1941-09-02 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, SEPTEMBER 2, 1941 The meeting convened at 8:00 o'clock P. M. with Vice President Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4), were noted present. Absent: President Weichhart, (1). MINUTES: 1. The minutes of the regular meeting of August 19, 1941, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. A communication was presented from Mr. D. Garfinkle, requesting permission to move a dwelling known as 1123 and 1125 Park Street to Lot "C", Block 24, lying on the east side of Park Street between San Jose Avenue and Otis Drive. Councilman Maurer moved that permission be granted to move this building provided all regulations of The Alameda Municipal Code be complied with. The motion was seconded by Councilman Branscheid and unanimously carried. 3. A communication was presented from Mr. Harry Hoenes, offering to purchase two sec- tions of pipe taken from discarded lamp posts for the sum of $2.00. Councilman Maurer moved the offer of Mr. Hoenes be accepted and the pipe sold to him for the sum of 2.00. The motion was seconded by Councilman Howe and unanimously carried. ORAL COMMUNICATIONS: 4. The City Manager reported orally on the following matters: Progress being made in the installation of the storm sewer at the foot of Park Avenue, which work is now practically completed; progress in construction of the new sewage pumping plant at Court Street and Otis Drive; removal of railroad tracks on Central Avenue is about half completed and a portion of the paving has been replaced; the general improvement of Encinal Avenue is going ahead as per schedule; improvement of Webster Street is progressing splendidly, the work being approximately ten days ahead of schedule. REPORTS OF COMMITTEES: 5. From Mayor Henry A. Weichhart, requesting permission to extend his vacation period through the entire month of September, due to the necessity of medical treatment for both Mrs. Weichhart and himself. Councilman Branscheid moved this permission be granted. Mayor Weichhart. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Vice President Godfrey requested the City Clerk, when notifying Mayor Weichhart of the Council's action in this regard, to express sincere regret for the necessity of absent- ing himself from the City and convey the wishes of the Council for the speedy recupera- tion of himself and Mrs. Weichhart. 6. From the City Manager, recommending that Fire Chief Thomas M. Lane attend the Con- ference of the Pacific Coast Association of Fire Chiefs, to be held in Reno, Nevada, September 8, 9 and 10, and that a sum of not to exceed $70. be appropriated for his expenses. Councilman Maurer moved permission be granted to the Fire Chief to attend this Confer- ence and that a sum not to exceed Q. be appropriated to defray the cost. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). v 7. From the Vice President of the Council, City Manager and Auditor, reporting on the count of money held. August 20, 1941, stating there was chargeable to and under the con- trol of the City Treasurer at that time the amount of $629,733.29. There being no objections, the report was ordered filed. ORDINANCES INTRODUCED: 8. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-432 of The Alameda Municipal Code by Adding Subsections (9) , (10) and (11) Thereto." 9. Councilman Howe introduced the following ordinance, after .ich it was laid over under provision of law and the Charter: "Ordinance No. New Series An Ordinance Amending Section 17-431 of The Alameda Municipal Code by Adding Subdivision (16) Thereto." UNFINISHED BUSINESS: 10. Continued from the regular meeting of Tune 17, 1941, the matter was presented concerning the recommendation of the City Planning Board to deny the proposed re- classification of property lying on the east side of Main Street, between Brush and Maple Streets, from the "B" Dwelling District, to the "D" Commercial District. Mr. Montgomery Flynn, Attorney for the Alameda Housing Authority, addressed the Council, stating the Alameda Housing Authority requests that this matter again be continued until the next regular meeting of the Council, to be held September 16, 1941, as it is further considering the advisibility of this reclassification and will have a definite report at that time. Councilman Branscheid moved the request of the Alameda Housing Authority be granted and the matter continued until the next regular meeting. The motion was seconded by Councilman Maurer and unanimously carried. 11. The matter of the proposed closing of that portion of Park Avenue, lying south of Roosevelt Drive, was continued from the regular meeting of the City Council held August 19, 1941. There being no objections, the matter was referred to "Resolutions." 12. The matter of the proposed closing of portions of Second, Spruce and Cypress Streets, continued from the regular meeting held August 19, 1941, was, on motion of Councilman Maurer, again continued until the first regular meeting in October, 1941. The motion was seconded by Councilman Branscheid and unanimously carried. RESOLUTIONS: 13. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2653 Ordering the Closing of That Portion of Park Avenue Lying South of Southerly Line of Roosevelt Drive." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1) . Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 14. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2654 Approving Revised Budget for the Proposed Survey to Develop a Plan for the Disposal of Sewage of the Cities of the East Bay." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1) . Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 15. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2655 Amending Indeterminate Revocable Permits Heretofore Granted to the United States of America by Resolutions No. 2406 and No. 2429 and Granting Revocable Permit to Construct and. Maintain a 42 Inch Storm Drain Extending into San Antonio Estuary Across Tide and Submerged Lands of the City Adjoining the Naval Air Station." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). There- upon Vice President Godfrey declared said resolution duly adopted and passed. 16. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No, 2656 Approving and Adopting a Budget for the Fiscal Year 1941- 1942; Appropriating Certain Moneys for the Expenditures Provided in Said Budget for Said Fiscal Year, and Ratify- ing Certain Expenditures Heretofore Made." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. At this time Vice President Godfrey explained the structure of the Budget adopted by the above resolution, which provides adequately for all expenditures but does not in- craase the tax rate of the preceding fiscal year. Appreciation and commendation was expressed for the cooperation and assistance of the City Manager, other City officials and. Department Heads and also for the fine work and cooperation of various Boards which has a direct bearing in compiling the present budget and fixing the City tax rate. Vice President Godfrey also requested authority from the Council to communicate this acknowledgement and appreciation to the several Boards, which consent was given. 17. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2657 Fixing the Rate and Levying a Tax on all Real and Personal Property in the City of Alameda for the Fiscal Year 1941-1942 and Apportioning the Same Among the Several Funds of the City." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). There- upon Vice President Godfrey declared said resolution duly adopted and passed. 18. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2658 Authorizing City Manager to Make Application to Federal Works Agency on Behalf of City of Alameda for Federal Assistance in Construction of Certain Defense Public Works." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 19. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2659 Approving First Supplemental Memorandum of Agreement for Expenditure of 1/4 Cent Gas Tax for Streets of Major Importance:" The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. ORDINANCES PASSED: 20. "Ordinance No. 770 New Series An Ordinance Reclassifying Property by Adding Section 16 to Ordinance No. 725, New Series." Councilman Branscheid moved the ordinance as read be adopted. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Budget of City of Alameda for Fiscal Year 1941-1942. 24. Form of Amendment of Revocable Permit of August 19, 1939 - Between City of Alameda and United States of America - re Sewer Outfall near Naval Air Station. BILLS: 25. An itemized List of Claims against the City of Alameda and the several depart- ments thereof in the total amounts as follows, was presented to the City Council: General Departments, $1,963.26; Police Department, $231.71; Civil Service Department, $18.00; Fire Department, $232.88; Street Department, $1,780.96; Health Department, $247.55; Recreation Department, $72.23; Park Department, $2,270.37; Golf Course Department, $530.41; Store Department, $173.94; Social Service Department, $37.87; Initiative Relief Fund, $84.00; Street Improvement Fund, 0645.98; Krusi Park Fund, $17.10; East Bay Municipal Utility District Fund, $2,345.15. Councilman Maurer moved the bills and claims against the City in the amounts listed and itemized in the List of Claims filed with the City Clerk on September 2, 1941, and presented to the Council at this meeting, be allowed and paid. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . Noes: None. There being no further business to come before the meeting the Council adjourned to meet in regular session on Tuesday evening, September 16, .1941, at 8:00 o'clock P. M.
