drive and Court Street on the grounds the price was too high. There being no objections, the communication was ordered filed. HEARINGS: . Communications were presented from Mr. Martin Stelling, Jr. and the City Planning Board, concerning a petition for adjustment of the district requirements pertaining to property situated on the northeast corner of Taylor Avenue and Webster Street, to eli- minate the setback of 9 feet 8i inches on Taylor Avenue in connection with the pro- posed construction of a store building. This matter had originally been presented to the City Planning Board at its regular meeting held July 30, 1941, at which time only a quorum was present. The motion in favor of granting the request did not carry and therefore, in order to give the peti- tioner the privilege of appealing to the Council for a hearing, a motion prevailed that the request be denied. After the City Attorney had presented all pertinent facts with regard to the matter, Councilman Maurer moved the decision of the City Planning Board be reversed and the petition granted. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Presi- dent Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). REPORTS OF COILIITTEES: n4/ 4. From the City Manager, submitting the Tentative Budget for the City of Alameda for the fiscal year 1941-1942. There being no objections, the budget was received and referred to the Committee of the Whole. 1 5. From the City Manager, recommending contract for the construction of a Sanitary Sewage Pumping Plant at Otis Drive and Court Street be awarded to the firm of Engineers, Limited, at its total bid price of $24,648.20. Councilman Maurer moved the recommendation of the City Manager be approved; that con tract be awarded to Engineers, Limited, for the construction of a Sanitary Sewage Pumping Plant at Otis Drive and Court Street at the bid price of $24,648.20 and that check be returned to the unsuccessful bidder. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. President Weichhart, (4). Noes: None. Absent: Council- man Godfrey, (1). 6. From the City Manager, informing the Council he was compiling a brief report, which he hoped to complete and file within the next two weeks, covering the activities of the City of Alameda, showing the improvements and progress that have been made over a period of three years. Mayor Weichhart stated the report when submitted would be received with great interest. ORDINANCES INTRODUCED: 7. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-342 of the Alameda Municipal Code by Adding Subdivision (2) Thereto." UNFINISHED BUSINESS: . Upon recommendation of the City Attorney, Councilman Maurer moved that further consideration of the matter of the proposed closing of portions of Second, Spruce and Cypress Streets be postponed until the next regular meeting of the Council to be held August 19, 1941. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Presi- dent Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 9. Upon recommendation of the City Attorney, Councilman Maurer moved that further consideration of the matter of the proposed closing of that portion of Park Avenue, lying south of Roosevelt Drive, be postponed until the next regular meeting of the Council to be held August 19, 1941. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). RESOLUTIONS: 10. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2645 Appropriating $3,700.00 Out of General Fund for Publicity or Advertising for Fiscal Year Ending June 30, 1942." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). Thereupon the Mayor declared said resolution duly adopted and passed. 11. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2646 Authorizing Execution of Contract with the Alameda Chamber of Commerce for Advertising for the Fiscal Year Ending June 30, 1942." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Presi- dent Weichhart) (4). Noes: None. Absent: Councilman Godfrey, (1) . Thereupon the Mayor declared said resolution duly adopted and passed. 12. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2647 Providing for the Amount Per Diem for Officers and Employees of the City of Alameda for Traveling Expenses." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Presi- dent Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). Thereupon the Mayor declared said resolution duly adopted and passed. ORDINANCES PASSED: 13. "Ordinance No. 767 New Series An Ordinance Amending Subdivision (9) of Section 17-431 of the Alameda Municipal Code." Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Council- men Branscheid, Howe, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1). 140 "Ordinance No. 768 New Series An Ordinance Amending Section 17-344 of the Alameda Municipal Code by Adding Subdivision (40) Thereto." Councilman Branscheid moved the ordinance as read be adopted. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Form of Agreement between the City of Alameda and the Alameda Chamber of Commerce for advertising for fiscal year 1941-1942. 17. Decision No. 34460 - Before Railroad Commission of State of California, re discontinuance of certain service and operation of other service. BILLS: 18. An itemized List of Claims against the City of Alameda and the several departments thereof in the total amounts as follows, was presented to the City Council: General Departments, $4,918.22; Police Department, 140.06; Civil Service Department, $2.32; Pound Department, $26.02; Fire Department, 43952.91; Street Department, 1,136.84; Health Department, $337.68; Recreation Department, 594.51; Park Department, $1,457.06; Golf Course Department, $669.53; Store Department, 0471.63; Social Service Department, $64.04; Initiative Relief Fund, $197.00; Street Improvement Fund, $910.34; Gas Tax No. 2 Fund, $62.90; Krusi Park Fund, E56.42. Councilman Maurer moved the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on August 5, 1941, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and President Weichhart, (4). Noes: None. Absent: Councilman Godfrey, (1) . _vi At this time Mr. Frank Gottstein addressed the Council with regard to adjourning the meeting in respect to the memory of Officer Richard Britt. Mayor Weichhart expressed regret for the passing of Officer Britt and spoke in com- mendation of his many years of faithful service. 20. Councilman Maurer moved that when the Council adjourn it do so in memory of its fellow member of the City Government, Officer Richard Britt, to meet in adjourned regular meeting at 8:00 o'clock A.
