1941-09-16 Regular CC MinutesREGULAR MEETING OF THE COUNCIL OF THE CITY OF ALAMEDA HELD TUESDAY EVENING, SEPTEMBER 16, ------ 1941 The meeting convened at 8:00 o'clock P. M. with Vice esident Godfrey presiding. ROLL CALL: The roll was called and Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4), were noted present. Absent: President Weichhart, (1). MINUTES: 1. The minutes of the regular meeting held September 2, 1941, and the special meeting held September 11, 1941, were approved as transcribed. WRITTEN COMMUNICATIONS: 2. A communication was received from Frank Fencl, requesting a permit to move a house located on property known as 2417- Harrison Avenue, Alameda, to another location. Councilman Branscheid moved that a permit be granted to Mr. Fencl to move this house, subject to all provisions of The Alameda Lunicipal Code pertaining to house moving. The motion was seconded by Councilman Maurer and unanimously carried. A communication was presented from Mr, Gus Kapler, reauesting a permit to move houses on property known as 1825 and 1827 ;iebster Street to a lot on the north side of Pacific Avenue, situated between Concordia Street and the Southern Pacific tracks, and to a lot on the east side of Schiller Street between Eagle Avenue and Clement Avenue, respectively. Mr. Gus Kapler's son addressed the Council in further explanation of this request. Councilman -Maurer moved the permit be granted to Ur. Napier to move these houses as requested, provided all regulations of The Alameda Municipal Code pertaining to house moving be complied with. The motion was seconded by Councilman,Howe and unanimously carried. 4. From Captain F. R. McCrary, Commanding Officer of the United States Naval Air Station, requesting a revocable permit granting permission to the United States of America to connect the sanitary sewers within the National Defense Housing Project to the main north side sewer of the City of Alameda. This revocable permit is in an amended form from that originally granted by the City to the United. States Government authorized by Resolution No. 2638 which was adopted on July 1, 1941. There being no objections, this matter was referred. to "Resolutions." ORAL COLMIUNICATIONS: . The City Manager renorted verbally on the following matters: Progress of the improvement of Webster Street; Improvement of Encinal Avenue from the westerly line of High Street to the easterly line of Oak Street; Progress on the installation of the sanitary sewage pumping plant at Otis Drive and Court Street; Contract has been completed on the construction of Main Street and. Atlantic Avenue and this contract is now ready for acceptance by the City. o. The City Manager stated that records of the City disclose no acceptance by the City of the railroad ties remaining on Eighth Street between Central and Lincoln Avenues, consequently the matter of having them removed at this time is questionable. Mr. Frank Gottstein addressed the Council further regarding the removal of these ties on Eighth Street. 7, Mr. Gottstein commended the Council on the progress of the improvement of Webster Street. S. Mr. Gottstein explained to the Council a proposed plan he is sponsoring and which he has presented to the City of Oakland for relieving the traffic congestion along Harrison Street near Oakland Portal of the Posey Tube. He requested the Council to commit itself either in favor of or against this idea. Mr. Gottstein advocates that traffic make a right hand turn on 6th Street, running easterly, thence turning left in a northerly direction and thence again turning left in a westerly direction down 7th Street, thus eliminating much. congestion at the inter- section of 7th and Harrison Streets. After discussion, Councilman Maurer moved that the City of Oakland be requested to work out some plan to open up the Oakland entrance of Posey Tube to relieve traffic congestion at the earliest time and in the easiest manner possible. Also, that the City Manager of Alameda be authorized to cooperate in this plan with the City of Oakland. The motion was seconded by Councilman Howe and unanimously carried. REPORTS OF C01,ILITTEES: 9. From the City Manager, recommending that the Building Inspector, E. H. Rogers, attend the Pacific Coast Building Officials' 19th Annual Convention to be held in Santa Barbara September 30, to October 3, 1941, inclusive, and that an amount not to exceed 51.). be appropriated for his expenses. Councilman Maurer noved the recommendation of the City Manager be adopted; that the Building Inspector attend this convention and an amount not to exceed ;50. be appro- priated for his expenses. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1). 10. From the City Manager, recommending that the Plumbing Inspector, A. R. Cranston be permitted to represent the City of Alameda at the Plumbing Inspectors' Conference to be held at Santa Barbara, October 9, 10 and 11, 1941, and that the sum of 50. be appropriated for his expenses. Councilman Branscheid moved the recommendation of the City Manager be adopted; that the Plumbing Inspector be authorized to represent the City at this Conference and a sum not to exceed $50. be appropriated for his expenses. The motion was seconded by Councilman 11. From the City Manager, recommending that contract awarded to Heafey-Moore Co. for the construction of Main Street and Atlantic Avenue be accepted. Councilman Branscheid moved the recommendation of the City Manager be approved and that contract awarded to Heafey-Moore Co. for construction of Main Street and Atlantic Avenue be accepted. The motion was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Dranscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). ORDINANCES INTRODUCED: 12. Councilman Branscheid introduced the following ordinance, after which it was laid over under provision of Law and the Charter: "Ordinance No. New Series An Ordinance Authorizing the Execution of a Contract for the Exchange of Certain Lands of the City of Alameda for an Easement for Public Conduit Purposes." UNFINISHED BUSINESS: 13. The matter of the proposed reclassification of the east side of Main Street between Brush and Maple Streets, from the "B" Dwelling District, to the "D" Commercial District, was presented, being continued from the meeting of September 2, 1941. A communication dated September 11, 1941, was presented from the Housing Authority of the City of Alameda, again requesting that the recommendation of the City Planning Board to deny this petition be sustained. A communication was also read from Mr. Augustin Donovan, attorney representing Mr. and Mrs. William J. Toaspern, owners of property located at the southeast corner of Pacific Avenue and Third Street, requesting the denial of the proposed reclassification of property designated in the petition. Mr. W. M. Buckley, representing the petitioner, Mrs. Esther ueiro1o, addressed the Council in favor of the reclassification and requested that the Council not dispose of the matter at this time but hold it in abeyance for sixty or ninety days. Mr. William J. Toaspern addressed the Council in explanation of his protest against this reclassification of the property involved. After discussion, Councilman Branscheid moved the recommendation of the City Planning Board be sustained and that the petition to reclassify that certain property lying on the east side of Main Street between Brush and Maple Streets, as more specifically described in the petition, be denied. The motion was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1). NEW BUSINESS: 14. Communication was presented from the City Manager, recommending that certain fire hose be purchased in the open market and without call for bids, as the present prices quoted are lower than those the City would have to pay were this hose purchased on bid. The matter was referred to "Resolutions." RESOLUTIONS: 15. The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2661 Authorizing Execution of Revocable Permit Granting Permission to the United States of America to Con- nect the Sanitary Sewers Within the National Defense Housing Project to the Main North Side Sewer." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . The following resolution was introduced by Councilman Maurer, who moved its adoption: "Resolution No. 2662 Approving the Form and Authorizing Execution of a Contract between the City of Alameda and the County of Alameda for the Distribution of Certain Payments in Lieu of Taxes to be Received by the City of Alameda from the United States of America in Connection with National Defense Housing Development No. Cal. 4112, and Rescinding the Agreement made between Said Parties and Dated. July 24, 1941." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1) . There- upon Vice President Godfrey declared said resolution duly adopted and passed. 17. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2663 Approving the Form and Authorizing Execution of a Contract between the City of Alameda and the Alameda County Mosquito Abatement District for the Distribution of Certain Payments in Lieu of Taxes to be Received by the City of Alameda from the United. States of America in Connection with National Defense Housing Development No. Cal. 4112." The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4) . The following resolution was introduced. by Councilman Maurer, who moved its adoption: "Resolution No. 2664 Approving the Form and Authorizing Execution of a Contract between the City of Alameda and the East Bay Municipal Utility District for the Distribution of Certain Payments in Lieu of Taxes to be Received by the City of Alameda from the United. States of America in Connection with National Defense Housing Development No. Cal. 4112." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . Noes: None, Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed- 19. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2665 Approving the Form and Authorizing Execution of a Contract between the City of Alameda and the East Bay Regional Park District for the Distribution of Certain Payments in Lieu of Taxes to be Received by the City of Alameda from the United States of America in connection with National De- fense Housing Development No. Cal, 4112." The motion to adopt said resolution was seconded by Councilman Howe and on roll call parried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 20. The following resolution was introduced by Councilman Howe, who moved its adoption: "Resolution No. 2666 A Resolution Authorizing the Acceptance of Certain Payments in Lieu of Taxes from the Administrator of the Federal Works Agency Approving a Form of Contract with the Federal Works Administrator with Respect Thereto, and Authorizing the Execution of Said Contract." The motion to adopt said resolution was seconded by Councilman Branscheid and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. . Absent: President Weichhart, (1) . There- upon Vice President Godfrey declared said motion carried and said resolution adopted. 21. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2667 Adopting Specifications for Furnishing Fresh Water River Sand to the City of Alameda During the Fiscal Year Ending June 30, 1942, Calling for Bids and Directing the City Clerk to Advertise the Same. " The motion to adopt said resolution was seconded by Councilman Maurer and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and. Vice President Godfrey, (4) . Noes: None. Absent: President Weichhart, (1) . Thereupon Vice President Godfrey declared said resolution duly adopted and passed. 22. The following resolution was introduced by Councilman Branscheid, who moved its adoption: "Resolution No. 2668 .Authorizing Purchase of Fire Hose in Open Market." The motion to adopt said resolution was seconded by Councilman Howe and on roll call carried by the following vote. Ayes: Councilmen Branscheid, Howe, Maurer and Vice President Godfrey, (4). Noes: None. Absent: President Weichhart, (1). Thereupon Vice President Godfrey declared said resolution duly adopted and passed. ORDINANCES PASSED: 23. "Ordinance No. 771 New Series An Ordinance Amending Section 17-432 of The Alameda Municipal Code by Adding Subsections (9), (10) and (11) Thereto." Councilman Maurer moved the ordinance as read be adopted. The motion was seconded by Councilman Branscheid and on roll call carried by the following vote. "Ordinance No. 772 New Series An Ordinance Amending Section 17-431 of The Alameda Municipal Code by Adding Subdivision (16) Thereto." Councilman Branscheid moved the ordinance as read be adopted.
